transferring between my manual and powered wheelchair.
This apartment is a death trap for someone with a
disability like mine. I
dislocated my elbow, broke my arm and sprain my left
ankle. That was on April 23, 2003. The State interfered
and had me removed from Valley Medical Center before I
had my arm set in a cast.

Allen just
cut over 100 jobs at Vulcan and
Steve Ballmer sold 70
million of Microsoft stock. On Friday May 23, over 77
million shares of MSFT sold--almost double. And on
May 6,
Gates slipped a Red Sweater over his pink shirt during a
photo shoot. That is one of our nerd rebellion Q.
Cool Bill. I needed a laugh about then. No wonder
Ballmer is selling That is a first
for him. You know if Gov. Locke keeps this up, the
state will go bankrupt.
May 25, 2003: I still haven't seen an orthopedist
about my arm and ankle. Boy have I been praying
for Divine Justice on this one. The pain is just now
beginning to reside after I got my elbow back in it's
socket on May 22. This is Gov. Locke's Hear no evil, See
no evil, Speak no evil. Oh well, it's not the first time
I've had to treat myself in my home due to an inability
to get to a doctor. I'm looking for a lawyer now.
They
keep thinking that if they say I'm a
psychiatric case they can get away with this.
Well, I didn't use to have any
psychological problems. And right now... well I feel
pretty mentally functional. If I weren't I think I would
be dead by now. Funny how my neighbor down the hall went
in on a psychiatric and got about 5 days of hospital
treatment without any problem at all. If I were truly a
nut they would have kept me.
Periodically someone hacks my
web and removes this page and a few others that
Microsoft doesn't like. This is a
HATE CRIME... They are trying to
starve me out either to force me into a nursing home
where I would loose my computer access or to kill me due
to neglect due to a lack of either medical or social
help. As long as I can crawl into this chair I'm going
to be here so take another HIT~ I'm talking to the DOJ
again.
Odd thing... I was
originally attacked because Microsoft thought I was a
Christian. And then they retaliated because I was
disabled and had the never to think I should be
employable. Now I'm being denied medical and social
services, because they think I have a developmental
disability or cognitive disorder and am psychotic. What
is really true is that I'm just an intellectual, having
a really healthy reaction to being assaulted and
harassed. Living with a dislocated elbow, broken arm and
sprain ankle for almost a month without having it ever
put in a cast is pushing this just a bit far. But I can
transmute pain and anger and turn it into pure energy.
I'M ALMOST DEAD FROM HARASSMENT AND RETALIATION.
C. Retaliation
A complainant may bring
a retaliation claim under Title VI or under a Title VI
regulation that prohibits retaliation. For example,
most agency Title VI regulations provide that "[n]o
recipient or other person shall intimidate, threaten,
coerce, or discriminate against any individual for the
purpose of interfering with any right or privilege
secured by [Title VI], or because he has made a
complaint, testified, assisted, or participated in any
manner in an investigation, proceeding or hearing
under this subpart." 28 C.F.R. § 42.108(e) (Department
of Justice Regulation).
To establish a prima
facie case of retaliation, the investigating
agency must first determine if the complainant can
show (1) that he or she engaged in a protected
activity, (2) that the recipient knew of the
complainant's protected activity, (3) that the
recipient took some sort of adverse action against the
complainant, and (4) that there was a causal
connection between the complainant's protected
activity and the recipient's adverse actions. See
Davis v. Halpern, 768 F.Supp. 968, 985 (E.D.N.Y.
1991). (Defendants's summary judgment motion to
dismiss Title VI retaliation claim was denied because
plaintiff established evidence of prima facie case).
Once a prima
facie case of retaliation has been established,
the investigating agency must then determine if the
recipient can articulate a "legitimate
non-discriminatory reason" for the action. Id.
If the recipient can offer such a reason, the
investigating agency must then show that recipient's
proffered reason is pretextual and that the
recipient's actual reason was retaliation. Id.
A showing of pretext is sufficient to support an
inference of retaliation. Id.

There is nothing so
wonderful as having Big Brother Microsoft go after all
you e-mail buddies because they don't like your web
site. ... :-) Most of my e-mail to Bill Gates is about
design issues that effect me directly as a disabled
person. After 3 years of saving every spare penny I
finally was able to by a new computer in 1998. It cost
$2500. I still have my old computer sitting next to it
with Win 3.1 on it. I am making about 10 times the mouse
moves in Win 98 than on older versions. It's a
pain--literally.
There are also major math errors that cause me to loose
my graphics work. And with ever path to the system,
I loose another math based program. So this is
justification for what they did. They actually submitted
this into court documents and I was threatened with a year in jail if I e-mailed
Gates again. They claim that they had already
black balled me from contacting the company for
developer support and that complaining to the CEO about
this was a violation of their earlier illegal
retaliation. So that gives them a right to harass all my
e-mail buddies. I have almost NO e-mail now. Nothing. So
I use this web to contact people which makes it hard to
read.
I'm a
whistle blower and have paid the price for it. That is
a picture of me me before Microsoft harassment in 1996 and this is me now.

I'm
now disabled and barely able to take care of myself due to
physical injuries. Fortunately, I can still peck at this
keyboard and type or I would be most definitely dead by now.
So much for the American Justice System. The harassment got
really bad when the antitrust case started. I was trying to get
Gates to settle out of court and didn't know if he was
reading me. He seemed to be.
I knew
the case would go this way. He had people in his own
company and around him trying to use the case to take him
down. They had people in D.C. in collusion. So some
very paranoid people started attacking me for writing about
math and security issue in Windows that people were really
upset about. And sexism in computer design.
I hate
posting anything negative on the Internet. I just hate
it. Bur hear we go again.

a writer. I'm an artist and engineer. I think in pictures. My writing is extremely

since the late 80s, I think the reading level for most
people is below the 5 grade. One stat I found in government
said that over 50% of Americans are functionally illiterate.
That is scary.
The
smarter a women is the more likely she is to be
abuse. I am extremely
abused and battered women, now physically disabled due to
sexual harassment in my community involving Microsoft. They
never stop and in the USA women have no civil rights unless
they have the money to buy them. I'm not being arrogant
about being smart,

When I
first wrote to Gates it was about my life and background.
I was looking for a really smart guy who would protect me in
the work place. It didn't happen. They say
that any organization gets it's psychology from the people
at the very top. What does this say about the men in charge
of this whole country? What does it say about Microsoft.
All
the men want to do is fight. It's the sex and violence
everywhere in the media. Males are being overly
stimulated sexually. It's just not natural. It can
give you cancer.
These
Microsofties can't discriminate between virtual
reality and the REAL world. If a
3D sexy fighter women in a video game is what
you believe, then you expect women to fight back. Well
fighting is not what I'm about. My small bones were not designed
to do kick boxing. We women have the rights
to live and work within the genetics that God
created. So buy your XBOX boys and
dream on... It's NOT real.
Yes
girls, any man that feels the need to discriminate or
sexually harass you, obviously has a major inferior complex.
Take the knocks and then learn to spin it back on them.
Sexual harassment isn't about sex it's about power. When
cases like mine don't have closure, it always spins back on
the men. I gage it in terms of the cognitive damage it did
to Microsoft number one asset--Bill Gates. Hate is a
mind killer and so is fear. But the Biggest mind
killer is guilt. Guilt can create paranoid delusions.
It's that paranoid behavior at Microsoft that I chuckle at.

How do people become so paranoid? I

low back wrecked when I was rear-ended by a dump truck as a passenger
in a car driven by a state contractor.

Cervical
X-Rays. You should seem the
cervical and lumbar spin MRI. They are really bad now.
Because this healed wrong my spinal cord was left
compressed and my nerve roots going to my arms were
crushed also. I only have bout 1/3 function in my arms
and very little strength.
The line in the last photo
is on the X-Ray and not a part of the physical
condition. Its a very fragile situation. The
slightest gar and my spinal cord will get pinched and
swell. This was a fixable situation and may still be.
But it's so bad due to a lack of treatment that the last
surgeon I saw said it looked like a malpractice issue
and would be too dangerous to do now.
Joe Dear was the Director of
Labor and Industries at the time when my claim was
closed without medical release. It was cut off about a
week after the lawsuit was served on Microsoft for the
assault that cause this injury. I had a hearing in
an attempt to keep the claim open and my doctor
testified that I wasn't medically stationary and Kelly
Services was granted a summary judgment and the case was
closed anyway, even though they submitted NOT witness or
documents to the contrary. This is how Preston Gates and
Ellis deal with a disability and harassment case. They
don't go to court. They just harass you and go after
everything in you life.
Both C4-5 and C5-6 were to
be removed. The surgery was to be done in April of
1991. They only did the one level--C5-6.
This is because they had problems keeping me
unconscious. I was suppose to have a second
surgery in early 1992 but Microsoft interfered with
my Labor and Industries Insurances. Because of complications the fusion didn't work.
So I blew the lower disc--C6-7 also. They
call this Cascading Syndrome. I never recovered.
The Department of Vocational
Rehabilitation considers this condition a psychiatric
disorder. They had me tested for at the UW and found NO
mental disorder yet persist with this view. In the past
12 years, they never did a physically assessment.
Why?
I've made complaints about
this to Director of DVR, Mike O'Brian.
Funny... In the investigation again no one interviewed
me or even called me on the phone. That is
discrimination. You are disabled so you must be
too incompetent to have any input?

DVR and the UW, who denied
me medical treatment, think they are are promoting
themselves with Mr. Gates Sr. who controls the wealthiest man in the world. In a recent psychological assessment by Gary Gernell, PhD and Jame O. Raney, MD, both for Safeco,
that my present condition is a form of hysteria. Well,
I'm NOT laughing. :-) The doctors who don't know
anything about my Microsoft mess are shocked that I have
such a major physical disability and haven't had any
medical treatment for it. They don't want to get
involved now because they say it looks like a medical
malpractice case. So much for this slanted hysteria
view. Suck up if you can boys, but Mr. Gates Sr. can't
cover all his deviant behavior.
The only pain medication for
this is work so that is what I do with this Web
Site. I work at it. I would rather be doing a for
pay job and not living off taxpayer's money. All I
wanted to do is go back to work so I could afford
to pay for my own medical myself. I wanted to move on
from this mess. I wanted to move out of this community.
I was denied that opportunity.
When I attempted to move to
Connecticut so I could work for IBM, Microsoft fought me
legal and I found myself tied up in legal hassles.

Ending Harassment Story by Bill Gates' father's Law Firm
They never even
interviewed me at Microsoft or deposed me when I
attempted to sue for my injuries. Why not sue for Legal
Malpractice Microsoft? Clear you name!
I was the
victim of work place violence. I was hazed by two male
employees at Microsoft on a business trip and after
getting injured, was told I had to do whatever they said
because I was just a TEMP.
Then when I
attempted to get help, I was attacked in my hotel room by
one of the males--a Filipino National who had very
different ideas about work relationships, feeling that
because he was my supervisor he had rights to sex. He
was uneducated. I have never understood why they placed
him over me when I had a high level technical degree. He
seemed to be getting encouragement from his boss who was
worried about possible competition from someone more
technical than he was.
Essentially,
my neck was broken when I blew out a disc as can be seen
in the 1990 X-ray. I had a fusion but they
couldn't keep me under and only did one of the disc.
Then due to the politics of the situation, I became
viciously harassed. My Labor and Industry worker's
compensation and medical were cut off by Kelly Services
without a release from my doctor. Due to the
politics of the situation, the state allowed this.
Because I didn't get the PT and rehabilitation I needed,
my condition never improved. In fact, now it's much
worse--at least 10 times worse--than before surgery.
They were suppose to do a second surgery to finish up
the mess in 1993 but the Labor Board allowed Kelly to
close the case, even though my doctor testified in
hearing that I wasn't stable. Even with this I still work
on a computer every day.
Just 3 1/2
years ago I was in an automobile accident. It seem
to me that every self-promoting bureaucrat thinks they
can get ahead by beating me down. I have 12 years of
lost income just because I was the victim of work place
violence like this. As for Microsoft, they support
what the men did to me completely.
I'm still
under attack by some people in that company.
Mr. Gates has known about this situation for years and
has refused to do anything about it. The above
graphic was made for him so I could send it via e-mail
along with other medical records that were requested. I
don't think a company that supports criminal behavior
has much of a chance. Eventually something really bad is
going to come out about Microsoft. I don't know what or
why they are this way, but normal people don't behave
this way.
Since the
accident my condition is much worse and now the
Safeco, via their attorney Rhonda L. Kalil of Tacoma,
is refusing to compensate me for the new injuries which
include my low back now and the wipe out the rest of my
cervical spine. I was offered $15,000 which isn't even
enough to cover the cost of the wheelchair I need,
especially since my attorney, Richard Hilfer gets
half. They and everyone else in my community think they
can get way with this and other forms of abuse because
of Microsoft.

My -- This is my
computer work station and bed. I've had a prescription
for mechanical bed for years because I wake up chocking
at night and need to sleep semi-reclined. I can't get
any help to get it. So I'm sleeping on a child's bunk
bed--a wood pallet with a broken down mattress.
We had a hearing on COPES
and they were granted a summary judgment claiming that
they would help with such things. But they don't and
United Way funded agencies don't seem to want to help
either. Fact is there aren't any volunteer
agencies for the physically disabled. Just COPES. It's
like living in Nazi Germany.
Microsoft has hired over
50,000 people since I was injured their. They fired the
man who assaulted me, but never would even consider
hiring me back, even though they knew I was wrongfully
dismissed. Instead they interfere with everything in my
life and still do. I shouldn't feel too bad. They fired
a lot of the DOS boys who developed stress related
illnesses after working 89-90 weeks for too many years.
One kid in his 20s dropped dead of a heart attack
on the job due to over work.

After all of this, there
was never an investigation. Someone in Microsoft
buys people off. It was nothing short of bribery. I was
unable to get the second surgery I need because they
refused to allow anyone to reopen my Labor and Industry,
even though I let the Microsoft case go. And the
EEOC's way of handling this was to make up a false
allegation in collusion with Microsoft that I had
literally force open a sliding glass door at the Federal
building and broke into the EEOC. This was
eventually dropped and the investigator, Mike Walley of
GSA security not the FBI(?), said that they knew who I
as and that it was totally made up. He was quite
embarrassed.
This is a criminal offense. So why weren't
the people at Microsoft and the EEOC charged? I've
also been falsely accused of hacking computers. I think
Scott McArthur,
corporate Manager of Investigations for Microsoft
Corporation, in collusion with Bill Gates' father's law
firm had something to do with this. They are both on
court documents. So what is the federal law on this?
Breaking into the Federal Building seems like it would
be a pretty serious issue. It was this incident that
motivated me to finally put up the web site. I had tried
everything to leave the whole Microsoft issue behind me
but the harassment has never stopped. It's a HATE CRIME
and it's killing me.

Malicious prosecution.
Every person who shall, maliciously and without
probable cause therefor, cause
or attempt to cause another to be arrested or proceeded
against for any crime of
which he or she is innocent:
(1) If such crime be a felony, shall be punished by

Well, Mr.
Gates himself knows about this case and won't do
anything about both the past harassment and the
harassment that continues today and threatens my
physical health and existence. In fact, numerous upper
level executives know that my life is now at risk
due to this kind of continued retaliation yet there is
NO criminal investigation or closure.

What this
situation represents now is nothing short of a real hate
crime. And to be disabled and know that people are
intentionally using your condition in an attempt to kill
you, is pretty distressing. I have a physical condition
that remains fixable, though at this point I'm literally
trying to exist with a broken neck that is so unstable
that a slight bump can land me on the floor crawling
around for weeks pretty much confined to bed. In
my case, people at the very top of Microsoft have been
involved. Isn't that true Steve Ballmer? You and your
wife were right in there... So what is this?

I'm the
one incompetent--with a 3.7 GPA out of college--not the uneducated Filipino who
assaulted me. This women obviously can't even read my
e-mail If she considers it hostile then it must be
some projection on her part that certainly wasn't
intended by me. After all I was attempting to go through
major cervical spinal surgery and they were harassing me
at the time. This is why I was trying to get to Gates.
NO ONE at Microsoft to this day has ever talked to me
about the retaliation which continues to this day. Some
of the women in the company who were in the business of
using sex to promote their careers may have taken it to
be hostile, but it certainly wasn't hostile in any real
sense of the word. After all, they had originally
attempted to recruit me to sexually manipulate Bill
Gates. I was quite sure that I had been head hunted into
the company and placed right down stairs from him yet
again for the same purpose--they hoped I would become a
diversion for him. I sure blew the lid off this powder
caked didn't I.

There is a big difference
between sexual harassment and assault. I was assaulted.
I was also drugged and raped. They had e-mail about this
because the uneducated Filipino bragged about what he
had done and was later fired when they found out. I
actually talked to Glenn after he was fired, something I
don't think they would have ever considered. I actually
tried to get him to file with the EEOC because he was
fired also. Microsoft had no policy for dealing with
such disputes. So they just destroyed my career. As I
said, they have never talked to me about what happened
13 years ago and continue to ignore the retaliation
issue that how is placing me at risk for dying in my
apartment due to criminal neglect on the part of social
services in my state.
HATE CRIME
As you will see in
reading these legal status, when a person knows that a
party is committing a criminal act and does nothing,
that makes them complicit in the crime themselves. Bill Gates know about my situation. I've actually talked
to his father on the phone many times and have an
answering machine tape with him on it. His father
has known and instead of doing anything to stop this,
seems to be doing more to harm me.
Microsoft
also monitors this web site. I've had license numbers
and discriptions on this web of harasser who work for
Microsoft. Yet they attack me for attempting to get this
to stop. This is why we have these
bizarre legal documents. That makes the malicious
harassment and continued assault on me--a physically
disabled women--a hate crime that goes all the way to the
top of a major corporation--to the CEO and Chairman of
the Board. Many board members know about this
also. Yet hey protect employees who commit these acts
against me. I may never get them in jail because of
their ability to bribe local judges and police agencies,
but I'm going to make damn sure that the world knows
what kind of men are running Microsoft. They can say
whatever they like. Microsoft has not changed and will
never change as long as the support criminal activities
to make a buck.

THE HORROR OF BEING A GIFTED WOMEN - I should be
dead. The only reason I'm not is because my brain is
always in hyper drive creative mode. It's amazing what
happens when you are constantly living under survival
stress. I had put up a lot of no perishable food for Y2K
and that has saved me many times.
It's amazing how much
food you can get out of a 2 lb. bag of beans and how
long that can last. It can keep me alive for a week. I
can only cook things like beans and rice or throw a
piece of meat in a pan. On my $572 a month I can only
afford to buy meat that is reduced in price quick sale do
to being passed pull date.
It's amazing how you can
learn to survive on such things. When I'm incapacitated
due to a spinal cord swelling I drink sugar water so I
can keep my blood sugar from dropping and causing me to
loose cognitive function. You boys think you can
kill me by starving me out. Keep in mind I'm a
disciplined mystic and that is nothing to joke about. I
have a lot of time to mediated these days. And
what do you think I mediate and pray about?
You put your hand between
your legs boys and hold no tight because when I'm
through, even if I die, you will not be men. NO ONE has
any respect for men who support the rape and abuse of
women. Remember, 3 men have been busted at your company
for child pornography. And remember why you have
blackballed me from working with your company. Look at
those documents you submitted in Northeast District
Court. You support this pornography issue too. That is a
felony too.
This guy is guilty of a felony and hate crime.
I've done thing but try to get the harassment to stop.
Who are these people.
Microsoft HR or Legal Department never even interviewed
me after the assault. And the Preston Gates and
Ellis law firm who handled the lawsuit never did a
deposition even. I guess getting my neck broken under
these conditions was OK because I was female.

