The Incidents surrounding my detention My name is Octavio Satchell McDonald,
born in the former United States of America Canal Zone in the U.S. Govt.
Medical Facility Gorgas Hospital. I
was educated in the USA Canal Zone Schools and Colleges, employed with the
U.S. Govt. Department of Defense (DOD) from 1981 to 1997. I was employed from minor jobs in the
Canal and U.S. DOD Installations to humanitarian aid to Haitian and Cuban
refugees along Canal border 1994 “Operation Safe Haven”, promoting “Democracy
and Human Rights” throughout the Caribbean and Latin American Region. I
want to bring to your attention the horrendous human rights violation, false
imprisonment, deprivation of my freedom, birth rights denied, violation of
international conventions, mental and physical abuse, and torture. Despite the fact that I told them I am a
disabled person suffering from chronic back pain due to injury 7 years ago in
the Miami Dade County Fair premises.
This left me temporarily crippled, under much medication, permanent
doctor’s supervision, rehab, risk of permanently becoming crippled. They
seized these medical documents. I
suffered great harm to my health while chained, handcuffed, shackled and
chained with other “illegal aliens” as I was moved from facility to detention
facility like an extremely dangerous criminal. Despite the fact I got up until then a clean, zero free
criminal record, not ever detained nowhere in my life. Not even for a few
minutes. This terrible nightmare began on
Tuesday November 22, 2005. As I
arrived on Flight 1700 of American Airlines my long time best buddy booked
the cheapest flight from Costa Rica to Miami. I have lived in Miami before as
my family and Canal Zone friends live here and I never had any problems here
or anywhere. As I arrived I showed my
Panamanian passport with “indefinite” U.S. visa with my USA Canal Zone Birth
papers and certificate for additional identification if necessary after all
the law specifies documents that can be used to establish identification and
citizenship. “A certificate of birth
in the United States” together with a document that confirms identity, as a
driver's license I have a Florida State Identification Card. I wrote out a form, all was OK, I was sent
to Customs. At Customs, Customs Officer searched
bag, no problem, began reading my legal notes, documents, writing,
questioning me on them, called others to look, photocopy, questioning me on
my legal documents, notes. Then they
took me in small room, searched my pockets, frisk me, took my passport,
Florida ID, my United States of America Birth Documents, By then I was
shaking and crying with anger, I asked them “why are you doing this to
me?” Nobody answered; I told them “I
was born under U.S. jurisdiction, why are you doing this to me?” I was told I was “an arriving alien, not a
U.S. citizen and will be deported back to my parent's country. Standing up for my rights I took hours
explaining to them my status born in the USA Canal Zone, My U.S. Passport
application never granted even though I paid fee, photos, they used my
documents in my possession to question on it. I explained to them my rights stated on my U.S. Birth Documents
that states “this certificate will always be valuable in proving the date and
place of your child's birth and identity of parents. It will be useful for proving age and
identity: For securing working papers...for proving citizenship...For Social
Security and Old Age Pension...For obtaining passports, for travel in foreign
countries...” This is my United States Birth Certificate stating my rights.
The same U.S. Birth documents you got.
They got furious saying “Birth in the
Canal Zone does not confer U.S. Citizenship” bringing back and quoting an
1904 unconstitutional racist apartheid law that granted U.S. citizenship to
white Americans, but unconstitutional as it violated the U.S. Constitution
Amendment XIV. Most of these immigration officers and “Homeland Security”
were immigrants themselves, saying “deport him, deport him”. One of Canadian descent told me “you just
can't claim citizenship like that”, told me “you and your crazy writings, you
know everything don't you?” When I
heard those words I instinctively knew I was in some trouble for some unknown
occult reason. The lady whom I had
transcribed printed interview, Latin older lady, real mean and harsh to me,
said “you are going to jail”. I was detained for two days at the
Miami Airport. They called my best
friend who was expecting me and my spouse back home that I was detained and
would not give neither of both any information. I was not given a chance to contact an attorney, when
interviewing officer Tracy Pueschel offered me an attorney, it was an document
to sign I would waver my right. I would
not get an attorney in exchange to go free, if I didn't sign I would be
arrested, I unbelievably said, “arrested for what? I was born under U.S. jurisdiction, with U.S. Birth Documents,
with a valid indefinite U.S. Visa, what is the problem? I asked.. He only limited to say “if you
sign the waiver you will be free to go, if not they will arrest you”. Thinking always in good faith, I had
nothing to lose. I signed and that
Wednesday before Thanksgivings, I had not heard from Officer Tracy Pueschel
and I was led handcuffed, shacked and chained for the first time in my life
to West Palm Beach Jail. I got there with some not so friendly
guards insinuating, “All those big mouth guys, we just let some bad guys beat
them and we look the other way”. I
said nothing and braced for what to come.
