Some practical advice for support contemnors in the State of Washington

A Way to Walk a Mile in a Noncustodial Parent's Moccasins.

A tribute to a hero, my father.  He was always my ally.

The following links are to those who are our allies in our fight to restore our rights under the Constitution and laws of the United States and under the constitutions of each of the fifty states.  I do not agree with every position taken by some of these sites, I do not support denying women equal protection of the law, but I believe that most of these people are pulling in the right direction.

There are two simple rules for being included on this page:  1) When I click on your link, your website will show up.  Error 404's and other results of such nature will cause me to delete from this page the link to your site.  2)  When I hit the back button, your site will let me out.  If it does not, I will delete it from this page.  I am grateful for all web surfers who find this web site and I will try to be considerate of them when they go through this links page to other websites of common interest.  Of course, with the Enemies pages, the same rules do not apply.  I will try to update the links, but I cannot account for the tactics of our Enemies in how they treat visitors to their web sites.  They are our Enemies, after all.

One other thing.  Since the www.google.com and www.findlaw.com search engines found this Antipeonage Act Website, traffic has been WAY up!  Thanks, guys!  Now maybe I can feed hits to the sites listed on this page and give them an incentive to cross-link back to me.  www.antipeonage.com is a URL that will feed users right to the Index page of this Website.  I want to thank a friend who requested anonymity for setting this up for me.  Thank you, Mr. Anonymous.  www.geocities.com/rogerwknight/ will also feed to the Index page.

The Antipeonage Act applies to child support, don't just take my word for it, read what Thomas Pollack wrote.  He is the Editor of The Men's Tribune.  Mind you, I don't agree with everything he says on his website, and that is our American right.

www.amatterofjustice.org  This is an interesting new group.  Check it out.  A group like this may be what we are looking for, a National Rifle Association for the other Amendments, with the same kick butt ATTITUDE.

www.dadsamerica.org These guys are in the fight.  This is the Dads Against Discrimination group.

www.AKidsRight.org This group is advocating a federal civil rights law to apply due process principles to the states.  If these guys think such an Act of Congress will fix the problem, then they should scream for the enforcement of the Antipeonage Act, 18 U.S.C. §1581 and 42 U.S.C. §1994

www.geocities.com/pittmanvking/  Web site for a lawsuit brought by 19 black employees of the racist King's Command Foods, Inc. meat processing plant in Kent, Washington. The facts in this case are truly appalling, however, Judge Richard McDermott of the King County Superior Court tossed the case on summary judgment for "insufficient evidence".  This judge would find that there is insufficient evidence that the ocean is salty.   We WON reinstatement of eight plaintiffs on September 8, 2003!!!!  It has now been more than thirty days.  No Petition for Review has been filed, it will be remanded back to King County Superior Court.

www.justicefiles.org  Information on police in King County, Washington.

Lists of State and County Employees are available at www.lbloom.net including support enforcement officers.

I have created my own Justice Files for support enforcers, it is on www.antipeonage.0catch.com.

www.copwatch.com  Information on police abuse of power and lack of accountability for that abuse.

www.contracabal.org.  Judge James Doerty declares that Mr. Trummel is a "mean old man" in his written ruling!  Posted on the Superior Court's website!.   More information on this case is available at www.politechbot.com.

www.paternityfraud.com  Oh, and by the way, it seems that child support agencies and courts are insufficiently concerned about accuracy in paternity tests and relieving parents of their support obligations when it turns out they are not the parents and what we have is lying, cheating, theft, and fraud.  I just take the position that the Antipeonage Act is violated whether the party is the father or not.

