Defamation

I brought a personal computer system in October-November 2000, for my personal use. A group of people, “unknown” to me, who are total strangers, bugged the system, by installing a covert snooping device, and starting monitoring my system 24 hours a day.

This are the days of global village, the internet. Because of the internet, a scenario of single, virtual global nation evolves. A nation which is advanced in Information Technology (USA) developed many a safeguarding law to protect internet users. For example, hacking a computer system as is being done in my system today (August 2002) gets life imprisonment in USA. But in India, the laws as well as the law-makers are “sleeping”.

In my home, I am not the single user of the system. There is another guy, in my home, a bit older than me, who lives just like any other modern society youth. Whenever he feels bored, he watches sex movies to get a “kick”, just like any modern youth. A modern youth have other stimulating habits like smoking, drinking, drugs, sex etc. which this “good” guy doesn’t have! He doesn’t care about mental training etc. In other words, the time hasn’t ripened for his training. His only reasonable fault is watching those adult movies.

Society has all sort of elements - jealous, envy, greed etc. There is nothing that can be done when a group of people persistently involves in false propaganda, defamation etc. We just let them to continue until they tire themselves out and leave on their own. They waste their own precious time.

Yet there are people fired with jealousy, out to ensure your defamation with the use of spy devices.

There is one observation post (of the many) manned by some young men. Men affiliated with the stalkers, who divert the pornographic parts watched by the other guy as defamatory propaganda with false identity. “Don’t be smart. This is what happens when one is too smart” as one of those jealous young men remark. Sex and vulgar movies which the other guy watches once in a while are attributed to my name, a false propaganda by the hackers.

That is what it is. Even if you don’t deal with others much and mind your own business, in the privacy of your own house, these men and women come with their nasty ways to devise methods to harm you.

Is there a Court or a government or law enforcement in this land which listen to the real life experiences of a victim?

What should be done with such men and women who stay in the shadows and harm you?

But the fastest-growing area for Internet spying is the home.  SpectorSoft, a leading manufacturer of spyware, at first marketed its products to parents and employers.  Sales jumped fivefold, however, when the company changed its pitch to target spouses and romantic partners.  “In just one day of running Spector on my home PC, I was able to identify my fiancé’s true personality,” a testimonial on the company’s website trumpets.  “I found all 17 of his girlfriends.”

 

What can you expect if someone puts SpectorSoft’s Spector 2.2 on your computer?  It will secretly take hundreds of snapshots an hour of every website, chat group and e-mail that appears on your screen, and store them so that the special someone who is spying on you can review them later.  A new product, SpectorSoft’s eBlaster, will send the spy detailed e-mail reports updating your computer activities as often as every 30 minutes.  These products work in stealth mode, so that the people being spied on are totally unaware.

 

SpectorSoft has sold 35,000 copies of its spyware, and it has only a piece of a booming market.  WinWhatWhere, another big player, sells primarily to businesses, but what it calls the “disgruntled spouse” market has been finding WinWhatWhere.  Many smaller companies have sites that sell relatively crude “key-loggers,” software that records every keystroke typed on a computer.

 

Isn’t all this spying on loved ones a little creepy?  Not to SpectorSoft president Doug Fowler.  “If you are in a committed relationship and you get caught because of evidence online, as far as I’m concerned you deserve to be caught,” he says.  Richard Eaton, president of WinWhatWhere, recognizes that in a perfect world users would reveal that they have placed monitoring software on a computer.  But WinWhatWhere Investigator has a feature that allows it to be completely hidden.  “Our customers demanded it,” he says.

Some references on sex, nudity, violence and morality in the Indian context (“official” level ONLY!!). Unlike the West, in India we have a contradiction. The official version or the book version on the way of life or the version “supposed to be” according to the old generation runs contradictory to what is seen in the grass-root level, in daily practice, in the deviant life of the younger generation. NEW DELHI: The Delhi High Court on Tuesday issued a notice to the Centre on a petition seeking to ban films and advertisements depicting sex, nudity and violence and prevent the telecast of fashion shows and beauty contests by TV channels.

