(Computer Crime Act B.E. ........) แปลโดยนักแปลอิสระ มงคล ตันติสุวิทย์กุล ในปี 2545 Translated by Mr. Mongkol Tantisuvitkul in 2002 บันทึกหลักการและเหตุผล (Explanatory Memorandum) ประกอบร่างพระราชบัญญัติว่าด้วยอาชญากรรมทางคอมพิวเตอร์ พ.ศ. ....... (to the Computer Crime Bill B.E. ………….) หลักการ (Principle) ให้มีกฎหมายว่าด้วยอาชญากรรมทางคอมพิวเตอร์ (To have a law on computer crime.) เหตุผล (Reasons) เนื่องจากในปัจจุบันมีการกระทำความผิดต่อข้อมูลและระบบคอมพิวเตอร์เป็นจำนวนมาก ซึ่งส่งผลกระทบต่อสังคม เศรษฐกิจ และความมั่นคงของรัฐ ทั้งการปราบปรามกระทำได้ยากและอยู่นอกเหนือขอบเขตของกฎหมายที่ใช้บังคับอยู่ในปัจจุบัน ดังนั้นเพื่อประโยชน์ในการป้องกันและปราบปรามการก่ออาชญากรรมดังกล่าว สมควรบัญญัติความผิดและมาตราการต่างๆ ให้สามารถดำเนินการป้องกันและปราบปรามได้อย่างมีประสิทธิภาพ จึงจำเป็นต้องตราพระราชบัญญัตินี้ (At present there are a number of offences committed to data and computer systems which cause socio-economic and security impacts. In addition, their suppression is difficult to be carried out and beyond the scope of law currently enforced. Accordingly, for the benefit of prevention and suppression of such crimes, it is appropriate to provide for offences and sections to enable prevention and suppression to be carried out in an efficient manner. (Computer Crime Act B.E. ........) ______________________________________________________________________ โดยที่เป็นการสมควรให้มีกฎหมายว่าด้วยอาชญากรรมทางคอมพิวเตอร์ (Whereas it is expedient to have the law on computer crime;) ______________________________________________________________________________________ ______________________________________ มาตรา 1 พระราชบัญญัตินี้เรียกว่า "พระราชบัญญัติว่าด้วยอาชญากรรมทางคอมพิวเตอร์ พ.ศ. ........" (Section 1. This Act shall be called "The Computer Crime Act, B.E. ............" .) มาตรา2 พระราชบัญญัตินี้ให้ใช้บังคับเมื่อพ้นกำหนดหนึ่งร้อยยี่สิบวันนับแต่วันประกาศในราชกิจจานุเบกษา เป็นต้นไป (Section 2. This Act shall come into force after one hundred and twenty days from the date of its publication in the Government Gazette.) มาตรา 3 ในพระราชบัญญัตินี้ (Section 3. In this Act :) "ระบบคอมพิวเตอร์" หมายความว่า อุปกรณ์หรือชุดอุปกรณ์ที่เชื่อมการทำงานเข้าด้วยกัน โดยได้มีการกำหนดชุดคำสั่งและแนวทางปฏิบัติงานให้อุปกรณ์หรือชุดอุปกรณ์ที่ทำหน้าที่ประมวลผลข้อมูลโดยอัตโนมัติ ("Computer System" means a device or a set of devices whose functions are linked together through the setting of a program and directive which enables the device or the set of devices to process data automatically.) "ข้อมูลคอมพิวเตอร์" หมายความว่า ข้อมูล ข้อความ หรือชุดคำสั่งที่อยู่ในสภาพที่ระบบคอมพิวเตอร์ประมวลผลได้ ("Computer Data" means data, statements or a program in a state that is capable of being processed by a computer system.) "ข้อมูลจราจรทางคอมพิวเตอร์" หมายความว่า ข้อมูลคอมพิวเตอร์ที่เกิดขึ้นจากระบบคอมพิวเตอร์อันเป็นส่วนหนึ่งของการติดต่อสื่อสาร ซึ่งแสดงถึงแหล่งกำเนิด ต้นทาง ปลายทาง เส้นทาง เวลา วันที่ ปริมาณ ระยะเวลา ชนิดของบริการ หรืออื่นๆ ที่เกี่ยวข้องกับการติดต่อสื่อสารนั้น ("Computer Traffic Data" means computer data generated from a computer system which is part of communications and represents the origin, source, terminal, route, time, date, quantity, period, service type or other information which is related to such