| James Gray is appointed Surveyor of the road to be opened from this place crossing the Race Paths and to intersect the old road leading to Robert Knox's near Robert Thompson as reportedly the former viewer to be directed by Michael Erskine from the north corner of his saw mill field to an old cabin on this side of his grist mill and ordered that he cause the same to be opened, cleared and kept in good repair and that John Gray, Gent direct and deliver him a list of the tithables who are to attend him. Ordered that the Sheriff give publick notice that the court will at September Court next proceed to lay the County Levy. The last will and testament of Martha Gatliff, deceased was further proved by the oath of Joseph Gore another witness thereto and is ordered to be recorded. On the opposite motion of William Toney and James Pines for administration of the estate of Martha Gatliff, deceased and with her will annexed the said William Tony introduced Happy Wiley as a witness to prove his right of administration thereof to which the said James Pines by his counsel objected, and the said witness was a legatee of te decedent and as the mother of two other legatees which objection was securied by the court and the said witness admitted which opinion the said James Pines excepted and offered a bill of exceptions thereto which is signed and ju----the court that it is the most proper to grant the said administration to the said James Pines. Whereupon the said James Pines made oath according to law and certificate is accordingly granted him for obtaining letters of administration of the said decedants estate with her will annexed giving security. William Vawter and Henry McDaniel his securities entered into and acknowledged bond in the penalty of two thousand dollars for his due administration of said decedants estate the performance of his will. Ordered that Alexander Stuart, Daniel Shumate, James Henderson and James Swinney or any theree of them being first sworn appraise the personal estate of Martha Gatliff, deceased and return the appraisement to the court. John Byrnside, Gent. is appointed Surveyor of the road from this place to the fork of Turkey Creek and ordered that he cause the same to be opend, cleard and kept in good repair. Isaac Estill, Gent. is appointed Surveyor of the road from the mouth of Turkey Creek to oposite his house and ordered that he cause the same to be opened, cleared and kept in good repair and that he and John Byrnside, Gent agree and direct the tithables who are to attend each of them. James Graham, Colonel Commandant, John Handley and John Hutchison, Majors, Henry McDaniel, Jr., William Graham, Robert Nickle, John Byrnside, James Jones, Captains, James Gray, Thomas Wyatt, John Handly, Jr. and Nimrod Tackett, Lieutants and James Byrnside, Alexander Dunlap, James Thompson and John Harvey, Ensigns of Companies of the Militia of this County took the oaths appointed by law for supporting the Constitution of the United States. Joshua Leech, Captain of the Troop of Cavalry in the Militia of this couty took the oaths according to law for supporting the Constitution of the United States. Others appointed Samuel Clarke, Henry McDaniel and Matt Farley, Gent. are recommended to the Governor as proper persons to execute the offices of Captains of Companies of the Militia of this County. George swope, James gray, William Maddy, David Graham, and Tollison Shumate, Gent. recommended as proper persons to execute the offices of Lieutenants of the 'companies of te Milia of this County Ordered that the undertakers of the Court House and Jail meet at this place on the day next before September Court next to enter into bond with security for complying with their respective undertakings. At Court continued and held for Monroe County the 22nd day of May 1799. Present William hutchison, William Haynes, John Byrnsides, Jaes Stanly, James Alexander, John Gray, William Graham, William Vawter, Gentlemen Justices. The Court having fixed upon the land of James Alexander, Gent. on which he resides the place for holding the Courts of this County on the terms and under the restrictions perposed by the said James Alexander and on his giving bond to comply forwith. It is ordered that the Court House be built thereon accordingly. James Alexander, Gent. entered into bond with security according to law and compiled with what else is required for obtraining license to keep and ordinary according tothe order of yesterday. continued on page 4 |
