He was elected 2nd Lieutenant on 10 Mar 1862 and was present and accounted for until he resigned on 17 Mar 1863. The reason he resigned was not reported; however, a notation on his letter of resignation states that he was "entirely incompetent. When summoned before a Board of Examination to test his competency, he refused to stand." His resignation was accepted on 30 Mar 1863. He later served as a Sergeant in Co. "D", 10th Battalion, N.C. Heavy Artillery. He md. Mary Jane Milton, of Tally Ho, 14 Nov 1878. The marriage register says he was 38 years of age, living in Tally Ho Township, and she was age 27. They must have been anxious to be married as they were married the same day the license was issued - in the public road near Oxford! The marriage was performed by Jack Wood, a Justice of the Peace, and witnessed by J.T. Evans, W.B. Horner and John Y. Wheeler. She was b. about 1851 and d. before the 1900 Granville Co. census was taken. 277. Benjamin David Martin Wheeler 1 (Wiley E. , Benjamin , William , Martin , John , John , Henry ) was born 2, 3 on 28 Jan 1818 in Granville Co., North Carolina. He died 4 on 21 Jun 1871 in Davidson Co., Tennessee. Benjamin was counted in a census 5 in 1850 in Davidson Co., Tennessee. He was counted in a census 6 in 1860 in 3rd Civil District, Nashville, Davidson Co., Tennessee. He was counted in a census 7 in 1870 in 5th Civil District, Davidson Co., Tennessee.

On 13 May 1841, Benjamin M. Wheeler and Malinda Johnson applied for a marriage license in Williamson Co.. They must have changed their minds as on 19 Aug 1841, they applied for a license again, this time in Davidson Co.
Benjamin Wheeler was on the 1850 census in Davidson Co., where he was a farmer. An agricultural census was also taken that year to determine how many farms there were, how big they were, etc. This census showed that Benjamin Wheeler, of Davidson Co., had 35 acres of improved land and 65 acres that were unimproved. This 100 acres was valued at $600. The value of his farming implements and machinery was $100. He had four horses, 4 milch cows, 7 other cattle, 20 sheep and 31 swine that were valued at $338. Since this census was taken in August and it was just after harvest time, he had on hand; 25 bushels of wheat, 625 bushels of Indian corn, 50 bushels of oats, 20 lbs. of wool, 30 bushels of Irish potatoes, 10 bushels of sweet potatoes, 50 lb. of butter, 2 tons of hay and 50 lbs. of beeswax and honey. He also had on hand $10.00 worth of "home made manufacture" (there was nothing to indicate what this consisted of) and $30.00 worth of slaughtered animals.
It would appear that this rather large Wheeler family had a well stocked larder for the winter. Of course, some of the grain would be used as feed for the livestock, but some of it would also be ground into flour, meal, etc. for the family.
Benjamin Martin Wheeler and his family attended the Cane Ridge Methodist Church which was located "on the headwaters of Hurricane Creek of Stones River". A rather interesting, and now humorous, event occured which was recorded in the minutes of the church. A "session of Cane Ridge met at the Church ... on the 15 of Sept 1855 it being the 2 day of campmeeting ... Business taken up ... charge against Bro. Gilman of intemperance & profanity Resolved that he be cited to appear before the session to ansure [answer] to said charges Session to convean at Cane Ridge Church on the 5 Oct 1855 Witnesses Martin Wheeler, Ruffine Vaughn ... ". A committee went to see him, he acknowledged the charge and said he was sorry.
Three years later, there was a similar entry, with entirely different results. "Session of Cane Ridge met at the Church on the 3 day of July 1858 constituted by Prayer members Revr. J.L. Alexander, mod. Elders - Charles Johnson Wm. H.B. Gambill & Wm. Austin Business taken up ... B.M. Wheeler member of our church a charg of intemperance & profanity. Resolved that Bro. Austin be appointed a committe to see Brother & Converse with him on the subject & report to the next meeting of the session ...". "Session of Cane Ridge met on Sunday the second day of Campmeeting Sept 1858 Bro. Austin who was a committee to see Bro. Wheeler reported he had saw the Bro. & conversed with him & he acknowledged the charg But did not give satisfaction Resolved that Bro Austin be furthur apointed a committee to see said Bro. during campmeetin ... ". No other mention is made of Benjamin M. Wheeler in the minutes of the church. This is a good example of the independent attitude of the branch of the Wheeler family that the writer married into. I can certainly imagine one of them saying, "Stick it in your ear!"
Beginning in 1849, B.M. Wheeler began acquiring land in Davidson Co. Over the next few years he bought thirteen different parcels of land totaling about 563 acres. Some of it was around the headwaters of Hurricane Creek, another location was on the west fork of Mill Creek, in Civil District 8, and other locations. He then sold three parcels of land totaling about 109 acres. The 1860 census gave the value of his real estate as $10,000. His personal estate was valued at $3,200. By 1870, he had apparently sold off or otherwise dispersed his assets. His real estate was valued at $600 and his persoanl estate was valued at $500.