You can sign the Unity Wall, a new means of petitioning for change and for telling your story.

www.independent.org  This is a comprehensive website promoting a libertarian view of what government should be and criticizing what it has become.  One need not agree with all of their apparent recommendations, I believe that private prisons suffers from the disadvantages similar to that of privately owned toll roads.  There are certain things that should be owned by the public in common and run by those answerable to the public through the election and judicial process.  Having said that, there is a 24 page article by Stephen Baskerville that should be read by every citizen of the United States on the subjects of divorce and family law, particularly the Child Support Crusade.  I will seek permission from Mr. Baskerville to post his article, "Is There Really a Fatherhood Crisis?" on this website.  It is available through this link and can be downloaded from it in Adobe Acrobat pdf format.

www.Dadsdivorce.com  A good source of information and links to published articles sponsored by the Cordell and Cordell law firm.

Alliance for Non-Custodial Parents Rights  Good site, very activist, lots of links, and plenty of information.

Friends of Lowell Jaks can write him at:

    Lowell Jaks 1608237

    Lerdo Pre-Trial Facility

    17695 Industrial Farm Road

    Bakersfield, California 93308

American Coalition for Fathers and Children.  Good site.  Lots of links and a good source of information.

National Coalition for Free Men.  Good site.  Lots of links and a good source of information.

www.menstuff.org Another good site with lots of stuff and father friendly columns.

Fight CPS and Win.  A resource for those fighting false child abuse allegations.  They are a part of the American Family Rights Association.

Jim Untershine of Long Beach, California and his Ground Zero Website.

There is the Californian LBDUK website, in association with the international LBDUK website, apparently based in Britain.

    R. Mark Rogers is the webmaster of the www.guidelineeconomics.com site.  He provides links to numerous organizations advocating toward reforming child support laws.

Adam Cody is one of us, his Digital Handshake website has information about attacking the support schedules with Troxel v. Granville and equal protection arguments.   The equal protection cases he cites might be of use for those of you with second families.

Separated Parenting Access and Resource Center.  Interesting site.  I believe that if we as a policy awarded custody to the parent who has the job, we could eliminate much of our welfare and child support enforcement spending and cut taxes at all levels of government.  Or we could use the money for a new space program and add the Moon and Mars as new states of the Union.  I see nothing wrong with a woman having custody of her children provided she can support them and she does not use them as a weapon against their father.  The government needs to stop using them as an excuse to violate its own Constitution and we need to demand that it cease and desist such violations.

    www.nevadansforequalparenting.org Another good American group.

Decent Dads of Texas is a new site that is now up and running.

The Center for Liberty and Privacy and the Alliance for Freedom and Alimony, Inc. retain attorneys who are fighting for our rights under substantive due process under the 14th Amendment. They are also looking at involuntary servitude and peonage challenges under the 13th Amendment and the Antipeonage Act.

Parents and Children for Equality.  Another good activist group, they claimed to me that they have found some high powered attorneys who are fed up with the gender bias in the courts in family law.  We sure could use all the help we can get!

www.dadsaustralia.com and www.AussieDads.com (switches you to www.geocities.com/ozydads/ ). Would you believe it is just as bad in other nations where big government liberalism, with its fellow traveler femi-nazism, has taken over?    Please see also the Shared Parenting Council of Australia.

For you Aussies who think your child support laws violate the Australia Constitution, there is a highly informative website by a bunch of lads in and near Perth, West Australia: www.mensconfraternity.org.au  They call themselves Men's Confraternity Organization.  I am not sure what a "confraternity" is, but I'll accept that they are quite a group!  It does appear that Australia's version of the English language has a few differences with the other dialects we speak.  But what would an American know?  We think a pint is 16 ounces!  We Americans love to root for our ball teams!  Root!  Root!  Root!  ALL OVER THE STANDS!  It is QUITE a sight!

www.fathers-4-justice.org  But hey!  Over in Great Britain there is an organization that is raising Hell over the destruction wrought by family courts who suffer from the same biases against fathers we see over here.  They have celebrities including Pierce Brosnan and Bob Geldof on our side!  Give them a look!

Stefano Genovese is building a new site, Free Thinkers Gazette.  He is active in the British Father's movement. Thanks for the link, Stefano!

Another British group, www.fathercare.org has the militancy one would expect of those who have concluded that being gentlemen and going through channels and the appeal process is ineffective.  Lots of graphics on this website.  I like the Spiderman figures floating around in front of the nuclear power plant!  How many excluded fathers are in control of nuclear plants?  How many are patrolling the streets of Baghdad?  How many are out catching speeders on Interstate 90?  How many are piloting large commercial aircraft? How many are working on farms and therefore have access to ammonia nitrate and fuel oil?  How many have engineering, physics, and chemistry degrees and therefore can figure out exactly how to destroy stuff?  How many have military experience?  I keep telling folks that compromise with slavery is impossible!

Please follow the links in the Fathercare site to its pages on Dr. Pelling, who was being prosecuted for daring to render public certain decrees of the British family law courts. (But hey, Dr. Pelling won damages against a court official who assaulted him!)  This reminds us that one of the motivations of the American Revolution was the threat to bring Americans over to Britain for trial rather than allow Americans to be tried in the colonial courts.  A British frigate sent to Rhode Island for such purpose was sunk in Narragansett Bay.  Upon investigation, no one would own up to knowing who was involved in the sabotage!  A core value of American law, the openness of courts and the freedom to discuss the consequences of public policy where it matters the most, in the courts, is not yet as ingrained in British practice.  British family law courts are, under Acts of Parliament currently in effect, the modern Star Chamber where litigants are bound to secrecy.  This is also the case in Australia and New Zealand.

For those who like to sing the line in Rule Britannia! that Britons never, never, never, will be slaves, there is the United Kingdom Independence Party, the UKIP.  They did rather well in recent elections for members of the European Parliament, and they are the ones protesting most vociferously against any law made in Brussels having any application in Britain.  It is enough to make us Americans wish there be a United States Independence Party!  (Like, Get U.S. out of the WTO!!!)  Now there are pro-E.U. Britons who will say that their ancient island nation is not giving up its sovereignty, but then please explain the greengrocers getting prosecuted for selling their produce in pounds and ounces?  Some might think that an argument over weights and measures a little silly, but when a petrol station in rural Britain must shut down because it cannot afford to replace its ancient but nevertheless functional and accurate Imperial gallon pumps with new liter-measuring pumps, then it's not so silly.  After all, would we Americans tolerate being converted over to the Spanish language because much of the world speaks it and it is easier to spell?  Shucks, we're still angry at our school boards for metri-fornicating our high school track meets!  That includes some of my teenage acquaintances who set new school records in such distances as the 220 yard event only to see it replaced by the 200 meter, known affectionately as the "Not Furlong".  The UKIP Links page connects with many Eurosceptic sites, including my favorite:

Save the Pint!  Draft beer, not kids!  What do I think about the Metric System?  I do not mind it as long as I am not required to use it in my daily activities.  I prefer that it be just that funny little scale on the other side of the ruler.  For engineering purposes, we have to take human factors into account, or nothing designed will ever be useful.  While such can be done in Metric design, the inch, foot, and yard ARE human factors.  If using such ratios as 12, 6, and 16, not to mention 5280, are such a problem for you, USE A CALCULATOR!!!  That is why we can tolerate the occasional millimeter designed part in our machinery, we just punch in 25.4 to convert!  No problem.  Certainly not one that justifies confiscating a grocer's scales or putting a rural fuel seller out of business.  If you, like myself and Harry Potter, think Metric is for Muggles, then the British Weights and Measures Association and Canada's National Pist! are for you!  Canadian beer drinkers deserve the pint they paid for, that means the Imperial pint, not the half liter or the American pint!  They recall the medieval tale of "Harrowing of Hell" where a resurrected Jesus freed all of the sinners from Hell, except the barkeep who sold short pints!  You could say that these people have a real foot fetish!  The BWMA has extensive material on the Metric Martyrs cases and a link to their Metric Martyrs website.  Allowing people to use the units they prefer is the same as allowing them to use the language they prefer, and that is not a "micro" issue!

