7 Revision One represents the first round of voluntary changes S-R made to the project based on input from the public,
Snohomish County Planning & development Services, the United States Fish & Wildlife Services, Washington State Department
of Fish & Wildlife, and appellant group Citizens to Preserve the Upper Snohomish River Valley/Pilchuck Audubon Society.

8 Revision Two is the result of a negotiated settlement between appellant Harvey Field and S-R. Following this revision, Harvey Field�s appeal was voluntarily dismissed with prejudice by the Hearing Examiner.

9 The United States Fish & Wildlife Service, Washington Department of Fish & Wildlife, Citizens to Preserve The Upper
Snohomish River Valley/Pilchuck Audubon Society and members of the public alleged that guy wires would cause avian
fatalities, particularly among the resident swan population as a result of collisions with guy wires which can be hard to see,
particularly at night. The applicant voluntarily changed from a guy wire supported design to a self-supporting design that
complies with the United States Fish & Wildlife Service memorandum titled �Interim Guidelines for Communications
Structures�, on file with Planning and Development Services.

10 The Federal Aviation Administration requires that all structures 200 feet and higher above ground level (AGL) must be lit and
painted according to FAA Advisory Circular AC 70/7460-1K Obstruction Marking and Lighting.

11 The United States Fish & Wildlife Service, Washington Department of Fish & Wildlife, Citizens to Preserve the Upper
Snohomish River Valley/Pilchuck Audubon Society and community input alleged that birds would be attracted to the structures
like �moths to a flame� and collide with the structures, the guy wires, or both. Further community comment focused on the
number of lights and how visible the project would be. The applicant voluntarily changed the project, lowering seven of the
antenna structures to below 200 feet. As a result, only one antenna requires illumination.