ABOUT HATE! HATED BECAUSE I'M A WOMEN AND HATE
BECAUSE I'M DISABLED. NOW I HAVE TO GET HELP AT

RCW 9A.36.080
Malicious harassment -- Definition and criminal
penalty.
(1) A person is guilty of malicious
harassment if he or she maliciously and intentionally
commits one of the following acts because of his or
her perception of the victim's race, color, religion,
ancestry, national origin, gender,
sexual orientation, or mental, physical, or
sensory handicap:
(a) Causes physical
injury to the victim or another person;
(Got my neck broken on the
job due to assault. Then had my condition used as a
point of harassment while attempting to go through
surgery. This continues to this day. Cutting off my
L&I without medical release, supported by Joe Dear,
Denying medical treatment in exchange for substantial
donations- $10 million at the UW who has repeatedly
refused to treat me. I can't get social services here.
People know who I am. I've had my medicaid hack and
doctors threatened. One had his Labor and Industries
payment for all his clients messed with until he
dropped me and the other had the same thing happen
with Medicaid. )
(b) Causes physical
damage to or destruction of the
property of the victim or another person; or
(It
took me 4 years to get a powered wheelchair,
even though I had a hearing with DSHS and there was a
summary judgment because DSHS said they were going to
help me get it. They never did. I worked at Microsoft.
I know how they make offers of jobs to people and
offer other perks to get them to do their dirty work.
I saw it going on with Federal government contractors.
They literally offer jobs to people. AND one of
the people who was trying to use a psychotic neighbor
to assault me by telling the psychotic I was spying on
him via his computer I actually meant. He didn't
recognize me so we chatted. He said he worked in the C
Tool Group and was ex-military. Why am I not
surprised. My neighbor did eventually flip out. I
didn't get hurt but he did get evicted. There are
police reports on this.)
(c) Threatens a specific
person or group of persons and places that person, or
members of the specific group of persons, in
reasonable fear of harm to person or property. The
fear must be a fear that a reasonable person would
have under all the circumstances. For purposes of this
section, a "reasonable person" is a reasonable person
who is a member of the victim's race, color, religion,
ancestry, national origin, gender, or sexual
orientation, or who has the same mental, physical, or
sensory handicap as the victim. Words alone do not
constitute malicious harassment unless the context or
circumstances surrounding the words indicate the words
are a threat. Threatening words do not constitute
malicious harassment if it is apparent to the victim
that the person does not have the ability to carry out
the threat.
(2) In any prosecution for
malicious harassment, unless evidence exists which
explains to the trier of fact's satisfaction that the
person did not intend to threaten the victim or
victims, the trier of fact may infer that the person
intended to threaten a specific victim or group of
victims because of the person's perception of the
victim's or victims' race, color, religion, ancestry,
national origin, gender, sexual orientation, or
mental, physical, or sensory handicap if the person
commits one of the following acts:
(a) Burns a cross on
property of a victim who is or whom the actor
perceives to be of African American heritage; or
(b) Defaces property of a
victim who is or whom the actor perceives to be of
Jewish heritage by defacing the property with a
swastika.
(If I were a Jew
these people who harass me would be arrested. When I
consider the mega bytes of hate mail I've received
over the past 13 years I shutter. I had an attorney
who was suppose to be working for me. It turned out
that I was really being set up. I eventually had
to block his e-mail because it was hate mail and
extremely harassing.
I actually filed a police complaint against him.)
This subsection only
applies to the creation of a reasonable inference for
evidentiary purposes. This subsection does not
restrict the state's ability to prosecute a person
under subsection (1) of this section when the facts of
a particular case do not fall within (a) or (b) of
this subsection.
(3) It is not a defense
that the accused was mistaken that the victim was a
member of a certain race, color, religion, ancestry,
national origin, gender, or sexual orientation, or had
a mental, physical, or sensory handicap.
(4) Evidence of expressions
or associations of the accused may not be introduced
as substantive evidence at trial unless the evidence
specifically relates to the crime charged. Nothing in
this chapter shall affect the rules of evidence
governing impeachment of a witness.
(5) Every person who
commits another crime during the commission of a crime
under this section may be punished and prosecuted for
the other crime separately.
(6) "Sexual orientation"
for the purposes of this section means
heterosexuality, homosexuality, or bisexuality.
(7) Malicious harassment is
a class C felony.
(8) The penalties provided
in this section for malicious harassment do not
preclude the victims from seeking any other remedies
otherwise available under law.
(9) Nothing in this section
confers or expands any civil rights or protections to
any group or class identified under this section,
beyond those rights or protections that exist under
the federal or state Constitution or the civil laws of
the state of Washington.

(a) Intentionally assaults
another and thereby recklessly inflicts substantial
bodily harm; or
(b) Intentionally and
unlawfully causes substantial bodily harm to an unborn
quick child by intentionally and unlawfully inflicting
any injury upon the mother of such child; or
(c) Assaults another with a
deadly weapon; or
(d) With intent to inflict
bodily harm, administers to or causes to be taken by
another, poison or any other destructive or noxious
substance; or
(e) With intent to commit a
felony, assaults another; or
(f) Knowingly
inflicts bodily harm which by design causes such pain or
agony as to be the equivalent of that produced by
torture.
(2) Assault in the second
degree is a class B felony, except that assault in the
second degree with a finding of sexual
motivation under RCW *9.94A.835
or
13.40.135 is a class A felony.

In addition to the criminal penalty provided in RCW
9A.36.080 for committing a
crime of malicious harassment, the victim may bring a
civil cause of action for
malicious harassment against the harasser. A person
may be liable to the victim
of malicious harassment for actual damages, punitive
damages of up to ten
thousand dollars, and reasonable attorneys' fees and
costs incurred in bringing
the action.

or attempt to secure a particular result in a particular
matter.