Taking cognizance of a Public Interest Litigation (PIL) seeking a direction to the Government to initiate steps to safeguard interests of children, who were adversely affected by the impact of such movies and advertisements shown in cinema halls and on television, a Bench comprising Acting Chief Justice Devinder Gupta and Justice A K Sikri directed the Centre to submit its reply by January 14.

Stating that "children, who are the future helmsmen of the country must be saved from this onslaught on our culture", the PIL by Madhu Mukul Tripathi alleged that the government has allowed the foreign companies controlled TV channels to "open floodgates of sex and nudity in India."

"The policy of screening foreign films has been further liberalised with the hitherto applicable quality check, involving a requirement of furnishing the review report of a foreign movie by established magazines, has been done away with," the PIL claimed.

What about the Sex & Violence on various internet sites which are easily accessible to the young minds in cybercafes and homes? Are they to be considered unpliable? How is the HC going to ban such happenings on the internet? Why only target the TV's?

No more cubicles at cyber cafes

AHMEDABAD: Are you among those who spend hours dating blondes and naughty teens on hot sites on the Net? Well, here is some bad news. The police will keep tab on every site you will visit now on.

 

In a bid to keep Net users under surveillance, amidst reports on the use of the medium by anti-national elements, the city police have issued a notification announcing stringent norms on the use of net at cyber cafes.

 

Not only will your identity be registered, but the details of every site you visit will be recorded on paper too.

 

While Commissioner K R Kaushik has already signed an order banning viewing of all pornographic sites and removal of all cubicles in a cafe, the cafe owners have decided to maintain a record of every site visited by the customer.

 

The order has been drafted under the guidance of additional commissioner of police, Keshav Kumar, along with a group of internet buffs.

 

According to Kumar, “First of all, the cafe owners will have to register themselves with the commissionerate, giving their personal details, identification and particulars of the premises being used for the cafe.”

 

Also, they will be required to give every technical detail, including the softwares being used by them.

 

They would also have to submit undertakings to the effect that they will abide by all the seven acts governing the internet usage and maintain every personal detail about each customer and the sites being visited by them, said Kumar.

 

The customers from now onwards will be allowed access only on producing an identity card, a driving license, a PAN card or a passport.

 

On being asked about the likely violations by the cafe owners, Kumar said, “The onus would lie with the owner of the cafe; he would be answerable for any kind of violation by a surfer if it’s detected at a later stage.”

 

The formalities of the proclamation bind the cafe owners to undertake surveillance on their part too.

 

It also makes it mandatory for them “to alert law enforcing agency in case of any activity of a net user which arouses suspicion” said inspector K J Chandana, who has been assisting in the formulation of the proclamation.

 

The department which hopes to create a full fledged cyber surveillance squad the next few weeks, also proposes a tie-up with the service providers to keep a tab sites being accessed through various cafes of the city.

 

Cyber law consultant and advocate in the Supreme Court, PavanDuggal said, would definitely be an effective step, if it defines liabilities of the cafe owners.”

said, identifying every net user in terms of valid identification is a good step, “but again a lot depends on the extent of enforcement.” added, “The law needs to extended beyond the city limits and even the state boundaries for better results.”

This is a really great news, after all it is not that we are culturally different from the west but it is that we need to have a right fusion preposition to the technological advancements, so that we still maintain the essence of our culture.

Law Breaking

There is always an age-old excuse, “At the time of committing the action, I did not know it was a crime”

1.  If it was a one-shot crime, which occurred only once, that excuse could have been valid, for a layman.

a.  What if the listening post or observation post is an education centre teaching information technology? What if the accomplices are those “teaching” information technology subjects? Can such accomplices say that they are unaware of the nation’s Information Technology Law, IT 2000? I personally doubt, that excuse!

Will that excuse be valid,

1.  if the crime was committed daily

2.  proper channels, people on the street, informing the illegal nature of the crime to the group of violators

3.  the government laws pertaining to the illegal nature were accessed many times through computer hacking of the bugged computer, thus awareness on the illegal nature was available to the violators through reading the hacked material

4. and then the material hits the internet, available freely around the world. Will the predators and stalkers still say they are unaware, in spite of the round-the-clock monitoring?

Bypassing passwords

being hacked with unauthorized entry and altering of content material is getting real and real as days drag on.

