Tom Cruise wins $10 million in gay lawsuit

LOS ANGELES: Tom Cruise has won a $10 million judgment in a 2001 lawsuit against a gay porn star who claimed he had a homosexual encounter with the Mission: Impossible actor, Cruise's attorney said on Wednesday.

 

A Los Angeles judge entered the default judgment in late December after defendant Chad Slater admitted that his story was false and said he would not actively defend himself against the lawsuit, said Cruise's attorney Ricardo Cestero.

 

"He is very, very pleased with getting this judgment and is happy to have another ruling by a court that these stories are false and defamatory," Cestero said.

 

Slater could not be reached for comment.

 

The judgment marks the second time Cruise has prevailed in lawsuits he filed to quash rumors that he is gay.

 

In 2001, the 40-year-old actor sued Michael Davis, the Los Angeles publisher of "Bold Magazine," for $100 million after Davis claimed to have a videotape of Cruise engaged in homosexual acts.

 

The actor dropped the suit later that year after Davis retracted his claim and agreed to a stipulation that Cruise "is not, and never has been, homosexual and has never had a homosexual affair."

 

Cestero said Cruise has not decided whether to press Slater, also known as Kyle Bradford, to pay the latest judgment.

 

In his lawsuit, Cruise said Slater falsely told a French magazine called Actustar that his gay love affair with Cruise led to the actor's August 2001 divorce from actress Nicole Kidman.

 

The actor said he would donate any proceeds of the lawsuit to charity.

 

Cestero said Cruise intends to file defamation actions against anyone who spreads false rumors about him.

 

"He is very concerned and very protective about his personal reputation," Cestero told Reuters. "To the extent that people are writing stories that defame him, he is going to go after them."

Cyber stalkers to be jailed for up to 10 years

Cyber stalking is to be made a crime under Victorian law punishable by up to 10 years' imprisonment.

 

And the law covering all forms of stalking is to be extended to cover stalking even where the victim is not aware that the offence has occurred.

 

Victorian Attorney-General Rob Hulls confirmed yesterday that new legislation outlawing online stalking would be introduced early next month.

 

"That means that if a person is stalked in a chatroom; if they are stalked by e-mail; if they are stalked on the Internet, it will be illegal," Mr Hulls said.

 

"We think that it is important that the evil of stalking itself is made a crime whether or not the victim has been harmed," he said.

 

"That occurs with the law of threat to kill at the moment, whether or not the victim is aware of the threat and we believe the stalking laws should be extended to that extent."

 

The Law Institute has endorsed the new law of cyber stalking, but opposes removal of the requirement that is central to existing stalking legislation that harm or apprehension of fear actually occur.

Here, have a look at that…

            - The use of emission devices to watch the target’s movements inside his house. The Australian stalker passing the device to an accomplice. Observation building over 100metres away from the target’s building, one wall one side, couple of walls next to that side. Walls are thick (14 inches, 9 inches, 10 inches) bricked and cemented unlike the Western thin board walls. Yet the waves from the powerful emission device can pass through, giving a clear view of the target’s activities inside his residence, to the monitors.

Copycats - currently emission devices are already in use at selective places in India by certain local families or groups of local people. (Refer the Indian Stalker case forthcoming in another chapter) The victim records its use since 2000 in India by the local Indian stalkers. In 1999, when the victim returned to India, the Australian stalker covertly followed with the spy devices, for a certain time period in various parts of India, before returning back to Australia. In Australia, by 1998 high tech emission/spy devices were in use, for when the victim moved to the temple in April 1998, the temple in Melbourne was bugged out. Later on in 1999, the use of emission devices was carried over to Malaysia for monitoring from a considerable distance. By 1997, tracking devices for cars were being used by the stalker; for following and monitoring. Early January 2003 – the Australian stalker comes again to India for stalking.

    1. Even important mail posted as “registered” or high priority special mail (victim’s passport send to Indian High commission for photo renewal) gets accessed through internal contacts at the postal wing or office.

    1. Covert contact of people dealing with the victim, co-workers etc.
    2. Covert contact of victim’s work place boss, owner of work establishment, their family, Indian association members (men, women, their family) for canvassing.
  3. Life in danger?
    1. Shift in residence.
    2. Takes refuge in a far-away country-side Buddhist temple/monastery
  4. By 1998, high tech emission/spy devices were in use, for when the victim moved to the temple in April 1998, the temple in Melbourne was bugged out.
  5. Continuation of telephone tapping – use of high tech spy devices to eavesdrop into conversation through any outside public telephones, even from a considerable distance away.
  6. Victim commences use of post office mail box to prevent mail tampering.
  7. Persistent covert monitoring continues to affect the victim’s attention on his studies.
    1. More keen on avoiding the predators.
  8. Funding? Bank balance?
    1. Use of internal bank contacts to constantly track the victim’s credit and debit accounts continues.
    2. Victim shifts to using hard cash instead of electronic transaction (credit or debit) to reduce monitoring of electronic funds transfer
  9. An early morning car-crash en route to work-place and subsequent shifting to the use of bicycle, to prevent trailing cars of the predators.
    1. Covert following by the predators continue.  
  10. Change in university?
    1. Computer hacking continues – whatever information that appears on the victim’s university computer screen hacked as it is.
    2. Internet surfing, private emails – all open.
    3. Use of emission devices continues.
  11. Shifts the mode of transport again to long distance walking and the use of public transport.
    1. Covert following by the predators continue.  

