The planning committee not only had to prove a "NEED", but also an "Exceptional Circumstance"� before passing this application.� The "NEED" has never been proven and the council nor the planning committee have ever stated what the Exceptional Circumstances are.

It was our own secretary during the very early days of this application, who pointed out to the council that the hedge running parallel with the main site was an Enclosure Hedge protected by an act of parliament and a ditch of Anglo Saxon origin ran alongside that same hedge. It was this group who found out that part of the proposed site which the council were quite willing to give a "Change of Use" to legally, is now subject to an ownership dispute.

Our portfolio now runs into many pages, we have copies of relevant planning guidelines, council structure plans, local plans, letters from the agent of the developer, memos from the council, letters showing a clear conflict of interest with respect to the BROWN FIELD site.� Our fight will continue until this developer is made to upgrade its existing site or moves to the BROWN FIELD site on the edge of town centre.� We as a group are not prepared to allow this Council or the Government, to override Environmental policies in pursuit of their planning targets.�

This group have also asked the council on behalf of the owner of the land within the site, to have Tree Preservation Orders (TPO's) put on the trees bordering this site, we still await their reply.� It has been noted by us and pointed out to the council, that any development allowed as shown on submitted plans, would undermine the root system, thus causing damage to these trees.

We have now included a new quotes page, that will include planning applications made to this council and the reasons for them turning them down and if the applicant has appealed to the DETR.� We think a few more new pages will have to be added.

Ruralists Against Green Erosion was formed by a group of local residents earlier this year, to fight a very contentious planning application in the beautiful Vale of Evesham in Worcestershire, we have been given the support of major National Environmental bodies and also hundreds of residents.

The proposed development is on a
Green Field site on Agricultural grade 2 land, with Archaeological and Historic interests and is outside the Local Development Plan for this area. There are alternatives sites for this proposed development,� they can develop their existing site at a fraction of the cost to themselves and the Environment, there is a Brown Field site available for development, a site which would conform to Government guidelines (PPG's) and Local Structure plans 100%

As a group we have steadily grown stronger over the months, with the support of hundreds of residents and our knowledge of planning issues both Local and National, we now intend to fully exploit that knowledge in our fight to get this development stopped.���

We have maintained from the very beginning, that no "NEED" or "Exceptional Circumstances" had ever been proven, as is required under various structure and planning guidelines for this development.� On the Councils own admission and shown on a planning agenda there are at least thirty reasons why this should not have been given approval.� The existing site, can be upgraded to meet their future requirements, this was stated by a board member in the local press weeks before approval was given! there is also land around the existing site available for this type of development! There was and no doubt still is a Brown Field site available, which would� cost a fraction of the amount they will have to spend, before they are even allowed to develop the
GREEN FIELD site and of course the Environment would be protected, it is this issue, that the Council seem to have lost sight of.�

The proposed site, will necessitate large alterations to a major trunk road� for safety reasons, they will have to provide a cycleway because it is on the edge of town, but it is a fact that the proposed development will encourage car use, how do we know that? well they propose to build a 500 vehicle car park! and who is going to cycle to this site in the winter? The public transport system� is non existent,� it will cause pollution in the form of car, lighting, noise, coaches, late night early morning disturbances to the local residents.

A previous development using the same proposed site, albeit slightly larger, was turned down by this Council on the grounds that "The applicants have failed to demonstrate sufficient recreational NEED to justify the creation of the proposed recreational facility beyond� the developed boundary of Evesham or its adverse impact upon this rural site, it's environs and the southern approach to the town"� This application was using the same land as now, but with additional land for other facilities.� This latest proposal, will have less facilities than before, so how can the council justify a recreational NEED now?���������������
