PLANNING AND BUILDING (AMENDMENT No. 22) LAW, 5746—1986*

Amendment of section l57A.

1. In section 157A of the Planning and Building Law, 5725-1965(1), the following subsection shall be added after subsection (g):

(h)

(l) The Minister of the Interior may prescribe by order, after consultation with the District Commission concerned, that the provisions of this section shall not apply to a particular area if
- (a) the area is included in a deposited scheme which permits building in such area and
- (b) the certifying authority was given an opinion to the effect that after approval of the scheme there will not be any bar to the receipt of a building permit for the area, including a bar arising out of opposition to the scheme lodged by a person directly prejudiced by it, and relating to property in which he has an immediate interest.
(2) Where the certifying authority considers that the construction of the building in respect of which approval has been given by virtue of an order of the Minister of the Interior under paragraph (1) involved a deviation from the provisions of the deposited scheme, it may direct the company, the Director or the supplier to withhold or discontinue the supply of electricity, telephone services or water, as the case may be, to that building: The provisions of subsection (g) shall also apply, mutatis mutandis, to direction under this paragraph.".
