New Mexico has a reputation around the Galaxy for being quite the tourist destination.  People come from trillions of miles away to visit this fair state. But it is a good idea that you fly carefully when you fly low, the ground has the right of way!!!

But seriously folks, this is the place that practiced peonage.  It was New Mexico Territory's system that Congress reacted to when it passed the Antipeonage Act, original statute recorded at 14 Stat 546.  And yes, the peonage system was indeed used to enforce a parent's duty to support his or her child, whether married or divorced, with or without custody. Vagrancy was defined to include abandonment of family and failure to assist in its support.  Vagrancy was generally defined as condition of having no money and no job.  If you have no money and no job, what can you do for your family?  The History page on this site tells you all about it.

Sess. p. 1571.  And here we go again with Knight v. Mercer Island, W.D. Wash. No. C02-879L and Knight v. Serpas, W.D. Wash. No. C02-1641C.  I assert that suspending my driver's license pursuant to a multi-subject bill passed long after the support order was imposed upon me in an effort to coerce my signature on a "repayment agreement" which necessarily requires employment is a violation of the Antipeonage Act, which was passed in response to New Mexico's practices.

New Mexico is still practicing peonage.  The Human Services Department operates the Child Support Enforcement Division.

Article II Section 1 of the New Mexico Constitution declares the supremacy of the United States Constitution.

Article II Section 4 of the New Mexico Constitution declares the inalienable rights of the people, including the right to acquire, possess, and defend property.

Article II Section 6 of the New Mexico Constitution prohibits laws that abridge the right of each citizen to keep and bear arms for lawful purposes, except for carrying concealed weapons.

Article II Section 18 of the New Mexico Constitution contains the state Due Process and Equal Protection Clauses.

Article II Section 21 of the New Mexico Constitution prohibits imprisonment for debt in civil actions.  I guess a child support order does not arise from a civil action.
