ABSTRACT

The state of emergency due to SARS-CoV-2 has meant a new

challenge for protection measures in cases of violence against
women. The rights to personal integrity and life of women need

to be effectively adapted during the pandemic, as cases of violence

increased due to the new advantages and stimulants for the
aggressor to commit the crime. For this purpose, a conceptualization

of human rights and violence against women in Peru will be made.
Then, the law that regulates these measures and the decree under

analysis will be delimited. Finally, it will be determined whether
the proposed solutions address the rights at risk.

1. IDEAS PRELIMINARES

Desde épocas del Imperio romano —e incluso mucho antes—,
el hombre ha gozado de mayores privilegios que la mujer, quien

ha llegado, incluso, a ser interpretada como un objeto a favor del

supuesto sexo superior. Esta lógica androcéntrica ha impedido que
las mujeres gocen de sus derechos humanos de manera efectiva.

Asimismo, las ha expuesto a sufrir diversos tipos de violencia por
parte, entre otros, de parejas propensas a ser agresivas en función

de presupuestos machistas. Esa violencia contra la mujer es
definida por la Convención Belém do Pará, en su artículo 1, como

«cualquier acción o conducta, basada en su género, que cause