The Metric System Sucks!  Not entirely accurate (Snapple is sold in PINT jars, therefore, it is NOT metric), quite opinionated, and definitely humorous!  While I don't think the Hanging Gardens of Babylon have anything to do with English measures, what with cubits and all, it gets over 110 Fahrenheit over there in Iraq!  That is why the folks are so crazy over there, even our troops at Abu Ghraib!  When the temps went over 110, we no doubt had the Hanging Dried Sticks and Brown Leaves of Babylon!  And by the way, why are we calling .30 calibre guns and ammo 7.62 mm?  That makes as much sense as Interstate Highways in Hawaii!!

We Americans have Freedom2Measure.  If the American anti-Metric movement is not as well organized as the British, it is because American government is not trying as hard to cram it down our throats.  Indeed, states like Kentucky and Utah have actively de-metricated some of their laws and practices.

For British freedom fighters, there is the Liberty Human Rights.

www.fathersforlife.org by Canadian Walter H. Schneider

www.garscontent.com  A French fellow who is also in the fight.  Plenty of links to British and other lads putting up a fight.

And R. Robinson of British Columbia has his site on Geocities.  Sister site shows documents including evidence that his ex at the very least made "inconsistent statements as to fact".  That is the type of perjury where if one statement is true, the other is false.  Example:  "We provide the child with a happy home, she knows my current love as the father, we all live together in a 3 bedroom house."  And "We do not have enough funds without the child support payments to meet our basic needs."  Which is it?  To declare that one has not received the child support checks when in fact one has already cashed such checks meets the definition of perjury under any system of law. Thanks for the link, Rob!

www.darrinwhite.com is a tribute site to Darrin White, a father in Prince George, British Columbia who committed suicide after being ordered to pay $2,071 Canadian per month when he was on stress disability leave from his employer, B.C. Rail.

And from the other end of Canada, www.nobiglies.org,  Steve Osborne is giving certain New Brunswick jurists a bad case of indigestion!   At www.canlii.org/nb/cas/nbca/2003/2003nbca86.html is the text of a recent appellate court decision reinstating the prosecution for criminal libel against Justice Raymond Guerette.  Justice Guerette excused the lies that were presented as evidence, i.e. perjury, but then made excuses for lawyers and such, and stated that "So long as there is not a big lie, then I'm all right."  Justice Guerette acknowledged that the evidence presented included lies, and then based his decision against Mr. Osborne in part on these lies.  For protesting this, Mr. Osborne is now being prosecuted for criminal libel.

Another Canadian Father's Outfit, For the Sake of the Children.

And the Men's Educational Support Association of Canada is another good resource for the Great White North.

www.nojustice.info is another good resource for noncustodials in Canada.

We can be forgiven for believing that this is a Nazi-style government sponsored hate campaign against noncustodial parents.

Then there is Planetary Alliance for Fathers in Exile.  Roger Desbois is raising some genuine hell.

Michael Hickman has his Hickman's Resource Center in English and German.

A forum page for Fathers On Rights for Custody Equality  It is based in Louisiana.

     The National Family Justice Association.

National Congress for Fathers and Children

International Men's Network  They link to the Liberator, the man's rights newspaper.

www.wayneperryman.com  He is a good guy based on Mercer Island, Washington, he is on our side.  Del Parker vouches for him.

www.backlash.com  Lots of links.  Lots of good information.  Just not sure where it is going.

www.mensactivism.org A good source of information and activism.

There is also the Fathers Integrity and Rights Movement.

www.iFeminists.com  Back to the roots of feminism, when it was the advocacy of equal rights for BOTH genders. This site is generally on our side and it criticizes the bald faced lies that modern "feminism" tells to make today's bad policy decisions.

www.mensnewsdaily.com  A good news source not slanted by the usual nanny state liberal bias of the "mainstream" media.

www.hisside.com  Glenn Sacks web site.  You will like him.

Dads Against the Divorce Industry  Another good site, lots of links, lots of information, including information on violent reaction by noncustodial parents.   Unfortunately, they are shutting down, perhaps on February 28, 2004.  We will see if the web site continues.