Commercial bribery.
(This is
Microsoft's favorite form of bribery. I've seen them do
it while working in the company. When they filed legal
actions with my service provider to get my e-mail, I had
known for months that someone was already getting it.
I'm an engineer and began to compile evidence to support
that they were getting into my e-mail. On the weekend
when the person in question seemed to be off, I got ON
e-mail at all. As a result, some of my e-mail would be
held up for about 3 days. This gave me two different
time stamps. But that wasn't all. On numerous occassion
when they blocked my e-mail, something went wrong. So I
would down load my e-mail, and then a few days later it
would show up again. On one occassion I ended up with
three copies of the same e-mail with different download
dates. So I just kept documenting it.
The password
for my e-mail was in a data base and could be accessed
by anyone at Transport.com. I came to the conclusion,
given what was going on, that more than one party at the
company was accessing my e-mail. This is something
that has happened with every service provider I've used.
These guys always mess it up. At Prodigy, I had over
$2000 taken against one of my credit cards in 1991. What
I have going on is more than just bribery. This is
criminal hacking.
Last years someone did an number at
Prodigy again. I have broadband, so why would I
subscribe to Prodigy. I couldn't even cancel the account
because my name wasn't on the account. So how is it that
Prodigy could bill my bank card without the right name?
This has never ended. Both Bill Gates and Steve Ballmer
know about this situation in their company and as such
this makes them complicated.)
(1) For purposes of this section:
(a) "Claimant" means
a person who has or is believed by an actor to have an
insurance claim.
(b) "Service
provider" means a person who directly or indirectly
provides, advertises, or otherwise claims to provide
services.
(c) "Services" means
health care services, motor vehicle body or other motor
vehicle repair, and preparing, processing, presenting,
or negotiating an insurance claim.
(d) "Trusted person"
means:
(i) An agent,
employee, or partner of another;
(ii) An
administrator, executor, conservator, guardian,
receiver, or trustee of a person or an estate, or any
other person acting in a fiduciary capacity;
(iii) An accountant,
appraiser, attorney, physician, or other professional
adviser;
(iv) An officer or
director of a corporation, or any other person who
participates in the affairs of a corporation,
partnership, or unincorporated association; or
(v) An arbitrator,
mediator, or other purportedly disinterested adjudicator
or referee.
(2) A person is
guilty of commercial bribery if:
(a) He or she
offers, confers, or agrees to confer a pecuniary benefit
directly or indirectly upon a trusted person under a
request, agreement, or understanding that the trusted
person will violate a duty of fidelity or trust arising
from his or her position as a trusted person;
(b) Being a trusted
person, he or she requests, accepts, or agrees to accept
a pecuniary benefit for himself, herself, or another
under a request, agreement, or understanding that he or
she will violate a duty of fidelity or trust arising
from his or her position as a trusted person; or
(c) Being an
employee or agent of an insurer, he or she requests,
accepts, or agrees to accept a pecuniary benefit for
himself or herself, or a person other than the insurer,
under a request, agreement, or understanding that he or
she will or a threat that he or she will not refer or
induce claimants to have services performed by a service
provider.
(3) It is not a
defense to a prosecution under this section that the
person sought to be influenced was not qualified to act
in the desired way, whether because the person had not
yet assumed his or her position, lacked authority, or
for any other reason.

How does one go from being a
totally sane person to crazy ones?.
The DVR program needs to go. It's not performing the
function it was intended for and the people working
inside do nothing but spend taxpayer's money on
unnecessary testing and assessments. I graduated from
OIT in 1988 and this agency has totally destroyed my
reputation and career. On SSI or welfare since 1990
when I was injured on the job, I also receive Medicare
and Medicaid, HUD and food stamps. My injury at
Microsoft was due to a lack of accommodation. I was
told by DVR NOT to tell anyone about my spinal
condition. Now I'm in a wheelchair and could sue this
state for negligence. What I would prefer is some
kind of action regarding the way this agency works or
better to the point, doesn't work.
I'm taking this public on the Internet. This state has
a budget problem. I think taxpayers need to know why.
But more to the point, DVR is getting federal money.
There are rules about how that money is to be spent. I
read the document. So I'm also taking this to the
Dept. of Treasury and
Treasury
Secretary Paul O'Neill
and DHHS. I think we need a new rule in government.
People who run for office must first pass a math and
economics proficiency test. I'm not kidding either.
The same goes for these people in DVR. I got As in
both Cost and Financial accounting in college and what
I see going on is incompetence. I don't have the exact
number because of access, but I can get close.
I also am lobbying for an end to Affirmative Action
Laws. We have too many people from third world
countries getting into the government. When they come
here they bring with them their culture and poetical
systems--graft. Affirmative Action was to help women,
blacks and Hispanics--already here--get a better jobs,
NOT create a gravy train for foreigners.
The linguistics issues alone are good reason to change
this. I know having dealt with many of these people
that they can not comprehend our government programs
and many other democratic/capitalistic principles.
This isn't racism. It's realism. It took me six months
to explain insurance to a Vietnamese in-home care work
after we were in an auto accident.
I have more education and experience than most of
these people. I am well respect in the computer
industry. People can't understand why I have continued
to remain out of work. I can program, do systems
analysis, program the internet and do
graphics--including 3D. All I needed from DVR was
help finding the Diversity HR person in these
companies so I could contact them about possible
jobs. If you go into a normal interview they always
reject you due to your disability because they don't
know the law. You need a vocational specialist and
advocate to help present you. DVR has never
done this and neither has any of the agencies
they use. DVR needs to go.