Days after, with others, handcuffed, shackled, chained in a crowded
mini van. Hitting every bump with my
injured lumbar back region from West Palm Beach, four hours to Bradenton,
claustrophobic with other inmates, others were lying on the floor. Up until this date I write this I cannot
believe this happened; happening in America... I got to Bradenton Manatee County Sheriff Office County Jail... One of the guys said ”you’re not going to
mix us with hardened criminals are you?”
They said no, guess what? They
put us in the cells with guys who were there after serving time in prison 20
years, 15 years, but always OK. As
many were from the Caribbean where some of my family are from and one of the
most prominent. And they treated the
guys and me with great respect until 4 days later when they put us with
regular immigrants. I heard so many shocking stories of
people hauled away from their homes, jobs, pulled away from their American
families, children, and most were legal green card holders, most for minor
violations. I could not believe what
I was hearing because I speak Spanish fluently and know most of the countries
of these people. 24 hours a day I was
with them, busy helping, translating, counseling, and interpreting both for
them and for English speaking staff. As a firm believer in God Almighty and
his Son Jesus Christ, poor souls as none trusted in legal service help. Later was to find out it was of no
help. By then I wrote and sent
photocopies to the media, U.S. Congress, on my case and other immigrants'
plight that something real wrong was taking place and my U.S. Birth under
U.S. Jurisdiction I should not be in any U.S. detention facility. I began to speak out on abuses done
against the poor helpless immigrants and I was singled out and watched. Money orders worth hundreds of dollars
never got to me my friends sent, phone cards which were excessively expensive
($13.50) 60 minutes, got confiscated, used, returned to me when leaving,
thousands of dollars in 1999 U.S. Postage stamps missing, just a handful
returned. Small matters like the few
bucks I had when I entered at the airport missing between West Palm Beach and
transported to Bradenton Detention on November 22, 2005. I began informing UN Washington DC
Office of my unjust detention, abuse of my human rights, civil liberties and
rights, birth right, psychological and mental abuses, the threat of physical
attack, not able to get any defense, no one could not contact me without a
mountain of red tape. Court dates,
which I was told in ten days from detention in November 22, 2005, kept
changing without any explanation, month after month. My U.S. birth documents, which were
seized, but I had copies, were not respected or honored. I was held and given no reason. All my writing for explanations was
ignored by my “deportation officers”.
By then everyone was noticing something was wrong and commenting “this
is an injustice they are doing to you, and to see that you were born in the
USA. If they do this to you, what
wouldn’t they do to us who were immigrants?
Many people began to become concerned
with my safety and there were a very
few inmates who seemed set up to provoke me into a fight, but with the help
of the Lord Almighty and good people I stood clear of these
provocations. I began to suffer of
chest pains, pains in my left arm. My
pressure which is 70/80 was doing 160/103.