Commentary by Stephen Baskerville, PhD., professor of political science at Howard University.  Excellent stuff! And he has a website promoting a Father's Day Rally in Washington D.C., www.fathersdaydc.org

www.newswithviews.com appears to be more libertarian conservative than social conservative and it publishes Professor Baskerville's comments and other pro-father articles.  Example by Carey Roberts Example by Glenn SacksDerry Brownfield's comment on Digital Angels.  Similar to my concerns in my Nongovernment Enemies page

www.intellectualconservative.com links to Glenn Sacks' column.  A definite point in its favor.

Of course, I do not agree with every opinion published on this website.  As an example, I believe that letting homosexuals get married is not going to destroy marriage or society.  The hate campaign against heterosexual fathers we can call the Child Support Crusade has already done that.  Add the brand new Supreme Court decision in Elk Grove Unified School District v Newdow. If the father is noncustodial, no matter how much time he actually spends with the child he lacks standing to represent his children's interest!  THAT IS A DECLARATION OF WAR ON NONCUSTODIAL PARENTS!!!!  All homosexuals getting married will do is allow homosexuals to experience what we heterosexuals experience when our spouses file for divorce.  Then we might get some new allies!

Sweet Chastity says his Chasti-Permalock stuff is just fantasy.  That may be, but it sure gives some of the wrong people (who know about Digital Angels) bad ideas about controlling citizens in a society.  WARNING: this link is to a site with "adult" content.  It is not for the under 18's or the faint of heart.

For the libertarian in all of us: www.lewrockwell.com    Read some Lew Stew!

The Equal Justice Foundation is another great source of information on all manners of Constitutional rights violations, including the rampant anti-male bias in family law and domestic violence.  Those who are quick to judge a man who is accused of assaulting his wife are often completely unaware or uncaring that sometimes, the woman is a total nutcase and therefore quire impossible to live with.  With the bias in custody determinations and the insane Child Support Crusade, many a man feels compelled to stay with a nutcase wife than leave her.  Because no man, however patient and tolerant, can take an infinite amount of bullshit, when he reaches his bullshit tolerance limit, that is when we have the explosions.  Not all such men will react rationally when driven over the edge.

Fully Informed Jury Association.  Good site.  What every citizen needs to know, because every citizen can be called for jury duty.  For those citizens charged with crimes, it would serve justice if every juror was fully informed.

Robert Birdwell has an interesting little site, www.4justice4all.info.  It is not devoted to child support issues I must admit, but he does address the larger problem of which the current system of child support is but a symptom.  The larger problem: In case you actually do not know (highly unlikely if you are smarter and more observant than the average doorknob) is the lack of respect for our legal rights as set forth in plainly worded Constitutional provisions and statutes passed pursuant to the Appropriate Legislation Clauses to protect our rights as people.  But you know, I was reading about the World Trade Organization agreement and how it usurps the statutes enacted by constitutional and usually democratic processes of the member states, including the United States.  It gave me a wicked idea.  Because child support laws greatly affect our ability to participate in trade, i.e., earn a living without interference by government in our relationships with our employers, labor unions, bankers, credit agencies, etc., even to the point of depriving us of professional licenses including commercial driver's licenses, professional engineer licenses, licenses to practice medicine, law, or even to dig water wells, it is an unlawful and unfair interference in our business relationships with other persons.  Mind you, corporations who might otherwise hire us except for the loss of licenses solely for child support are also unfairly restrained in trade.  Has anybody considered filing a complaint with the WTO?  Perhaps we can form a corporation named the Non-Custodial Parents Commercial Drivers, Professional Engineers, Physicians, Nurses, and Water Well Drillers and then file our complaint with the entity that is designed to protect corporations from regulations by individual nations and their political subdivisions!  (There are all kinds of other legal mischief we can cause with such an organization.  Example, we can respond to any garnishment order for child support with an assertion that it exposes us to liability under the Racketeering Influenced and Corrupt Organization Act, 18 U.S.C. §1961 includes peonage and slavery crimes defined by 18 U.S.C. §§1581-1588 within its definition of "racketeering activity"!!).  In fact, any corporation could refuse compliance with child support garnishment orders with this very argument!!!  So why don't you???

