Litigation is the process where parties with disputes make their formal claims, file the case with the court, gather information through "discovery", engage in alternative dispute resolution, prepare the case for trial and if necessary try the case. Litigation is a high intensity activity in which the client is usually closely involved. It is no fun to be a plaintiff or a defendant in a legal action, so litigation is not engaged in lightly. Our attorneys are sensitive to the very personal and anxiety producing nature of the litigation process. We work closely with our clients in order to keep them fully informed of what is currently happening and what is likely to transpire next. The client gets copies of all pleadings and papers filed unless they do not wish to receive them. In most cases, there is about a one year time span from filing the case with the court to the trial. If the case is complex, or if there is a need to litigate collateral issues such as appeals to discovery or motions, the case can take longer.
