INTRODUCTION

Social order experience of different countries shows that granting and real providing different kinds of public guarantees (privileges, advantages) for particular groups of society (veterans, pensioners, participants of marked events, organizations, people belonging to particular social categories: groups, strata, classes, tribes and others) became generally accepted. In this way differential field of social opportunities is created.

At the same time equality of people is secured by means of rights system which creates legal field.

It is generally accepted that legal field and opportunities field do not coincide in many ways.

Successful examples of realization of field opportunities aimed to create social differentiation of society point out that in case it is applied for other purpose, real possibility of creation of equal opportunities society exists.

The Concept of Equal Opportunities Society is designed to found the process of society creation, the society which realizes the Principle of Equal Opportunities Field.

PREAMBLE FOR NIS (for newly formed independent states)

We have already heard about the society of equal rights and unequal property status.

We have already had the society of equal property status and unequal rights.

Against the background of market relations striking property disproportions and social tension come out while transiting from property equality to rights equality. The danger of social outburst exists.

To avoid social cataclysms the process is elongated during the time and social energy is diverted to other course (emigration, brain-drain and labor force; creation of illusory power-draining spheres and types of activities, and others). In consideration of security and stability, provision which such a neutralization of social energy is partly justified but belongs to the non-productive one.

The possibility of the more productive orientation of social energy in the direction of the creation of equal opportunities society which may give a stabilizing effect, but without negative consequences still remains untried and unused.

THE CONCEPT OF EQUAL OPPORTUNITIES SOCIETY

Chapter 1. General part

1.1. The principle of equal opportunities: All members of society (people) have social guarantee of equal opportunities realization of inalienable natural rights of human being. This guarantee is expressed by the guaranteed Equal Opportunities Package.

1.2. The notion of inalienable rights of human being is used according to the regulations of international law.

1.3. Constituents of Equal Opportunities Package are defined by the notions "human", "human dignity", and "inalienable rights of human being" which must be provided in any case.

1.4. The concept "equal opportunities" means the possibility to realize one's rights within the scope of the guarantee without any additional formal conditions, on the only basis that you are a human being.

1.5. Accessibility of equal rights does not mean their necessary use, and not in the least related to the use or non-use of additional opportunities.

1.6. The composition of Equal Opportunities Package is universal and founded on international standards which must be defined on the basis of experience generalization of the use of the given Concept in different countries.

1.7. The use level of constituents of Equal Opportunities Package is defined by national standards.

1.8. The national standards of constituents of Equal Opportunities Package are defined by society level development and changed depending on its welfare which should be declared officially.

1.9. Every person may to know his/her Equal Opportunities Package guaranteed by society including its level and means of its realization.

1.10. Equal Opportunities Package provides equal opportunities Field for all members of society (people) without exception.

Chapter 2. Equal Opportunities Field

2.1. Equal Opportunities Field is the part of general field of equal opportunities in which society guarantees to every person the possibility of realization of his/her inalienable rights and needs irrespective of his/her social status. Field of equal opportunities is one of the main social features of society.

2.2. Peoples have equal common rights and different social status.

2.3. Opportunities of every person consist of two components:

· starting opportunities, which society grants to every person on the only basis that it acknowledges him/her as human;

· status opportunities, which are additional in relation to the starting ones.

2.4. People have different status opportunities related to a social status of human in society (material, official and others).

2.5. Starting opportunities should be the same to every member (person) of society.

2.6. Starting opportunities should provide every member of society with a position honorable to human.

2.7. Starting opportunities are defined by Equal Opportunities Package.

Chapter 3. Equal Opportunities Package

3.1. Equal Opportunities Package - the major social guarantee given to human by society.

3.2. Equal Opportunities Package provides every person with an honorable minimum of living conditions and equal starting opportunities for the development of social status during the long-life period.

3.3. The composition of Equal Opportunities Package is defined by society and ratified by Supreme Legislative Authorities of country.

3.4. The level of Equal Opportunities Package is defined by Supreme Executive Authorities of country in accordance with directives of Supreme Legislative Authorities of country.

3.5. The composition of Equal Opportunities Package (open list - a sample):

· Provision with elementary physiological needs of human: food, air, water, lavatory, heat, baths…
· Clothes;
· Place for sleep and rest; for keeping personal belongings;
· Means of conveyance, transportation;
· Communication facilities
· Provision with ecological security (standards);
· Medical treatment;
· Health care;
· Security: personal safeguarding and property safety.
· Guarantee of basic social needs of human: information exchange; association according to interests; social aspects of creative self-realization;
· Provision with development opportunities: information, education, self-perfection;
· Opportunities to create one's own work place (entrepreneurship);
· Satisfaction of psychological needs of human: intimacy and anonymity, self- identity, respect, individual aspects of creative self-realization.

Chapter 4. Provision with Equal Opportunities Package

4.1. The provision with Equal Opportunities Package is guaranteed by society representative of which is country.

4.2. The function of country lies in creative organizing and supporting Equal Opportunities Package on a level set for everybody and for every member (person) of society.

4.3. Human receives opportunities guaranteed by Equal Opportunities Package from organizations of all patterns of ownership and subordination.

4.4. Equal Opportunities Package may not be used but should be obligatory supported.

Chapter 5. Responsibility for following Equal Opportunities Package

5.1. If a representative - the country is not able to exercise Equal Opportunities Package guaranteed by society, society takes constitutional measures against its representative.

5.2. A person who did not obtained opportunities guaranteed by Equal Opportunities Package or revealed their inadequacy to the standard declared has the right of getting a fair compensation judicially. The country is held responsible.

Chapter 6. International aspects

6.1. World organizations define international standard of Equal Opportunities Package and survey the norms and realization of national Equal Opportunities Packages.

6.2. In case the facts of lowering of national Equal Opportunities Field below the level of human dignity are found, world organizations take measures of international influence and aid.

Chapter 7. Development and enforcement strategy of the Concept of Equal Opportunities Society

7.1. The Concept of Equal Opportunities Society is created in Independent Intellectual Center IIC RN l-A-992-0 FIS.

7.2. The success of creation of Equal Opportunities Society depends on publishing and popularizing the Concept.

7.3. Chapter 1-7 are open for discussion. Supplements and changes are possible.

7.5. In case of sponsorship support, the creation of interim work groups for adaptation of national standards of Equal Opportunities Package and development of the Concept is provided. Activities of work groups will be co-ordinated by means of the creation of the Coordination Centre of Equal Opportunities Society.

7.6. Development of the Concept of Equal Opportunities Society is expected in the direction of the creation of the corresponding bill on the basis of its discussion or regulations Package which should be proposed to Supreme Council of Ukraine and Supreme Legislative Authorities of other countries the communities of which may wish to live in the society realizing the Principle of Equal Opportunities.