Benjamin married Malinda Johnson in 1841. Malinda was born 1 on 8 Apr 1821 in Tennessee. She died on 30 Aug 1881 in Davidson Co., Tennessee.

In 1880 she was living in the household with her grandsons Alfonso and James Brent, her daughters Rachel, Winney, and Martha Wheeler, her daughter Sarah Glymp, and Rachel's daughter, Irene Wheeler. Alfonso, at age 18, was named as head of the household.

They had the following children:

+ 866 F i Mary Nancy G. Wheeler
867 F ii Elizabeth Jane Wheeler 1 was born 2 on 4 Nov 1843 in Davidson Co., Tennessee.
+ 868 F iii Rachel M. Wheeler

Josiah married 1, 2, 3 Virginia Albertine "Jenny" Jarratt daughter of Sandford or Sanders Bowers 'Sandy' Jarratt and Elizabeth Ellender Wheeler on 5 Feb 1880 in Davidson Co., Tennessee. Virginia was born 4 on 20 Jan 1859 in Tennessee. She died on 2 Sep 1944 in Nashville, Davidson Co., Tennessee. Virginia was counted in a census 5 in 1920 in Nashville, Davidson Co., Tennessee. She was counted in a census 6 in 1930 in Nashville, Davidson Co., Tennessee.

She was living on North 4th Street in 1930, in a home valued at $500, which she owned.

278. Hiram William Wheeler (Wiley E. , Benjamin , William , Martin , John , John , Henry ) was born on 20 May 1819 in Granville Co., North Carolina. He died about 1870 in Mill Creek, Izard Co., Arkansas. Hiram was counted in a census 1 in 1850 in Davidson Co., Tennessee. He was counted in a census 2 on 18 Jul 1860 in 3rd Civil District, Davidson Co., Tennessee. He was counted in a census in 1870 in Mill Creek, Izard Co., Arkansas.

He was enumerated on 22 Aug 1850, on the Davidson Co., Tenn. census. He was counted on the census in 1860 in Davidson Co., Tennessee. He moved his family after that census was taken and in 1870 he was counted in the 1870 census in Mill Creek, Izard Co., Arkansas.
In the Izard Co. Historian dated Oct. 1983, is an article entitled Reconstruction in Izard County, was found the following: "The Gazette reported in 1869: Every day brings news of the doings of the militia in Fulton County. Of stock taken, houses robbed, and money taken in many instances. It is intolerable to bear, but alas! where is there redress, we are admonished to bear it like good citizens, which we have done. No one dared to resist or wished to violate the law, except a few who left the county and made good their escape, and good men had to suffer the loss of their hard earnings, and many ladies have been grossly insulted. But to close their devilish design, three of the militia came into our county (Izard) last Sunday night and rushed in the house of one MR. WHEELER, demanding his pistols. When Wheeler answered that he had no pistols and was too sick to get out of bed, the men shot him to death."

Hiram married 1 Mary C. Jarratt on 15 Feb 1844 in Rutherford Co., Tennessee. Mary was born 2 about 1824 in Lunenburg Co., Virginia. She died after 1880 in Mill Creek, Izard Co., Arkansas.

Mary was counted as the head of the household in 1880. The only other person in the home was her 17 year old son Robert.

They had the following children:

877 M i James K.P. Wheeler was born 1 about 1844 in Davidson Co., Tennessee. He died 2 probably bef 1870.

His name was probably James Knox Polk Wheeler.
878 M ii William B. Wheeler was born 1 about 1846 in Davidson Co., Tennessee. He died 2 probably bef 1870.
879 M iii Addison Wheeler was born 1 about 1848 in Davidson Co., Tennessee. He died before 1860 in Davidson Co., Tennessee.
880 M iv Fletcher Wheeler was born 1 in Jun 1850 in Davidson Co., Tennessee. He died before 1860 in Davidson Co., Tennessee.
+ 881 M v Nathan L. Wheeler
+ 882 M vi Josiah or Joseph Carlton Wheeler
+ 883 M vii Richard J. Wheeler
884 M viii Thomas H. Wheeler was born 1 about 1859 in Davidson Co., Tennessee. He died 2 before 1870.
+ 885 M ix Robert Price Wheeler