www.constitution.org. This site has an absolutely extensive wealth of information.  Most impressive is the essay, an actual law review article, written by John Wolfgram on how judicially developed doctrines of immunity and abstention frustrate the petitioning by citizens for redress of their grievances.  This can lead to "common law courts" and the filing of "bogus" liens by citizens against government officials for violating their constitutional rights and holding themselves immune to redress.  While not justifying or excusing Timothy McVeigh for bombing Oklahoma City, and I certainly don't, he nevertheless writes a coherent argument that when government refuses to allow redress of grievances by every nonviolent means that citizens come up with, violence becomes inevitable.  Whether it is Spartacus and Company raising Hell all over Italy, Wat Tyler and the English peasants marching on London, or the Massachusetts Minutemen letting the British troops have it at Concord, this is what happens when people are frustrated by the government protecting its prerogatives instead of redressing the grievances.  People who complain about our government abusing its power are lumped together with white supremacist and racist groups, even though many of our complaints against abuse of government power ARE THE SAME AS THOSE EXPRESSED BY BLACK PEOPLE!!!  Those of us who are not racist then get defamed by association and divided from our African American citizens with whom we share a common cause.

MAKE NO MISTAKE!!!!  NO WAY DO I SUPPORT OR HAVE SYMPATHY FOR THOSE WHO SENT THE KAMIKAZES TO HIJACK THE BOEING AIRCRAFT AND SLAM THEM INTO THE WORLD TRADE CENTER AND THE PENTAGON.  CLICK HERE FOR MY TRUE FEELINGS ON THIS!!!!

At the same time, while I do not oppose war with Iraq and I believe that clobbering the Taliban in Afghanistan was more than justified by the attacks on September 11, 2001, I find myself agreeing with some of what is being said by the people who have signed the petition opposing war with Iraq.  You can find them at www.nion.us and here in the State of Washington at www.notinourname-seattle.net.  I am dead set against secret courts, secret military tribunals, and secret imprisonments.  Where we must fight war, we should fight the war, but here in America, the Bill of Rights is the supreme law of the land and we should honor it.  Our public safety does not require that we suspend the privilege of the writ of habeas corpus.

I supported President Bush in his decision for war.   Here is why.  However, I am wondering just WHO is providing the United States Government the HALF TRILLION DOLLARS in new loans each year to pay for the deficit.  And WHY?  I voted for Bush because I was fed up with the Clinton crap that was defended and represented by Al Gore.  But I just do not understand why ELECTED Republicans are so willing to spend so madly (and join the Child Support Crusade destroying the fathers, generating more bureaucracy and spending) when many GRASS ROOTS Republicans CANNOT STOMACH all this spending and bureaucracy!  I just hope that the deficit financing is not coming from the Saudis and others who do not expect to ever get their money back, but are willing to pay us to relieve them of Saddam and Osama bin Laden.  Of course getting rid of OBL is a worthwhile project by itself.  But I wonder.

I hope that this garbage that happened at the Abu Ghraib prison is not conducted by more than a small number of troops and officers who violated their oaths.  Cruel and unusual punishment is one of the things prohibited by the Constitution they swore to support, protect, and defend against all enemies, foreign and domestic.  At the same time, my sincere condolences to those who loved Nick Berg and all who have been killed during and since September 11, 2001.  To the troops not guilty of any crime: Thank you from the bottom of my heart.  If you find the men responsible for murdering Nick Berg, kill them.  They, like Osama bin Laden, don't deserve anything else.

I obviously do not agree with some of the positions taken, see my comments on the Iraq War, but I love well done political satire.  These updated War Posters ought to be quite entertaining, as long as you can be a good sport and take a joke.  Those who protest the war have been rightly criticized for doing it the wrong way, offending people rather than convincing them to come over to their side.  I think this guy, Micah Wright, is doing it the right way because what he is doing is extremely effective satire.

