WHAT ABOUT THE CONTRACT I SIGNED WITH THE BOSS?
There seems to be a lot of confusion with independent contractor contracts. For the most part, in the case of fast food delivery drivers, they are meant to circumvent the law. The problem is that the employer doesn’t know what the law is. Some contracts are ridiculous. Some, like the one I am currently working under, have all the earmarks of an employee relationship, while others are more sinister. Most companies don’t use employment lawyers and most don’t know what they are doing.
Regardless, the distinction between an employee and an independent contractor is not governed by the terms of the contract necessarily, but by the actual working relationship between you and your boss.
An example: One of my contracts said I could hire helpers to do, or complete my job. On investigation it was found I could not. The company controlled who delivered their pizzas.