communications.) "พนักงานเจ้าหน้าที่" หมายความว่า ผู้ซึ่งรัฐมนตรีแต่งตั้งให้ปฏิบัติการตามพระราชบัญญัตินี้ ("Competent Authority" means a person who is appointed by the Minister to act in accordance with this Act.) "รัฐมนตรี" หมายความว่า รัฐมนตรีผู้รักษาการตามพระราชบัญญัตินี้ ("Minister" means the Minister in charge of the enforcement of this Act) _____________________________ โครงการพัฒนากฎหมายหมายเทคโนโลยีสารสนเทศ (2 พฤษภาคม 2545) (The Legal Development Project on Information Technology (May 2, 2002)) สำนักงานเลขานุการคณะกรรมการเทคโนโลยีสารสนเทศแห่งชาติ (National Information Technology Committee Secretariat) ศูนย์เทคโนโลยีอิเล็กทรอนิกส์และคอมพิวเตอร์แห่งชาติ (National Electronics and Computer Technology Center (NETEC)) สำนักงานพัฒนาวิทยาศาสตร์และเทคโนโลยีแห่งชาติ (National Science and Technology Development Agency (NSTDA)) กระทรวงวิทยาศาสตร์ เทคโนโลยีและสิ่งแวดล้อม (Ministry of Science, Technology and Environment) มาตรา 4 ให้นายกรัฐมนตรีรักษาการตามพระราชบัญญัตินี้ และให้มี่อำนาจแต่งตั้งพนักงานเจ้าหน้าที่ ออกกฎกระทรวง ระเบียบ และประกาศ เพื่อปฏิบัติการตามพระราชบัญญัตินี้ (Section 4. The Prime Minister shall be in charge of the enforcement of this Act and have the power to appoint competent authorities and issue ministerial regulations, rules and notifications for the execution of this Act) กฎกระทรวง ระเบียบ และประกาศนั้น เมื่อได้ประกาศในราชกิจจานุเบกษาแล้วให้ใช้บังคับได้ (Such ministerial regulations, rules and notifications shall come into force upon their publication in the Government Gazette.) หมวด 1 (Chapter 1) ความผิดเกี่ยวกับการรักษาความลับ ความครบถ้วน (offences relating to secrecy, integrity) และการทำงานของข้อมูลคอมพิวเตอร์และระบบคอมพิวเตอร์ (and the functioning of computer data and computer systems) มาตรา 5 ผู้ใดเข้าถึงโดยมิชอบซึ่งระบบคอมพิวเตอร์ที่มีวิธีการป้องกันการเข้าถึงโดยเฉพาะและมิได้มีไว้สำหรับตน ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ (Section 5. Whoever wrongfully accesses a computer system which has a specific protection method against being accessed and not available for oneself shall be punished with imprisonment not exceeding two years or a fine not exceeding forty thousand baht, or both.) มาตรา 6 ผู้ใดเข้าถึงโดยมิชอบซึ่งข้อมูลคอมพิวเตอร์ที่มีวิธีการป้องกันการเข้าถึงโดยเฉพาะและมิได้มีไว้สำหรับตนที่เก็บหรือส่งโดยวิธีการทางอิเล็กทรอนิกส์ ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ (Section 6. Whoever wrongfully accesses computer data which has a specific protection method against being accessed and not available for oneself which is stored or transmitted by means of electronics shall be punished with imprisonment not exceeding three years or a fine not exceeding sixty thousand baht, or both.) มาตรา 7 ผู้ใดกระทำการใดๆ โดยมิชอบด้วยวิธีการทางอิเล็กทรอนิกส์ เพื่อล่วงรู้หรือดักรับไว้ซึ่งข้อมูลคอมพิวเตอร์ของผู้อื่นที่อยู่ระหว่างการส่งในระบบคอมพิวเตอร์ ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ (Section 7. Whoever commits any wrongful act by means of electronics to uncover or intercept another person's computer data which is in the course of transmission in a computer system shall be punished with imprisonment not exceeding three years or a fine not exceeding sixty thousand baht, or both.) มาตรา 8 ผู้ใดกระทำโดยมิชอบด้วยการลบ ทำให้เสียหาย ทำลาย ทำให้ไร้ประโยชน์ แก้ไข เปลี่ยนแปลง หรือเพิ่มเติมข้อมูลคอมพิวเตอร์ของผู้อื่นทั้งหมดหรือแต่บางส่วน ต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ (Section 8. Whoever performs a wrongful act by deleting, damaging, rendering useless to, amending, modifying or making an addition to another person's computer data in whole or in part shall be punished with imprisonment not exceeding five years or a fine not exceeding one hundred thousand baht, or both.) มาตรา 9 ผู้ใดกระทำโดยมิชอบด้วยประการใดๆ อันเป็นการรบกวนการทำงานของระบบคอมพิวเตอร์ ต้องระวางโทษจำคุกไม่เกินเจ็ดปี หรือปรับไม่เกินหนึ่งแสนสี่หมื่นบาท หรือทั้งจำทั้งปรับ (Section 9. Whoever performs a wrongful act in any manner whatsoever which causes interference to the operation of a computer system shall be punished with imprisonment not exceeding seven years or a fine not exceeding one hundred forty thousand baht, or both.) มาตรา 10 ถ้าความผิดตามมาตรา 5 ถึงมาตรา 9 เป็นการกระทำที่เกี่ยวกับความมั่นคงของรัฐ ความสัมพันธ์ระหว่างประเทศ ความมั่นคงทางเศรษฐกิจหรือการคลังของประเทศ หรือของหน่วยงานของรัฐที่มีความสำคัญเป็นพิเศษเพื่อใช้บังคับการให้เป็นไปตามกฎหมาย ผู้กระทำต้องระวางโทษหนักกว่าที่บัญญัติไว้ในมาตรานั้นๆ กึ่งหนึ่ง (Section 10. If the offences committed under Sections 5 to 9 are concerned with public security, international relations, national economic or fiscal security or government agencies that are of special importance for enforcement the compliance of law, the offender shall be liable to heavier punishment than that as provided in the corresponding sections by one half.) ผู้ใดตระเตรียมเพื่อกระทำความผิดหรือพยายามกระทำผิดตามวรรคหนึ่ง ต้องระวางโทษเช่นเดียวกับผู้กระทำความผิด (Whoever makes preparation or attempt to commit any offence under paragraph one shall be liable to the same punishment provided for such offender.) มาตรา 11 ผู้ใดเพื่อกระทำความผิดตามมาตรา 5 ถึงมาตรา 10 มีไว้ในครอบครอง ผลิตแจกจ่าย ขาย เสนอขาย แลกเปลี่ยน เสนอแลกเปลี่ยน ซื้อ ใช้ มีไว้เพื่อใช้ ส่งออกไปหรือนำเข้ามาในราชอาณาจักร ซึ่งสิ่งต่างๆ ดังต่อไปนี้ (Section 11. Whoever, in order to commit the offence prescribed in Sections 5 to 10, has in possession of, produces, distributes, sells, offers for sale, exchanges, offers for exchange, purchases, uses, possesses for use, export or import the following items) (1) อุปกรณ์ รวมถึงข้อมูลคอมพิวเตอร์ซึ่งออกแบบหรือดัดแปลงขึ้นเป็นการเฉพาะ (Equipment including computer data which is specifically designed or modified;) (2) รหัสผ่าน รหัสการเข้าถึง หรือข้อมูลใดในลักษณะคล้ายคลึงกันเพื่อให้เข้าถึงระบบคอมพิวเตอร์ (Passwords, access codes or any similar data to access a computer system;) ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองหมื่นบาท หรือทั้งจำทั้งปรับ (shall be punished with imprisonment not exceeding one year or a fine not exceeding twenty thousand baht, or both.) หมวด 2 (Chapter 2) ความผิดเกี่ยวกับคอมพิวเตอร์ (offences relating to computers) มาตรา 12 ผู้ใดทำปลอมขึ้นทั้งหมดหรือแต่บางส่วนซึ่งข้อมูลคอมพิวเตอร์ที่แท้จริงของผู้อื่นที่เป็นหลักฐานทางกฎหมาย หรือทำให้ข้อมูลคอมพิวเตอร์ดังกล่าวผิดไปจากเดิม โดยประการที่น่าจะเกิดความเสียหายแก่ผู้อื่นหรือประชาชน ถ้าได้กระทำเพื่อให้ผู้หนึ่งผู้ใดหลงเชื่อว่าเป็นข้อมูลคอมพิวเตอร์ที่แท้จริง ต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ (Section 12. Whoever counterfeits another person's genuine computer data in whole or in part which is legal evidence or alters computer data from its original state in a manner likely to cause injury to another person or the public, if it is committed in order to make any person to believe that it is genuine computer data, shall be punished with imprisonment not exceeding five years or a fine not exceeding one hundred thousand baht, or both.) มาตรา 13 ผู้ใดโดยทุจริต แก้ไข เปลี่ยนแปลง ลบข้อมูลคอมพิวเตอร์ หรือนำข้อมูลคอมพิวเตอร์เข้าสู่หรือรบกวนการทำงานของระบบคอมพิวเตอร์ของผู้อื่น และโดยการกระทำดังกล่าวทำให้ได้ประโยชน์ในลักษณะที่เป็นทรัพย์สินจากผู้นั้นหรือบุคคลที่สาม ต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ (Section 13. Whoever dishonestly changes, modifies, deletes computer data or loads computer data on or interfere the operation of another person's computer system and such act results in a benefit in the nature of being a property from such person or a third person, shall be punished with imprisonment not exceeding five years or a fine not exceeding one hundred thousand baht, or both.) มาตรา 14 ผู้ใดกระทำด้วยประการใดๆ โดยวิธีการทางอิเล็กทรอนิกส์ เพื่อให้ปรากฏแก่ประชาชนด้วยการผลิต ส่งผ่าน จัดให้ได้มา หรือทำให้แพร่หลายซึ่งข้อมูลคอมพิวเตอร์ที่เป็นสิ่งลามากอนาจารโดยใช้ระบบคอมพิวเตอร์ ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ (Section 14. Whoever, by any electronic means whatever, does any act by production, transmission, acquisition or circulation in order to cause the appearance of obscene computer data by using a computer system, shall be punished with imprisonment not exceeding three years or a fine not exceeding sixty thousand baht, or both.) ถ้าสิ่งลามกอนาจารตามวรรคหนึ่งเกี่ยวกับบุคคลอายุไม่เกินสิบแปดปี ไม่ว่าผู้กระทำจะรู้หรือไม่ก็ตาม ผู้กระทำต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ (If the obscene material under paragraph one is concerned with a person not yet over eighteen years of age, whether an offender is aware of or not, such offender shall be punished with imprisonment not exceeding five years or a fine not exceeding one hundred thousand baht, or both.) หมวด 3 (Chapter 3) อำนาจหน้าที่เจ้าพนักงาน (Authority of Officers) มาตรา 15 ในกรณีที่มีเหตุอันควรเชื่อว่าได้มีการกระทำที่เป็นความผิดตามที่บัญญัติไว้ในพระราชบัญญัตินี้ และหากปล่อยเนิ่นช้ากว่าจะเอาหมายค้นมาได้ สิ่งของไม่ว่าจะจับต้องได้หรือไม่ก็ตามหรือพยานหลักฐานที่เกี่ยวกับการกระทำความผิดอาจถูกยักย้าย ซุกซ่อน ทำลายหรือทำให้เปลี่ยนสภาพไปจากเดิม ให้พนักงานเจ้าหน้าที่มีอำนาจเข้าไปในเวลาใดๆ ในเคหะสถานหรือสถานที่ที่มีเหตุอันควรสงสัยว่ามีการซุกซ่อนหรือเก็บรักษาทรัพย์สินหรือพยานหลักฐานที่เกี่ยวกับการกระทำความผิด เพื่อทำการเข้าถึงและตรวจสอบระบบคอมพิวเตอร์หรือสิ่งอื่นใดที่มีเหตุอันควรเชื่อได้ว่าเกี่ยวเนื่องกับการกระทำความผิด ยึด อายัด ทำสำเนา หรือดำเนินการอื่นใดซึ่งระบบคอมพิวเตอร์หรือข้อมูลคอมพิวเตอร์ เพื่อใช้เป็นพยานหลักฐานที่เกี่ยวกับการกระทำความผิด (Section 15. Where there is a reasonable ground to believe that an offence prescribed under this Act has been committed and if left delayed until a warrant of search is issued, the article whether being tangible or not or the evidence related to such offence may be removed, hidden, destroyed or altered from its original