I have done my own versions of some of these war posters, but I do not have enough space on this Geocities site.  I refer you to www.antipeonage.0catch.com.  Because I do not want to be accused of "remote loading", you will have to find your way to the jpegs from there.  Or you can go to Google and type in "Antipeonage Act".  The War Posters Page is now about item 4.

www.october22.org  www.j4mumia.org  www.freespeech.org  www.refuseandresist.org are some of the sites complaining of police brutality.  I do not know whether Mumia Abu-Jamal is innocent or guilty of the crime for which he was convicted: murdering a policeman.  Nor do I know if he was acting in self defense if he did kill the officer.  But I do agree that the Antiterrorism and Effective Death Penalty Act is an appalling violation by our Congress and by President Clinton of their oaths of office to support, protect, and defend our Constitution.  Given the political nature of our state courts, and particularly the Pennsylvania courts as found by the United States Supreme Court in Fiore v. White, (2001) 121 S. Ct. 712, I must say that the deference to the decisions by state courts shows an appalling lack of knowledge of reality or a lack of consideration of the rights of human beings.  To say that the rights of a state, which is nothing more than a political construct, supersedes the rights of a human being, is to take the position defended by those who surrendered at Appomattox Court House.

The Electronic Frontier Foundation is a legal defense type operation that fights to protect our rights from intrusive electronic surveillance and to defend Internet freedom.

Speaking of electronic gizmos, www.antipolygraph.org is a useful site for learning all about a test that a District of Columbia court once found inadmissible in the famous Frye case.

www.rense.com  While this site has the look of a UFO magazine, it is useful to know what is POSSIBLE for our government to do to us in the name of control, whether it is actually true.

I personally do not smoke marijuana, nowadays.  But I did use it when I attended high school and college.  The result of this experience was to cause me to wonder two things: I could not figure out why the stuff was worth $50 per quarter ounce (the high powered stuff back then), and I could not figure out why our government wastes our tax money on those so foolish as to spend $50 per quarter ounce and then smoke it.  I still do not know the answers to these questions, other than our government prohibits marijuana for the same reasons it enforces unreasonable and unconstitutional child support laws: to maximize the number of government employees.  Just as the children of government employees are the children supported by child support laws, so they are supported by the War on Drugs.  Don't get me wrong, those addicted to cocaine and other such substances wreck havoc on themselves, their families, and society, which is not true with those who only smoke marijuana.  But the havoc they wreck can be handled.  The havoc wrecked by the War on Drugs is not so easily remedied. For this reason, I have decided to link to those who are fighting to legalize marijuana because they are fighting the good fight: for freedom to be Americans who make choices without government interference so long as our choices do not violate the rights of our fellow citizens: www.jeffandtracy.com  www.norml.org www.seattlehempfest.com www.potbust.com www.mamas.org  www.lycaeum.org  www.crrh.org www.hr95.org  www.efficacy-online.org  www.drugsense.org www.hemp.net www.prdi.org www.csdp.org  www.november.org www.pdfa.net www.cannabisaction.net www.jug-or-not.com/can  www.dancesafe.org www.drugpolicy.org  www.drcnet.org  www.fear.org www.mpp.org www.mapinc.org www.ssdp.org  www.drugpeace.org www.hempseed.com  www.votehemp.com  A funny thing about the recent United States Supreme Court decision in U.S. v. Oakland Cannabis Buyer's Cooperative is that nowhere in this decision is there any explanation of what provision of the Constitution authorizes Congress to prohibit with the Controlled Substances Act, 21 U.S.C. §§801-971 the simple use, possession, and commerce in marijuana WITHIN a state for any reason.  What the Oakland Cannabis Buyer's proposed to do (or should have proposed) was to grow and produce the marijuana within the State of California.  Refine the product to useable form, within California. And to distribute the product to those qualified by licensed physicians to have a medicinal purpose for their use of marijuana, within California.  That is why it is called a drug.  The reason I point this out is that if under these circumstances an employee of the Oakland Cannabis Buyer's Cooperative were to file suit in a federal court under the Fair Labor Standards Act, 29 U.S.C. §201-219, for failure to pay overtime wages, the suit would be dismissed for a lack of INTERSTATE COMMERCE.  The reason that the FLSA requires interstate commerce for federal jurisdiction was that in 1938, Congress believed that it was the only way it could be upheld as constitutional, as authorized by Article I Section 8 clause 3 of the Constitution, the Interstate Commerce Clause. So how can the Controlled Substances Act apply to marijuana that is NOT involved in interstate commerce?  The Supreme Court neglected to explain that.