My disabled condition with my painful injured back was ignored. No medication, I had to bug them over and
over to give me a lower bunk (to sleep) because of my back. I was made to suffer to the maximum in
this detention facility, which I notified U.S. Congress, media continuously
what was going on with me, in there and hundreds of other immigrants. People detained up to two years, one year,
8 months and it seemed I was heading in the same direction. My birth under
U.S. Jurisdiction made no difference and I became “singled out”. As I helped many of the helpless
immigrants from all walks of life, and the unbelievable things that were
being done to them, their lives their family life and their family they were
inhumanely torn from to be sent back to their country. Most left from childhood, many worriedly,
gloomily told me “I can’t go back to my country, because they would suffer
torture, cruel detention, beatings, executed” and many were sent off anyway. I began to see all the talk of human
rights violations and “champion of the cause of human rights” is a bunch of
lies as these things were being done to me and these people. I no longer saw no difference anymore of
“rogue nations” and human rights violations nations. As I was suffering these human rights
violations right here. My birth
rights under USA denied, if you think this is just an isolated case, then
think again. My USA Birth Document is
no different than yours. They do this
to me today, tomorrow it could be you, your family or loved ones. “Under the Panama Canal Act of 1979,
Public Law #96-70 of 1983(b)(3)-(4)”Canal Zone Government” is deemed to refer
to the “United States of America”…
The United States as substitute for the Canal Zone Government,” “The
term Special Immigrant “refers alien falling within one group of immigration
classifications… 1.
Returning lawful permanent residents of the United States. 2. Former citizens of the United States…5.
Former employees of the Canal Zone Government or the United States Government
in the Canal Zone 8 U.S.C§1101…. That
is what I entered with an indefinite U.S. Visa issued to me in 1991 while
employed with the U.S. Department of Defense, and like I was told by Embassy
Officials “get your U.S. Passport” which I applied for but Miami Passport
Office denied it “United
States citizenship is based upon title 8 of U.S. Code 1401-1409, dated
1986. U.S. citizenship by birth:
Child born within the territory of the United States, regardless of the
citizenship of the parents.”
Encyclopaedia Britannica 1966, under Canal Zone USA “sovereignty: since title to all such land acquired by
the United States , The Canal Zone, in its entirety is a United States Reservation”. National of the United States: A citizen
or a non-citizen who owes permanent allegiance to the United States. 8U.S.CA §1101 (a) (22) also termed U.S.
National; U.S. citizen. In fact my
United States Canal Zone Birth paper, original that Immigration Custom
Enforcement confiscated from me, has U.S. Constitutional Amendment XIV
ratified in 1868 section 1. “All
person born or naturalized in the United States and subject to the
jurisdiction thereof, are citizens of the United States; nor shall any state
deprive any person life, liberty, or property, without due process of law;
nor deny to any person within its jurisdiction the equal protection of the
laws.” Words of the U.S. Constitution
stuck on my U.S. Birth Certificate in Immigration Officials custody and
refuse to let me go. When
I finally got to hear a court hearing after six months in unjust detention, I
got to court under the Honorable Judge Kevin McHugh. Prosecutor raised 1904 racist apartheid
Canal Zone discriminatory law that gave whites citizenship but excluded
Caribbean descendants like myself, despite our grandparents and parents
contributed mightily to the building, construction and operation of the U.S.
Canal. I raised the above, U.S.
Constitution, all with the help of God Almighty as I could get no “free legal
help”, and could not afford a private lawyer for my defense. The judge told me to return in two weeks. Judge
McHugh saw me the following week. I
told him I entered with an indefinite U.S. Visa and U.S. Birth Certificate
for additional identification if needed.
I never been detained arrested, I got zero criminal record. The Honorable Judge told me to return in
two weeks. When the two weeks passed
I saw the honorable judge who said he sees no reason why I should be held in
custody or deported and would like me to be released. But I needed to see the Director of
Homeland Security of Bradenton Detention Center Mr. David Wing to sign my
release. I could fight my US citizenry in court but his court was not the one to do that. He would give me some papers to fill out to go to a higher court, which I agreed with him to go to a higher court. When
I came the following week, the guard that escorted me looked worried and
asked me if I got a lawyer. I said “no,
but God Almighty is defending me”.
Being a very intuitive person, I picked up something was wrong. I got into the Court of the Honorable
Judge Gail Padget, who reaffirmed the same ruling to my favor as Judge
McHugh. But the Lady Prosecutor
appealed. The Judge asked why? The Prosecutor said “I don’t know this is
above my head, you can go back to your parent's country can't you?” The Judge says she would like the appeal
resolved in 48 hours. But prosecutor
says 30 long more days. The Honorable
Judge says "get a lawyer", and provided me with a list which we all
detained knew it's no good and waste of time. Two
weeks later while in Bradenton Detention Center, Immigration Officers brought
papers saying I would be "deported", despite the fact I was still in
process, and other sensitive issues involved, They knew, UN Office and U.S. media knew, which for the U.S.
would mean violation of International Conventions and outright evil on these
Immigration Officials from the beginning.