state, the competent authority shall have the power to enter at any time into a dwelling place or a place where there is a reasonable ground to suspect that the property or the evidence connected with the commission of an offence is hidden or kept therein, for the purpose of accessing and investigating a computer system or any other article with reasonable grounds to believe that it is involved in the commission of an offence, seizing, attaching, making a copy of or performing any other act on the said computer system or computer data, to use as evidence in connection with the commission of such offence.) การค้นยานพาหนะของผู้อื่นในที่สาธารณสถานเพื่อให้ได้มาซึ่งพยานหลักฐานเกี่ยวกับการกระทำความผิดตามพระราชบัญญัตินี้ ให้นำบทบัญญัติว่าด้วยการค้นบุคคลในที่สาธารณสถานตามประมวลกฎหมายวิธีพิจารณาความอาญามาใช้บังคับโดยอนุโลม (The provisions relating to the search of a person in a public place under the Criminal Procedure Code shall apply mutatis mutandis for the search of another person's vehicle in a public place in order to acquire the evidence connected with the commission of an offence under this Act.) มาตรา 16 ในกรณีมีเหตุอันควรสงสัยว่าน่าจะมีการกระทำความผิดตามพระราชบัญญัตินี้ ให้พนักงานเจ้าหน้าที่มีอำนาจเข้าตรวจข้อมูลคอมพิวเตอร์อันเป็นหลักฐานหรือคาดหมายได้ว่าจะเป็นหลักฐานเกี่ยวกับการกระทำความผิดดังกล่าว (Section 16. Where there is a reasonable ground to suspect that an offence under this Act is likely to be committed, the competent authority shall have the power to make a search of computer data which is the evidence or expected to be the evidence connected with the commission of such offence.) เพื่อประโยชน์แห่งการแสวงหาข้อเท็จจริงและรวบรวมหลักฐาน ให้พนักงานเจ้าหน้าที่มีอำนาจดังต่อไปนี้ (For the purpose of the seeking of facts and collection of evidence, the competent authority shall have the following powers :) (1) เรียกข้อมูลจราจรทางคอมพิวเตอร์จากผู้ให้บริการเกี่ยวกับการติดต่อสื่อสารระบบคอมพิวเตอร์หรือจากบุคคลอื่นที่เกี่ยวข้อง (demand computer traffic data from a service provider concerned with the communications on a computer system or other concerned persons.) (2) ในกรณีที่มีการเข้ารหัสลับของข้อมูลคอมพิวเตอร์ สั่งให้บุคคลที่เกี่ยวข้องกับข้อมูลคอมพิวเตอร์นั้นทำการถอดรหัสลับ (In case the computer data has been encrypted, order a person concerned with such computer data to decrypt it.) (3) มีหนังสือสอบถามหรือเรียกบุคคลใดๆ ที่เกี่ยวข้องกับการกระทำดังกล่าวเพื่อให้ถ้อยคำ ส่งคำชี้แจงเป็นหนังสือ เอกสาร ข้อมูล หรือหลักฐานอื่นใดที่อยู่ในรูปแบบที่สามารถเข้าใจได้ (issue written inquiry or summon any person concerned with such act give statements, submit written explanatory notes, documents, data or any other evidence in a form that can be understood.) มาตรา 17 ในการปฏิบัติหน้าที่พนักงานเจ้าหน้าที่ต้องแสดงบัตรประจำตัวต่อบุคคลซึ่งเกี่ยวข้อง (Section 17. In carrying out the prescribed duties, the competent authority shall present an identity card to the person concerned.) บัตรประจำตัวให้เป็นไปตามแบบที่รัฐมนตรีกำหนดโดยประกาศในราชกิจจานุเบกษา (The identity card shall be in accordance with the form specified by the Minister upon publication in the Government Gazette.) มาตรา 18 ในการปฏิบัติการตามพระราชบัญญัตินี้ ให้พนักงานเจ้าหน้าที่เป็นเจ้าพนักงานตามประมวลกฎหมายอาญา (Section 18.
