Smoke belching Ordinance in Limbo
The Anti-Smoke Belching Ordinance approved by the city council last December may not be implemented at all.
The Laaand Transportation Office (LTO) claims that the city government cannot implement the ordinance because aside from duplicating the function of the LTO as far as the Clean Air Act (CAA) is concerned, the city government is not (yet) accredited to assist in the implementation of the CAA.
LTO Regional Regulations Officer Romeo Jallorina said, his central office is specific--"the city government should not implement its Anti-Smoke Belching Ordinance."
The Anti Smoke Belching Ordinance proposed to test all emissions from motor vehicles and issue a Certificate of Clearance (COC) that the unit is not a smoke belcher.
In turn the COC will be used to register or reregister the vehicle with the LTO.
Jallorina says, the LTO reserves the right to issue the COC which will be required before registration can be effected at the LTO.
He said the LTO and the city government may enter into a memorandum of agreement (MOA) to assist each other in implementing the law.
City Officials entertained high hopes that the ASBO will earn money for the city's coffers.
Incidentally, the ordinance was sleeping at the city council for six years while the CAA was approved only last year.
