The reality of the Internet, as you should
be aware, is that anyone who wishes to set up a Web site can purchase
any available domain name. Since it was Jeff Xxxx's good-faith intention
to create a not-for-profit fan site, he is perfectly within his right
to do so. I see that Kyle has an official site at www.kmaynard.com -- hence Jeff's registration does nothing to prevent your developing
a Web presence.
It was your associates who contacted
Jeff seeking to acquire the domain from him-- thus, it would be rather
difficult to show that he was "profiteering" or having a "forced sale." If you wish to go
through the process of disputing the domain registration with ICANN,
you certainly can.
I would hope you are patient, as the
process can take months to begin. I'd suggest reviewing Paragraph
4(a) and 4(b) of the UDRP of 24 October 1999. Please note that all
associated fees are charged to the complainant which run from $1250
to $1500. The arbitration process, however, doesn't run on sympathies.
I should point out that if the matter
becomes confrontational, it's less likely that Jeff will be amenable
to working out an arrangement as originally discussed.
Incidentally,
as I'm just coming off a year in Israel, I'm familiar with
the Yiddish, "Du kannst nicht auf meinem rucken
pishen unt mir sagen class es regen ist." In light of your
statements, I'd suggest, an apropos response of "gai strasheh
di vantzen."*
