I have given my daughter Susan Hickerson bonds on the City of Henderson KY in place of land. Sixth. I have given a tract of land to my son George W. Clemens Seventh. I have given to my daughter Julia Proctor a tract of land. Eight. I have given a tract of land to my son Walter Clemens Now it is my will & desire to dispose of balance of my estate as hereinafter set out. First I will & bequeath to my beloved wife Martha Clemens the home farm on which we now live suposed (sic) to be about fifty acres- for & during her natural life & I also will to my wife the thirty acre tract of land that adjoins the land of Silvester Pike & Julia Proctors land for & during her natural life- & at my wifes death said two tracts of land is to go back to my children as hereinafter set out I also will to my wife three good horses & two good milch cows & fifty dollars worth of stock hogs & all of the poultry on hand & also all of the house hold & kitchen furniture on hand & provision enough to last her for one year & provender enough to keep said stock for one year- Now I am the owner of one thousand dollars in Union County bonds & also the owner of bank stock in the Bank at Morganfield Ky-& it is my will & desire that my wife shall have for & during her natural life the yearly interest & proffits ariseing on said bonds & Bank stock & at her death said bonds & Bank stock to go to my estate. Should said county bonds cease to yield a yearly income or lost in any way to my estate, then in that event I want enough of money put on best rates of interest & well secured as will yield one hundred dollars per year & said hundred dollars per year to my wife may be raised in whole or in part by the renting of real estate. Should said bank cease to exist or the stock therein cease to yield an income or be lost to my estate in any way. Then & in that event I want as much as two hundred dollars per year raised in the same way from my estate as the one hundred dollars above mentioned & said two hundred dollars per year be paid over to my wife during her lifetime. & at her death the property yielding said two hundred dollars goes to my estate. Second. I & my wife are both growing old & feeble & I desire that my youngest son Walter Clemens. shall remain & live with me as long as I live & should my wife live longer than I do, then I wish that my said son Walter Clemens shall live with my wife until her death. & should my said son Walter Clemens remain & live with us & help to wait on & take care of us until we are both dead then & in that event at my wifes death he the said Walter Clemens is to have the home farm on which we now live & not otherwise. Third. It is my will & desire that my Curlew tract of land of about three hundred & thirty acres shall not be sold nor divided between my heirs for ten years after my death but same my be rented out & the proceeds divided as herein directed. Third. Now after carrying out my will as above made. It is my will & desire that the balance of my estate both personal & real that may remain & be on hand at my death shall be divided between my heirs as set out hereafter in this will & at my wifes death the property that comes back to my estate. that is the county bonds & bank stock or the other property that my be used to raise the yearly income of three hundred dollars for my wife & also the thirty acre tract of land till come back at my wifes death to be divided at that time between my heirs. & unless my son Walter Clemens remains with me & my wife & until the death of the longest liver as above indicated then the home place would also come back to my estate to be divided my between my heirs at my wifes death. The personal property that I give to my wife & including the income on the county bonds & bank stock & the use of & proffits (sic) ariseing (sic) on the two tracts of land she is to have & do with as she feels disposed. Now all the property that may be on hand at my death both real estate & personal under the provissions of this will & then subject to a divission (sic) & all the balance of my estate that will be subject to a divission at my wifes death under the provissions (sic) of this will. I will & bequeath as follows. First to my son Leonard J. Clemens one eight to do with as he may choose. Second. To my son Aaron Clemens one eighth to do with as he may choose. Third. To my son George W. Clemens one eight to do with as he may choose. Fourth. to my son Walter Clemens one eight to do with as he may choose. Fifth. to the children of my son William F. Clemens one eight. meaning that those that are now borned as well as those that may hereinafter be borned & should any of said children die before arriving to the age of twenty one years & without a child or children then & in that case its share shall go to its brothers & sisters & not its father. The said William F. Clemens shall not take possession of the property either personal or real without first giving bond & approved security. He the said William F. Clemens may however live with & have control of said children & have his board & nothing more out of said property. So long as he with the children & whatever kinds of property the children of my son Wm. F. Clemens may get under this will shall in no event be liable to their fathers debts. Sixth. to my daughter Susan Hickerson one eight for & during her natural life & then to the children borned of her body & should any of them die its share shall go to its brothers & sisters If the death hapens before the age of twenty one years on leaving a child or children. Security is required of my daughter before she takes possession of the property. Seventh. To the children of my deceased daughter Sarah Clemens one eight & should either of said children die before the age of twenty one years & leave no children then its share shall go to its brothers & sisters Eight. to my daughter Julia Proctor one eight for & during her natural life & at her death then to her children & should she die without leaving a child or grandchild then a live. then & in that case one half of said eight share shall go to her husband & the other half to my heirs. Now in addition to the property that I have given to my wife as above. I also give her a good buggy at my death & she shall also have all the farming utensils necessary to cultivate the lands that I have given her a life interest in. Now in addition to what I have above given in this will to my daughter Susan Hickerson I give her the tract of land I own in this county near George Willets factory suposed (sic) to be about fourty (sic) or fifty acres & to be held by her in same manner as the other property given her by this will. Now in addition to what I have already given my daughter Julia Proctor by the provission of this will & in addition to what I have so given her by this will. I also give to her the thirty acre tract of land that adjoins Julias at her Mothers death & to be held & go in same way as that given her & her children by this will. Now on reflection I will & desire that the tract of land in this county near George Willits factory shall go to my wife for & during her natural life & then at her death said land shall go to my daughter Susan Hickerson & to be held by her in the manner indicated above in this will. Clements This 9th of Feb. 1878 At a county court held for Union County at the Courthouse in Morganfield on the 1st day of August 1881 the foregoing instrument of writing purporting to be the last will and testament of Walter Clements deceased was produced to the court by Mrs Martha Clements and was fully proven by the oath of Sylvester Pike Louis J Wathen & S L Clements the subscribing witnesses thereto whereupon it was ordered that said writing be allowed and established as the last will and testament of said Walter Clements deceased and ordered to be recorded as such which is done accordingly -- Attest Gep Taylor Clkucc Ple Taylor DC.5 He was census 1880 in 1880 at Morganfield, Union County, Kentucky; Enumerated with Walter & Martha were: Walter, Hattie A. (daughter in law), Eugene P. (grandson) & Andrew McFarland (other).6 Walter died on 3 July 1881 at Union County, Kentucky, at age 76.7 Walter's will was probated at Morganfield, Union County, Kentucky, on 1 August 1881.8