Gates Foundation is
investing $37.3 mil in the maker of Zoloft, Pfizer,
who is involved in invalid drug test at the UW. I
love the press in the UK. :-) I guess my complaint to
the
FDA is working. The UW is also under
investigation for
Medicare/Medicaid fraud. These drug combinatiom are very dangerous. I've seen many psychotic eposides in my apartment complex.
About the Zoloft
trial:
If you filter out anyone who is know to have side
effects then it's not a valid sample. This is marketing
at it's very worse. This isn't science. The
Universities are getting
money for doing this too so they don't object to the
requirements made here. The following was written by
another very highly qualified scientist at another
university outside the US.
Having
read those pages, I have a number of concerns about that
project.
1. The recommended initial dose for Geodon (alone) is
20mg/day.
The study uses 40mg/day and 80/mg a day; the latter
is half the
maximum recommended dose. I think they ought to
have a group at
20mg/day.
2. The people selected for the study are ones who
"don't respond to
6 weeks of treatment with Zoloft 100-200 mg/day".
All of the
subjects will receive another 6 weeks of treatment
with a drug that
has already failed (that is, they will suffer the
negative effects
with no expectation of positive effects) and 10 of
the subjects will
receive another 8 weeks of "treatment" that is known
to be ineffective
for them.
So 30 people will be asked NOT to seek effective
treatment for 12
weeks, and 10 of them will be asked not to seek
effective treatment
for a total of 20 weeks. That's a _long_ time for
someone to suffer
"major depression". They ought to receive some
really serious
benefits in return for this.
I do understand that they are looking for a way to
help people that
aren't currently being helped. But it does say
"there are alternative
treatments available". If there weren't, it would
still make sense
for someone to turn to "quacks" and "alternative"
medicine and try
practically _anything_. The subjects are passing up
at least the
_possibility_ of some more effective treatment, for
several months.
What _are_ the benefits?
- A psychiatric evaluation,
but the principal beneficiaries are the researchers, who
want
to exclude people who don't fit their criteria ("without
psychotic features").
- A physical examination,
but the principal beneficiaries are the researchers, who
want
to exclude people who don't fit their criteria (liver or
kidney
damage is a warning sign against prescribing drugs like
these).
- An ECG,
but the principal beneficiaries are the researchers, who
want
to exclude people for whom Geodon is contraindicated
(because
Geodon has some effect on the heart, so people who
already have
heart problems should not receive it).
In fact, the people who will be asked to keep on
with ineffective
medicine for so many weeks are precisely the ones
who receive no
real benefit here because they didn't have any
problems in those
areas in the first place.
3. I note that these exclusions mean that the results
of the study
will only be valid for people who pass similar
tests; there will
be no reason to extrapolate any effect or safety
results to the
general public.
4. I note that the RISKS section mentions only side
effects which
one could expect to be temporary. There is no
mention of increased
risk of breast cancer or liver damage, both of which
are mentioned
in the Prozac Truth web site (www.prozactruth.com);
there isn't even
any mention of weight gain. Not even all the known
temporary
side effects of the drugs are listed. Nor are the
"abnormal muscle
movements" common with Geodon mentioned (unless
that's what they
have in mind with 'akathisia'; I thought it would be
more like tics).
5. I further note that drugs which affect
neurotransmitters sometimes
have a "rebound effect". To catch that, you have to
monitor the
subject for a couple of weeks _after_ the medication
is withdrawn.
I see no mention of such post-treatment monitoring
in these pages.
6. "Financial compensation for such things as lost
wages, disability
or discomfort due to this type of injury is not
routinely available."
I've had the kind of sadness that one gets when a
relationship
breaks up. I would not willingly go through that
again. From
everything I've heard, major depression is a LOT
worse. People
who choose to be subjects in this experiment,
instead of pressing
their doctor to try something, _anything_ else, or
going to the
quacks, are heroes. They are undergoing a lengthy
period of
suffering that they could at least have _tried_ to
avoid. Now I
have taken part in one asthma experiment (I caught a
respiratory
infection part way through, so they removed me from
the study) and
will shortly be in another. But they weren't
messing with my _head_.
There was some discomfort, but it was temporary, and
I understood
pretty well everything they were doing, and was
cheerful at the time.
You'd have to pay be a _lot_ to undergo what these
subjects are
undergoing. If not reward, at the very least they
deserve adequate
protection.
Financial compensation for things like this _ought_
to be
"routinely available", and in a
civilized society
would be, through
something like our Accident Compensation Commission.
7. I note that there are urine tests to 'screen for
illicit drugs'.
Sometimes I'm so cynical I surprise myself. I wonder
what effect
marijuana would have on these people. I can't help
thinking that
at least it'd be a heck of a lot safer than these
drugs. And of
course by screening out people who use it, you make
sure that you
will never find any evidence that it helps... This
is half a joke.
But only half.
8. The main thing that strikes me is that I don't
believe a study this
small can ever provide any evidence worth having.
Let me briefly
explain three reasons why.
a. Time.
I note that Zoloft may take up to eight weeks to have
its
full effect. It would not be surprising if adding
Geodon
to Zoloft required another eight weeks. This means that
the eight week 'combined treatment' period is the
_minimum_
they could get away with.
With this short study there is no way they could
discover
the consequences of long-term treatment. Heck, with a
study
this short, you would conclude that tobacco was
perfectly
safe!
b. Sample size (I).
There may be many different causes of
depression.
You need at least as many subjects as there are
(frequent)
causes to make sure that you're not missing a systematic
effect.
At a rough guess, there could easily be four different
underlying causes for depression: (physical trauma,
possibly at
an early age; infection; drugs, both medical and
recreational;
genetic defect). Allow a factor of 5.
Men and women may differ. There's a factor of 2.