 

1999

Malaysia

  1. Change in nation?
    1. Victim leaves for Malaysia for job hunting, interview.
    2. Stalker follows with spy devices.
  2. After job assurance, victim returns back to Australia, to prepare for the final leaving of the nation.
    1. Farewell to Australia.
  3. Stalker follows again to Malaysia.
  4. Later on in 1999, the use of emission devices was carried over to Malaysia for monitoring of the victim, from a considerable distance away.
  5. Covertly follows the victim to different parts of Malaysia (Ipoh, Kedah etc)

 

India

  1. Change of nation again?
  2. In 1999, when the victim returned to India, the Australian stalker covertly followed with the spy devices, for a certain time period, stalking in various parts of India (Delhi, Rajasthan etc) before returning back to Australia.

 

2000

India

  1. The victim records spy device use since 2000 in India by the local Indian stalkers.
  2. Copycat Indian stalker moves in to the victim’s neighborhood, by staying in a nearby educational building.
  3. Covert visual observation or surveillance of the target from the neighborhood.

May 2003

Satellite stalking in the city of Thiruvananthapuram, Kerala, India. The local stalking group uses GPS to track the movements of the victim within the Thiruvananthapuram city and its outskirts. With satellite stalking, it is NOT only the movements of the car along which route, is tracked but more detailed information about the occupants are also trespassed upon. The small transmitterº, is so powerful that whatever details that go on inside the car can easily be seen by the stalkers from a long distance away. Say you park your car, and have a cat-nap. They see your cat-nap!

º This tracking device is advanced than the older ones being connected to the radiator area (Reference: Orland, Kevin. (Thursday, February 06, 2003) Satellite stalking: Latest hi-tech crime. USA: Associated Press.), it is lodged in the car somewhere else which the victim haven’t located, for the victim checked under the hood of the car.

June 2003

The victim suspects the presence of a hidden high power audio device in his parent’s car. For some of the family conversation that occur while traveling in the family car, with his parents, or between his parents, the stalkers receive immediately along with what ever you do while traveling in the car along with your parents, even scratching an itch etc. The stalkers can thus plan adequately, modify their covert schemes depending on the ever changing scenario, to way-lay you where ever you go…for coincidences…For example, you along with your parents, go somewhere to see someone. Along the way, you change plans to go elsewhere, a new place. The predators by monitoring through their spy devices and satellite tracking also know your change in plans, and thus prepare to waylay you at the new place.

Pretexting is the practice of collecting information about a person using false pretenses. Typically, investigators pretext by calling family members or coworkers of the victim under the pretense of some official purpose. This can include calls made under the pretense that the victim is about to receive a sweepstakes award or insurance payment. The family members or coworkers called are deceived by the pretexter, and provide personal information on the victim.

The time frame given above is important for various reasons – criminal prosecution, court cases, the commencement of predatory use of such devices when they became available in the market.

One effect of this documentation is that for a serious reader, the ethical question on safety, security, privacy etc in a modern advanced nation like Australia opens up. All those pages and pages of law, rules and regulations etc on privacy, personal security are all nothing…just nothing. You just need the right contacts only. You can do anything you want on anyone, man or woman. To all those advocates of privacy rights worldwide as well as those in advanced Western nations – what will be the response to this documentation?? Now they are making more electronic. Documentation of your purchases, your bank accounts etc - all being fed to a centralized database for monitoring in USA. More invasive to privacy. With the net result to prevent intrusion even by common predators, you really, really have to run away into seclusion where there is no technology – forests, deserts etc. For in the days of doom, the forces of Devil control everything inside out. They will even number men and women, as the trend goes.

When you have women as stalkers, you have a compounded or complicated situation compared to men as stalkers. Their sexuality, being their thump card. Can go into anywhere, talk to any person, especially men, talk them over, bribe them, or even seduce them etc.

When you have multiple women stalkers and the joining of forces, their advantage increases.

The advantage again increases when some of them have a very “free” life style (where the concept of “shame” becomes diluted or a matter of less importance). Practically any man can be cornered. Any man trying to impose the law can be tempted to favouritism. Turning the other way while the women carry on their monitoring. The law can even be made to act as “complete lack of awareness” of what was going on right in the middle of the city or even near the centre of the ruling government. Such is the power of those “painted” (make-up) faces. Just smile…If not, a touch, …it won’t take that long for many a society man to follow their wishes.

Being woman, add parental or family support. Something rare for men stalkers – to have the parental support; for modern men do what they desire.

Imagine the revised roles. If a woman was watched, monitored and followed by a man or a group of men with her home bugged out, how will the woman victim feel? If those predators and stalkers have changed cap and imagined the feelings of a victim, things would have been a lot different…
