- Boating Law -

Yacht owners, crew members and passengers are subject to special rules about maritime injuries, contract disputes concerning maritime matters and deaths that occur on the high seas. Furthermore, the owners and operators of boats are subject to U.S. Coast Guard rules and regulations such as the Oil Pollution Act, enforcement of the Rules of the Road, safety equipment and operations requirements and licensing rules, as well as state laws that affect the safety and registration of vessels. Violation of these rules can result in fines and even jail time.

Boat owners often have problems with their insurance companies when they have a claim. For example, there is a patch clause in most boat insurance contracts. The patch clause allows the insurer to limit repainting of the hull to the damaged spot even if the effect is to create a multi shade hull. Owners find this unacceptable and the result is a disagreement and difficulty getting the work started.

Boat yards repair work and maintenance activities are another area where disagreements are common. When negotiating with boat yards, insurance companies and government agencies, a knowledge of the unique aspects of boat ownership and operations is important.

At the Law Firm of Kallis & Assoc. we have an attorney who has owned several boats up to 60', and who holds a U.S. Coast Guard Masters License. We represent you as we would want to be represented, with concern for the vessel and for its seaworthiness as well as for the emotional feelings of the owner and operator.
