| The Petition of Thomas Kilpatrick against Christian Peters is continued till the next Court The Petition of the same against Truman Canter is continued till the next Court The Petition of the Jubez Johnston against James Maddy is dismissed or want of prosecution Upon the Petition of Robert Gwinn against William Johnston. It is considered b the court that the plantiff recover against the said defendant nineteen dollars and ninety nine cents together with interest for the same to be compiled after the rat of six per cent per annum from the first day of June 1799 until payment and his costs by him in his behalf expended. The Petition of Isaac Paul against Thomas Kilpatrick by the agreement of the parties is dismissed. The Petition of Mathew Mahony assinee of John Donnal against----Rezin Riston is continued till the next court. Upon the Petition of Jesse Green against Samuel Daily and James Maddy. It is considered by the court that the plantiff recover against the defendants five dollars and seventy five cents together with interest for the same to be computed after the rate of six per cent per annum from the 17 day of October 1797 until payment and his costs by him in this behalf expended. Three Petitions of John Henderson against Benjamin Harvey are continued till the next Court at the defendants costs. Upon the Petition of Robert Campbell assignee of James Harper who was assignee of John Harper against Robert Wiley. It is considered by the court that the plantiff recover against the defendant ten dollars and fourteen cents togther with interest for the same to be computed after the rate of six per cent per anum from the 17 day of September 1798 until payment and the costs. The Petition of James Elliot assignee of John Legg against James Massey is on the motion of the defendant by his attorney continued till the next court at his costs. Ordered tha Patrick Boyd pay unto Absolom Leech, fifty three cents for one days attendance at this court as a witness for the said William Gullett at the suit of Robert Nickle and John Thompson. Ordered that James Byrnside pay unto Thomas Johnston fifty three cents for one days attendance at this court as a witness for the said James Byrnside at the suit Robert Nickle and John Thompson. Ordered that William Gullett pay unto Francis Best fifty three cents for one days attendance at this court as a witness for the said William Gullett at the suit of Robert Nicke and JohnThompson. Ordered that Absolom Morris pay unto James Maddy for fifty three cents for one days attendance at this court as a witness for the said Absolom Morris days at the suit of William Maddy. Ordered that Absolom Morris pay unto Samuel Lewis, Justice fifty three cents for one days attendance at this court as a witness for the said Absolom at the suit of William Maddy. Ordered that the court be adjourned till the next court in course. The minutes of these proceedings were signed: Wm. Haynes John Hutchison. At a Court of quarterly sessions held for Monroe County at the house of James Alexander the 20th day of August 1799. Present James Alexander, William Haynes, John Gray, John Byrnside, and James Handley, Gentlemen, Justices, Irwin Benson, Foreman, William Gullett, James Boyd,, Francis Best, James Rawlins, William Campbell, John Carr, Adam Thomas, Henry McDaniel, John Blanton, James Byrnside, John Foster, Joel Stodghill, Lively McGee, John Arnott, and John Dunn were sworn a Grand Jury of inquest for the body of this County and having received their charge withdrew and after sometime returned and presented Jacob Miller on the information of the said Joel Stodghill, John Dunn and John Arnott, for retailing spirituous Liquors without license within six months last past and then the said Grand Jury having nothing further to persent wer discharged. Ordered that prosecution against Jacob Miller this day presented the Grand Jury to cause him to appear at the next court of qarterly sessions to answer the said presentment. A deed of Bargain and Sale from Cottrell Lively and Sarah his wife to Reuben Dunn was acknowledged by the said Cottrell Lively and Sarah his wife she the said Sarah being first privately examined as the law directs and is ordered to be recorded. A deed of Bargain and Sale from David Dick and Eleanor his wife to Hugh Caperton was acknowledged by the said David Dick and Eleanor his wife she the said Eleanor being first privately examined as the law directed and is ordered to be recorded. continued on page 2 |