I wrote the Immigration Officials, the Immigration Judges here in
Bradenton, my "Deportation Officer". I was still in court proceedings until June 2, 2006. I was to go back to court to hear on
appeal. I sent copies again of my
birth certificate under USA Canal Zone, my Indefinite Visa I entered with. On
May 22, 2006, 180 days into this unjust detention and false arrest, I filed
an "habeas corpus" in two large yellow envelopes, where I put
"legal mail" made out to the U.S. Attorney's Office in Tampa and
the Sam Gibbons U.S. District Court in Tampa and gave both mail to guards in
the Manatee County Sheriff Office to deliver on May 30, 2005. Immigration Officials took a group of us
out, some to Krome Detention Center in Miami, some to be taken out of country
immediately. Handcuffed, four hour
ride to Miami, A group was processed in Miami Krome Detention, which looked
even meaner and repressive than Bradenton.
Armed Guards, my intuitive feelings told me "this is no place to
be." I
told Immigration Officials I had Court time June 2, 2006 in Bradenton and
could not be deported. The same words
the Nazi Gestapo used to massacre my Jewish Grandmother's people in Europe. They all kept saying "we are all
taking orders from above." I was
put on a flight hurriedly, watched by plainclothes Federal Marshals on
plane. When we got to the arriving
country, we were detained, fingerprinted, mug shot like a criminal. But because of good friends from the local
and international community I was set free to go about my business. Those
of you who know what is going on, you knew what Homeland Security and
Immigration did to me, try to let happen to me and what international laws
and conventions were broken when they did this to me. A certain prominent sector of U.S. media
have all the documentation on the whole case and you see the criminal actions
they pulled on me. I put full blame
on "Homeland Security and Immigration , Custom Enforcement for anything that happens to me or any of my
family, for your reckless violations, human rights abuse, denial of my birth
rights, false imprisonment, violation of habeas corpus process and liable for
all physical, mental, emotional damage your torturing psychological pressures
had me under your inhumane, unjust detention. I
welcome the legal professional help of any attorney, human rights
organizations. I want to give thanks
to the diplomatic and international community who backed me all the way and
quietly worked out matters out for me.
I would be forever be grateful, thanks again. Your "silk gloves" actions will
be forever remembered, admired, thanks again. Some of you, your silence is not understood. Do not think you are any safer than
me. They deny my U.S. Birth Right
today, tomorrow it could be you. Help
came to me from another source, you notice?
You still have time to use your vast influence for such a time as
this. It's up to you. Check
the court records and see what I am to now tell you. Homeland Security and ICE deported a
person born under U.S. jurisdiction.
Objected my being free in the U.S. yet I am totally crime free, no
criminal records. While they did not
object to bail, object to people with criminal records "go back" to
the streets of the United States posing a threat to you, your family and your
property exposed. Ask
under the Freedom of Information Act FOIA for documents of all those who paid
bail, set free for November 22, 2005 up until May 31, 2006. I was forced to leave U.S. with my
crimeless records and you will get a surprise. One of the fellows who benefited with a chance to stay in the
U.S. told me "man, I don't get this, I should be deported. I saw your U.S. birth documents, you
should never be deported. Somebody
with authority hates you real bad".
That is OK my God, is the God of Light" all the "works of
darkness will soon be exposed."
Just remember, this is no isolated incident. They pull this on me; tomorrow it could be you, or one of your
loved ones. I hope it never happens,
but it can. Where is the talk about
"promotion and respect of human rights?" Is this the same old double standards, some got and others have
not? All evidence points that's the
way it is. Special
thanks again to the Diplomatic and International community for all your
help. I would never forget your
help. My growing up overseas makes me
open minded to a world of six billion people of all languages, races, and
people. I
want to give special thanks to the diplomatic contacts, countries upon
hearing my ordeal through their deported nationals. And you offered me the opportunity with my family to live
there, to get medically treated for my back injury I suffered in Miami Dade
County Fair premises in 1999 and left me disabled and these aggravated it not
giving me the medications and treatment I needed. I give all of you thanks.
