Structure Sar'i

Ibadah. In law islam is recognized by five law types arranging
problems of people religious service. All the
laws must by virtue of correct theorems that is
Al-Quran and
Hadist big prophet of Muhammad SAW
Five law theorem types is :
1. Mandatory
Be obliged to mean comand to execute an observance as according to
loaded and foundation which have been specified . The
comand is accompanied by reward for which will do and
dubious for which do not want to do. Simply is
recognized as statement " That be obliged to meaned if
it is done will get reward and if it is leaved will get
sin from God and expressed as one who to deny to God
comand "
2. Circumcision
Circumcision means comand to execute an
observance as according to loaded and foundation which
have been specified. Governed this circumcision applies
to whom which ready to execute it. This circumcision
comand accompanied with reward for which will execute it
and there is no dubious for not ready to execute it.
Simply is recognized as statement " Circumcised that
means if it is done gets reward from God and if it is
leaved not to get sin "
3. Illicit Circumcision
Illicit. Illicit meaned comand to leave an
other observance or deed as its the which have been
specified. The comand is accompanied dubiously for
denying and remain to does it and reward reward for
which ready to leave it. Simply is recognized as
statement " Illicit of that meaned if it is done gets
sin and if it is leaved gets reward from God "
4. Makruh
Makruh. Makruh means comand to leave an
observance to which ready to leave it. This makruh
comand accompanied with reward for wanting out it and
there is no dubious for which is permanent . Simply is
recognized as statement " Makruh meaned if it is done
innocent, if it is diditinggalkan will get reward from
God "
5. Mubah
Mubah. Mubah or recognized also by having to means comand to
enable to do or doesn't do an observance. This mubah
comand is not accompanied dubiously for doing or doesn't
do. Simply is recognized as statement " Mubah meaned if
it is done not to get reward and if it is leaved nor
sinned "
Out of five kinds of law type which has been
submitted at study before all ( Mandatory,
Circumcision, Illicit, Makruh, Mubah ) called as with
law sar'i. Stipulating of law sar'i is based to two
considerations or refers to two kinds of reference
theorem that is :
A. Theorem Naqli
Theorem Naqli. Theorem naqli is theorem which
based on to stipulating which have been specified God
and Rasulullah Muhammad SAW. The stipulating in the form
of stipulating having the character of sure and or
stipulatings requiring further interpretation
Based on its the structure and level.
Distinguishable naqli theorem to four levels. The level
is high rise structure. Mean Theorem residing in at
lower level may not interfere in or at variance with
theorem residing in to it. If found by theorem that is
is each other interferes in, or law theorem sar'i which
is incompatible between one theorems with other theorem,
hence theorem used is nearest theorem of its the
understanding with theorem residing in to it
Law theorem structure sar'i is :
1. Al-Quran
Holy Book Al-quran. Holy Book Al-Quran occupies first sequence in
law structure sar'i. Understanding of Al-qur'an as law
theorem sar'i is as according to position of Al-Quran as
source of highest law. Every stipulating of law sar'i
must and absolute may not be against holy book of Al-quran
2. Hadist
Hadist. Hadist in law structure sar'i occupies
second sequence after holy book of Al-Quran. Mean hadist
its the position is acurate resided in under Al-Quran as
law book. Position of hadist in law structure sar'i
haves the character of interpretation and explanation of
from laws sar'i which have been specified in Al-Quran as
highest law book.
3. Ijmak
Ijmak. Ijmak means agreement some people to a
problem of law arising in punishing sar'i. The problems
limited to problem which in Al-Quran as main law book
and hadist as detail of explanation of Al-Quran is not
found annotations that is clear or detailed annotations.
Stipulatings of law sar'i with this ijmak
method may not be stipulating of separate law. But
remain to be explanation of law residing in to of
berrdasarkan wawasaan of the moslem scholars which has
mastered its the science is carefully. And benefit
principality balance and its the mudharat from a
stipulating of law to believer
4. Qiyas.
Qiyas. Qiyas means looks for equation from law
sole sari'i is arising with laws which have been
specified in Al-Quran and Hadist and law ijmak.
Equation stipulating of law sar'i with visible Qiyas method at
stipulating of alcohol law compared to by khamar.
Statement of alcohol there are no in Al-Quran and hadist,
but the alcohol has the same impact with khamar yatu
inebriating beverage.
Stipulating of law qiyas, side still refer to
Al-Quran as law book and as basis main law. permanent
Qiyas Law cannot be specified promiscuouslyly. Law qiyas
but having to based on opinion of the moslem scholars
and the related experts, based on benefit principality
and badness of matching with Al-Quran and hadist.
B. Theorem Aqli
Theorem aqli means law theorem sar'i matching
with man common sense. Man who psychologically
experiences psychological convulsion have no business
specify mind law. Its the opinion is mandatory to be
refused.
Stipulating of theorem aqli in punishing sar'i
is done after paying attention and studies law - law
sar'i based on theorem - dali naqli circumspectly
This aqli theorem bears some law types that is :
1. Mandatory.
Mandatory. Mandatory in theorem aqli at law
sar'i is mandatory at mind. Mean all stipulating of law
sar'i which sidah specified to be acceptable by man
common sense. Mandatory good in mind receives it is and
or mandatory in mind to refuse it
2. Impossible.
Impossible. Impossible in theorem aqli at law sar'i is impossible
at mind. Mean all stipulating of law sar'i which sidah
specified to be impossible received by man common sense.
Impossible good in mind receives it is and or impossible
in mind to refuse it
3. Jaiz or possibly.
Jaiz. Jaiz or possible in theorem aqli at law
sar'i is possible at mind. Mean all stipulating of law
sar'i which have been specified possibly received by man
common sense. Possible good in mind receives it is and
or possible in mind to refuse it
Law jaiz or this possible arisings from
limitation of man mind in interpreteng a problem of