But hey!  The Ninth Circuit found that this federal law cannot affect medicinal marijuana, lawful under California's Proposition 215, that has not entered into interstate commerce and is not intended to enter into interstate commerce in Raich v. Ashcroft, (9th Cir. December 16, 2003) _____ F. 3d. _____ !

Or as a bumper sticker says: "The effects of marijuana are, uh, uh, I forget."

www.clickitstickit.com unfortunately disappeared.  However, I am challenging the validity of RCW 46.61.688, the seat belt statute in Knight v. State.  In the process of this, The State filed a State's Motion for Order Continuing Oral Argument and Staying All Proceedings Pending Decision by Supreme Court (Adobe Acrobat pdf file) and cited State v. Eckblad, Supreme Court of Washington No. 74109-3.  In this Motion, Senior Deputy Prosecuting Attorney Deanna Jennings Fuller, WSBA 7914 writes:

"It is the intention of the State to request this stay in all future constitutional challenges to the seatbelt law in King County RALJ appeals until the Supreme Court decides Eckblad.  It is a waste of resources to do otherwise."

This is great news!  I asked that the State be enjoined from enforcing the seat belt statute, RCW 46.61.688, pending the outcome of Eckblad in my Appellant's Response to State's Motion for Order Continuing Oral Argument and Staying All Proceedings Pending Decision by Supreme Court. If it is a waste of resources to defend this statute against constitutional challenges prior to Eckblad, then it is a waste of resources for police to cite motorists and their passengers for seat belt violations.  This continuance should not depend on the defendant being aware of this situation, it should be automatic and done at the court of limited jurisdiction level.  A defendant should not have to file a RALJ appeal to King County Superior Court to enjoy the benefit of this continuance.  Such would deny such defendants the equal protection of the laws without serving any legitimate state interest.

If you get a seat belt ticket you should respond to it with a written motion to continue citing this case, State v. Knight, King County Superior Court No. 03-2-39382-7 SEA and challenging the constitutionality of RCW 46.61.688, on the same basis as me and Mr. Eckblad.  Print out a copy of the Adobe Acrobat file of the State's Motion and attach.  To help you I drafted a dummy motion for my imaginary friend, Roslyn Washington.  She is always getting into this kind of trouble!

I strongly object the idea that our fundamental rights are for sale for a bag of federal money.  I would sign the Initiative that repeals the entire statute, not just take a baby-step because we don't want to lose federal funds.  Hey, that is what our Congressional delegation is for!  We freedom loving Washingtonians are so fed up that we want to whap our government upside the head!  That is why Tim Eyman is so successful!  The Initiative I suggest is the whap upside the head kind of Initiative we need!  If we do indeed lose our share of federal highway money, then our two Senators and 9 Representatives need not support any other bullshit until those funds are restored.  A position they will take if they believe re-election depends on it. If we don't see kilometers on the road signs, it is because they are convinced that we might not re-elect them if they force a foreign language down our throats like that. Same basic concept here.

My favorite process server in Seattle is Seattle Process Service, Inc. run by my good friend Robert Hoyden.  He served Officer Toman, which really impressed me.  I did not have an address for him and neither did www.justicefiles.org at the time.

And I work with John R. Scannell at Action Employment Law.