I will not reject your offer.
The attorney in that case is Bryan Christiansen of “Dow and Associates”,
brought in a lawsuit for one million dollars. But because of my injury, pains intensified with Florida some
times cool, wet, stormy weather. I
went back to the former Canal Zone, as workers compensation doctors wore me
out, while injured and suffering, their usual doubting, minimizing minorities
ailment. My attorney Bryan
Christensen 305-444-6773 can inform you fully what my needs and how this injury
and subsequent violations of my human and civil rights took place
afterwards. I sent a full copy on
April 4, 1999 to the Justice Department Civil Rights Section to file a Civil
Rights violation on my behalf. I am
still waiting to hear from them. 1999
was very traumatic as my sister Julieta Satchell, crippled since age 2, as
she was injected accidentally wrong by a U.S. doctor in the U.S. Government
Hospital of Gorgas, left her crippled all her life. My folks never got no help, no aid, never solicited it, much
less a lawsuit. She died January 3,
1999confined all her life to a wheel chair. Buried in the U.S. cemetery of
Corozal, a U.S. cemetery in the Canal Zone.
Made international news last November 5, 2006 as President Bush and
the First Lady visited it. My father
died months after, August 1999. A
very rough draining emotional year as I also suffered my first crippling
injury February 20, 1999. My
father, who worked for the U.S. Canal Zone Government from youth, bought
insurance with the U.S. Navy, Dept of Defense. They notified my grieving widowed mom. She signed the forms. It’s still 7 years my mother has not
received a penny from that insurance.
Injustice, Injustice, Injustice!
Then they do this great badness to me. I
thank the people of England, as my family ancestry known as the “powerful
clan” of Scotland are from for your generous offer as you got to know my
family tree, also the people of the Caribbean where my family is also very
prominent as far as South Africa.
Thanks all of you for your support and secret diplomacy in my
behalf. Thanks from the heart thank
you. Thanks to the brave women and
men of theUnited Nations, your top quality, silk gloves, quiet untiring
diplomacy is matchless. Thanks for
acknowledging th Human Rights violations against my person and freedom. Most

Senator thanks for your concern and contacting me. I got your message and letters, you mentioned any valuable
information I can provide you with for the Nation, and Sir here it is. Sir, keep scrutiny, close scrutiny what
these bureaucrats are doing in the name of “Homeland Security” particularly
me, a person born under U.S. jurisdiction.
You should investigate every one of them. Who had me detained six months, a disabled injured person for
no reason, aggravated my health condition, and rejected two judges’ opinion
to set me free in the country’s jurisdiction. I was born and forced on a plane back to parent’s county where
I was detained, mug shot, finger printed like a criminal. As
you read this most Honorable Senator, every news media, U.S. human rights
group and international human rights groups are also reading the vicious, horrendous,
human rights violations, denial of U.S. birth right under U.S. jurisdiction
and documented criminal actions against my person. All the nationals of the Four Corners of the world deported
back to their countries commenting “the injustice they doing to you, and you
born here”. They saw my
documentation, my U.S. birth certificate, and U.S. Birth papers and documents
on USA Canal Zone. Everyone said “if they do this to you who is born under
these peoples’ jurisdiction, what else they wouldn’t do to us who are
immigrants, not from this country?” I
leave this information to look into carefully Honorable Senator, Chairman of
Homeland Security and Government Affairs.
Have them please Honorable Senator, to return my U.S. Birth Document
they took, my U.S. Identification and Driver’s License. Its not theirs, and its like prominent
Tampa Attorney John Ovink told Herald Tribune, about us in Bradenton
Detention Center, “this is not North Korea”, (no offense to the people of
North Korea). So
much talk about ‘Human Rights”. “Civil Rights”, “The Rights of Minorities”
when you mercilessly stepping all over their bodies and rights. Anyone