280. Elijah James "Lige" Wheeler 1 (Wiley E. , Benjamin , William , Martin , John , John , Henry ) was born on 13 Jan 1821 in Granville Co., North Carolina. He died on 26 Jan 1898 in Davidson Co., Tennessee. He was buried in Wheeler Burying Ground in Antioch, Tennessee. Elijah was counted in a census 2 in 1850 in Civil District 7, Davidson Co., Tennessee. He was counted in a census 3 on 7 Aug 1860 in Civil District 7, Davidson Co., Tennessee. He was counted in a census in 1870 in Davidson Co., Tennessee.

When the census was taken on 23 Aug 1850, he was living in Civil District No. 7 of Davidson Co., Tenn. On the 24th of September 1860, E.J. Wheeler paid Hays Blackman $1,590.31 for a piece of land containing a little over 31 acres, on Mill Creek in Civil District 7 of Davidson County. Then, in 1862, he sold a piece of property in Civil District 7 which contained about 33 acres. The description does not match the property he bought in 1860 and there is no deed to show how he acquired the 33 acres.
In Nov. 1870 he bought another 18 acres that joined the 31 acres he had bought in 1860. Then in Dec. 1875, for $1497, he bought another 29 1/2 acres. The deed described the land as follows: Beginning at a point in the center of Mill Creek Valley Turnpike opposite the end of a fence; and runs thence in the said Pike, S. 22 1/2 degrees ... Rains SW corner ... to the center of the N & C Railroad; thence S. 25 degrees E. with the center thereof, 49 poles to the center of Mill Creek; thence up the center of Mill Creek ... to the center of the Island, A.J. Baker's NE corner; .... with the priviledges of all drift that lodges on the west half of the Island ... .
Then in 1882, he bought the last piece of land recorded for him when he bought 13 3/4 acres from his son, Elijah Dow Wheeler. This was also on Mill Creek®)5¯4®)1¯ and the deed described it in part as "Beginning at a stone in the NW corner of A.J. Baker's land ... running thence ... to the center of Mill Creek, about 4 poles above Mill Creek Valley Pike bridge, thence down the center of said Creek ... to a point in an island ... ."
Elijah Wheeler had bought a total of 92 1/4 acres which appears to have gone from Mill Creek to the top of the hill where the Meades Chapel Church of Christ sits today. At some point, Elijah Wheeler erected a grist mill on the creek. Today the mill stones are in the yard of the second house built by his son, William R. Wheeler. The house is on the side of the hill about half way to the top.
The Meades Chapel Church of Christ and the Wheeler Burying Ground are on the land once owned by Elijah Wheeler but so far I have been unable to determine how the church came into possession of the land. Correspondence from a Mr. W.E. Simpson, a trustee of the Church and cemetery, said the lot for the church was purchased in 1897 for $50.00 but he didn't know who it was purchased from. The cemetery was already there.
Elijah James Wheeler md. Eliza Williams Ferguson, 20 Dec 1845, in Williamson Co., Tenn., with Parson M. Brogdon as bondsman. Parson Brogdon was Eliza's nephew, the son of her brother Benjamin and Edy (Wheeler) Brogdon. Eliza was the dau. of Richard C. Ferguson and Elizabeth Brogdon.
Richard C. Ferguson and Elizabeth Brogdon were md. in Granville Co., N.C., 26 Dec 1814. They were md. at the home of Elizabeth's father, David Brogdon. Richard Ferguson served in the War of 1812 and in 1850 was granted bounty land in Tenn- essee for that service. His wife later received a pension. It is said that they moved from Granville Co., N.C. to Wake Co., N.C., then to Hickman Co., Tenn. They were in Hickman Co. by 1830 and after living there for a few years, moved to Williamson Co. They were shown on the census of Williamson Co. for 1840 and 1850.
So far, in all my searching, little scandal has touched this Wheeler family. However, Eliza Ferguson's father appeared to have had a violent temper which landed him in jail at least once.
The Fergusons had not been living in Williamson Co. very long when the following appears on the records of the court:

"State of Tennessee|
Williamson County |
To the Sheriff or keeper of the County jail of said county. I herewith send you the body of a
certain Richard C. Ferguson who was brought before me, Levi Crosby, an acting Justice of the
Peace for said county, on a warrant had and obtained by his wife Elizabeth Ferguson, she
having sworn that she has just cause to fear and actually doth fear that the said Richard C.
Ferguson, her husband, will kill her or do her some great bodily harm or procure others to do
so for him and therefore that she doth pray Sureties of the Peace from him and upon the
execution and return of said warrant by Henry Jenkins a lawful Constable for the county afore-
said. The prosecutor, Elizabeth Ferguson, having by good and disintered testimony fully satisfied
me that she has just cause to be alarmed by reason of the menaces[sic] of the said Richard C.
Ferguson and he the said Richard C. Ferguson having failed or refused to enter into recognizance in
the sum of four hundred dollars with good and sufficient security to appear at the Circuit Court, to be
holden in the Courthouse in the town of Franklin, in County of Williamson, in the State above written,
on the second Monday in July next. In the mean time to keep Peace towards the good citizens of the
State, but especially towards his wife, Elizabeth Ferguson, these are therefore to command you to
receive into your custody the said Richard C. Ferguson in the ______man Jail of said county and him
safely until thence discharged by due courts of law.
Given under my hand and seal this 27 day of June 1838.
Levi Crosby, J.P."

Everything must have been resolved as they both lived a long if not entirely happy life. By 1860 their children were all gone from their home and they had moved back to Hickman Co. It was here, near Pinewood, that Richard Ferguson d. on 17 May 1869 at about age 76. Elizabeth lived another ten peaceful years, dying on 21 May 1879 at about age 79.
Eliza W. Wheeler d. 28 May 1897 and is bur. along side her husband in the Wheeler Burying Ground behind the Meades Chapel Church of Christ on Antioch Pike, Antioch, Davidson Co., Tenn.
When Elijah James Wheeler d. 26 Jan 1898 in Antioch, Davidson Co., Tenn., he did not leave a will. As with so many people, he probably had already distributed his personal possessions. The court appointed his son George to administer the estate which consisted of:

William Cook Rieves, son of Peter Franklin and Celette Louise (Cook) Rieves, 27 Dec 1882, in Davidson Co., Tenn. He was b. on 28 Feb 1851 in Williamson or Davidson Co., Tenn., d. 6 Aug 1929 in Antioch, Tenn.
On the occasion of "Aunt Sue"'s 100 birthday, a day "Aunt Sue" called "the gayest day" of her life, the neighborhood gave her a birthday party. There were over 100 people in attendance and The Nashville Tennessean wrote a story about it which ran in the 13 Feb 1949 issue. The reporter described her as "A blue-eyed lady with plump cheeks and silky white hair, usually hidden under a bonnet, Mrs. Rieves looked nearer 80 than 100, and her placid outlook seemed the chief explanation of the fact that she, the eldest of eight children [only seven have been identified, did one possibly d. as an infant?], had outlived them all."
She had never lived more tham two miles from her birthplace, never out of sight of it but one year, and never traveled further than the 18 miles to Nashville. As a girl, she attended a private school in Sulpher Springs woods, and Rough Rock school. She joined the Gethsemane Baptist Church when she was 17 but changed her membership to Mill Creek Baptist Church when she married.
Fifteen years old at the time of the Battle of Nashville, she stood in her yard and heard the cannon roar from Brentwood where the fighting was heavy. She never actually saw any of the soldiers in action but the Yankees camped across the railroad from their home and looted the farm and there were Yankee pickets who stood guard duty in her father's yard.
They had no children of their own so she and her husband took seven orphan children into their home and raised them until they were grown and married. They added three rooms to the original two room home to make room for all the children.
One of them was a Negro boy who was 3 years old when they took him in. When he was grown and ready to strike out on his own, they gave him a horse and saddle and $50. Through the years, he was the only one to keep in touch with "Aunt Sue". In 1951, he was living in Chicago. Two of the boys served overseas in WW I. When they came back to the states they came to see the Rieves. That was the last they saw of any of them.
"Aunt Sue" wrote a will in 1903 in which she stated that, "I ... own and am in possession of eleven hundred and forty dollars, cash in bank, and promissory notes drawing interest, the same being the property I inherited from my father's (E.J. Wheeler, deceased) estate ...". She instructed that her estate be divided equally between her sister, Mrs. Jennie Shacklett, and her three brothers, Elijah D., William R., and T.J.M. Wheeler, or their heirs. Her husband and her brother, George were to receive nothing because of their "financial condition". However, she outlived her husband and all her siblings.
