CAAM Partnership applied in 2007 to construct an additional 50,000 Watt AM radio station with two additional towers on the Short School Road site where KRKO is currently operating without a final permit.  CPUSRV together with Angela and Bob Day appealed the issuance of a Conditional Use Permit (CUP).  After a prolonged hearing process extending over a year, the Hearing Examiner denied the CUP because of the possibility of health impact, especially in young children living or attending schools within four miles of the site.  CAAM appealed to the County Council, which in a contested 3-2 decision overrode the Hearing Examiner�s finding.  CPUSRV, together with Rick Reed and Mark Craven are appealing that Council decision in Superior Court in Seattle.  

The trial will take place on Friday morning, August 14, at 9:00 before Judge Douglass North.  The case will be argued by the lawyers based on the record without new testimony.  Our attorney, Claudia Newman, will present the case first, followed by James Tupper for CAAM, and then Ms. Newman in rebuttal.  The trial will probably last two to three hours.  While no new testimony is permitted, attendance is often noted by the judge as an indication of the seriousness of the impact on the community.  We encourage residents of the impacted communities to attend. 

Judge North�s courtroom is room W-764 in the King County Courthouse, 516 Third Ave., Seattle.
There is also an entrance from Fourth Ave.  The trial will begin at 9:00 AM precisely, and we encourage you to arrive at the Courthouse 15-20 minutes earlier.  There is a security check at the entrance.  Transportation is being arranged by car pool, and there are also good bus connections from Woodinville or Bothell Park-and- Ride lots.

Car pooling transportation will start from the Bacon residence, 14311 Kenwanda Drive (first drive on the right from Connelly Road) (360-668-3628) leaving at 7:15 AM.  Bus connections from Woodinville P&R: MT-311 at 7:30 or 7:43 to 5th & Jefferson.  Or the ST-522 express at 7:18 to 2nd & James.  The ST-522 can also be boarded at Bothell P&R at 7:33 AM.  There are also good connections from Everett on the 7:15 SOUNDER or ST-510 busses along I-5.