In order to measure natural variation (and without that,
you
can draw no real conclusions), you need at least two
subjects
for each condition (here age x cause). Another factor
of 2.
So in each of the (0mg/day, 40mg/day, 80mg/day) groups,
you
really want at least 5x2x2 = 20 subjects.
c. Sample size (II).
There's a rule of thumb in statistics that with a sample
of
size N you can detect effects of magnitude no less than
order (natural variation)/sqrt(N). With different
constants
to scale this ratio, this rule of thumb works for
practically
all situations and models.
Let's not forget that 30 is the _starting_ number of
subjects.
Some of the subjects may have to be dropped during the
experiment.
In fact it's extremely likely. They might end up with
25 subject
altogether. They might also end up with none.
All things considered, they are likely to notice a
_dramatic_
improvement. They are very likely to miss a _mild_
improvement.
They are also very likely to miss a mild worsening, or
even
due to "luck of the draw" record a mild improvement for
their
sample when the normal result in later years turns out
to be
mild worsening.
If I interpreted correctly something I saw on the Web,
Zoloft
was tested on 4000 subjects before approval. The
combination of
Zoloft and Geodon which is a *new* drug could have
effects
different from either taken separately, and should be
tested to
the same standard. (Just like you can take a monoamine
oxidase
inhibitor, or you can take Zoloft, but you had better
never ever
take both of them together.)
9. It makes sense to leave out women who are, or might
become, pregnant.
- No-one wants to put a baby at risk.
- The advice books already say to be extra careful
with these drugs
when there is or might be a baby, so there's no
point learning
what happens in a situation you're already
planning to avoid.
However, it is odd that they would reject a woman
who is not
practicing contraception because she never has sex
with men (or anyone).
If you can trust someone (who is probably suffering
loss of libido
anyway) to take the pill regularly, you can trust
her to abstain.
There many be an interaction between chemical
contraceptive methods
and SSRIs. It would be surprising if there were
not. It would be
desirable, therefore, to have a useful number of
female subjects who
are _not_ using chemical contraception, in order to
be able to detect
such an effect.
If other studies have a sampling bias for women who
are using
chemical contraception, then there's a good chance
that some interactions
are not being recognized.
10. "This study is an 'open-label' study where both you
and the
investigator know what medication and dosage you are
receiving."
I'm not a medical researcher. (I am part of a small
group that is
trying 'data mining' techniques with adverse drug
reaction monitoring
data, but that's because I know a bit about data
mining and a bit
about statistics and personally know the head of the
monitoring team.)
So there may be some good reason for it. But I
can't for the life o
me think what it might be. Since assessment of
depression depends to
a large degree on patient reports, and since the
researchers won't
_see_ the subjects taking all their pills and will
therefore have to
rely on patient reports of conformance, making this
study open-label
seems to me to invalidate it. (What if, for
example, some of the
patients taking 80mg/day of Geodon read up about
Geodon and decide
to take only half a pill each time? Could _easily_
happen.)
It took medical science _decades_ to appreciate the
importance of
double-blind experiments. It sounds as though these
people still
haven't grasped the point.
Put 'open-label' next to 'small sample size' and
'short duration',
and I wouldn't use the results of this study for
toilet paper.
That's the results of one night's hard thinking.
It looks to me as though it is basically a sales ploy to
let Pfizer
sell more Geodon.
I've known quite a few doctors who are lovely human
beings,
humble, kindly, informed, aware of the limits of their
knowledge.
I've also met a few of the other sort, like the one in
the hospital
here who said to me (I am _not_ joking):
"You CAN'T be in pain, you're walking!"
There is a possibility that they are also
using poor unsuspecting people who are getting these drug
combination for free or at the states expense to collect statistics.
That isn't a very good sample either. Poor people are often
depressed due to oppression not depression and are more likely to
have a placebo effect than a really depressed person. This is
especially true when a psychiatric condition is linked to drug use
and also makes them eligible for welfare benefits.
It's like: "Wow, if I take this drug and
it's working I can live in government housing, get food stamps and
Social Security Insurances (welfare benefits.)"
To a person who is depressed due to economic
difficulties or racism, this is sure to lift their spirits. This is
exactly what is going on too. The problem is that when a REAL
depressed person takes these drugs it may kill them or have major
side effects on other aspects of their health.
This is just the beginning. I have other
trials under scrutiny now two. Medical test are yet another issue.
They are literally using the poor to generate their market share
as test
subject. This is what I see going on.

In Washington State US this is what they say on their web:
"More than 28,000 low-income, uninsured patients in Washington
received $5.6 million worth of medicine through Pfizer's Sharing the
Care and Patient Assistance Programs in 2001."
In Texas where a lot of immigrants are and our President is from
they say this:
"More than 183,000 low-income, uninsured patients in Texas received
$40.1 million worth of medicine through Pfizer's Sharing the Care
and Patient Assistance Programs in 2001."
I guess that's because there are more
Hispanics in Texas?
I think we need to discriminated between Oppression and Depression.
Poor people in my community are get their drugs changed every
time a new one comes out. None of them are
educated. They just do what that doctor says. In some cases the
drugs, if already on the market, are paid for by Medicaid.
When these low income people get sick from side effects, their
medical treatment is paid for by welfare--Medicare and Medicaid. So
the advantage of doing this is quite clear. You get a population
without the ability to sue whose medical side effects are covered by
public money. And at the same time can add these people to your
statistics data base of positive results to use in your marketing.
What a scam this is.
It can take a very long time to get the
media involved in a very critical situation, but it's always
worth it in the end.