Stalkers and predators at different places. A stalking victim, was I, am I. Different places, different people. All through this web-site direct and indirect evidences are spread out about my current as well my previous stalkers/predators. Men and women who try to forcibly impose their fancy desires, without self-respect, honor, dignity, shame, manners etc.

Today, I was “locked up” in a virtual trap, in my own home territory. With advanced devices, they monitor inside out of my life, my residence place etc. Email passwords, website details are all being monitored.

In the event of stalking, the foremost advice is document, document, and document - anything relevant. For we don’t know what can happen tomorrow. Is there really a tomorrow? The Lord only knows! Yet the publication of the indirect evidences is like a time-bomb being displayed to the hackers, the predators, the stalkers. The days of their count-down to justice. Something they look forward to avoid under all costs.

Some options are, to use the passwords obtained through the high-tech bugs as well as the EM emission detection devices, and content modify the web-site. They can modify when I sleep, or don’t use the computer, say between 10:00pm and 07:00am Indian Standard Time. Or even modify immediately after I have uploaded the daily update and logged off from the website.

Some noteworthy points:

Being in a virtual lock-up, with access to internet and personal computer (bugged!), the IP (Internet Protocol) address of this computer from which the web-site is constantly updated is constant, as long as I am here inside the trap, and have not fled from the surroundings.

So any alternating of the contents that can occur can be verified if the login to the web-site occurs from a computer with a different IP address. Such a login proves the existence of the “hidden” stalkers, and thereby their access to the “stolen” passwords.

If the web-site was a single page, I can manage. Any alteration can easily be detected.

Something like ruling a kingdom. Small kingdom, we can manage. The larger and larger, difficult to manage efficiently, unless segmented and trusted allies kept for overseeing or managing.

Hundreds of web pages inside the website, how am I going to know a small alternation at different places, at different files?

One way of facing this scenario, is frequently uploading all the files, onto the website, thereby overwriting any unauthorized altering. But it is not effective, if the predators immediately login and reverse what they want to reverse, or change those parts which they identify as evidences, or add material abusive to the webmaster.

With the use of high technology snooping devices even by ordinary people, it is already mentioned that some concepts like passwords to login are just outdated. What else can I do other than alert some of those relevant agencies like yahoo and Interpol, (In the event of physical harm or danger to the web master of this site/author of these writings; REMEMBER there is a tall and fat man, smoker and beer drinker, who runs an educational institution holding the key information regarding the number of observation posts, the people manning those posts as well as the identity of the men and women predators involved in this illegal trap and use of spy devices) about such a possibility?

Changes that can be done always have a limitation. Beyond my environment, it is up to the relevant people to look into. To understand the threat and change what can be changed.

We can only place our trust in the Lord.

In other words, with the advancement of technology, we just have an inevitable situation: Surveillance. Instead of fighting it, we just have to get used to it. But we have to ensure that we are not manipulated by the monitors. Truthfulness, openness from our side is an answer. They monitor and lay bare our private life. So why don’t we lay bare our private life onto the web, use the web as a guardian, that silently monitors the monitor? Any unwanted manipulation by the monitors gets documented in the web also. Something that can prevent the misuse of surveillance, whether it is from the cops, the law enforcement or even ordinary citizens.

In other words, the monitors play the role of “'accountability partner' to monitor your surfing” or life.

Those who read your web pages or website around the world play the role of “accountability partner” to the monitors!

Why these stalkers and predators don’t go away? After these long a time. Over two years. Why they keep watching me? Should such people be killed? Sometimes, I used to wonder, if only I had a weapon, I could kill them off, for tormenting a stranger in his own house for nothing! They want me to get onto the street, so that they can come forward and pick a quarrel for no reason. Use some of their paid helpers for support. Trying to impose the will of a majority on a cornered man. Trying to push women into the hands of men who don’t need such loose types. The daylight criminals!

They say they haven’t done anything. Merely watching. But who are they? What right they have to monitor a person inside out with all these spy devices and all these expensive investments? Just simply? Or is it because I escaped into the seclusion of my house that they couldn’t do anything so far? What should be done with such men and women who stalk their prey with no restrictions? No manners, whatsoever. No rules, nothing!

So what? Why use such devices on strangers and unsuspecting people? Trying to force others to do what you want to do?

A good ordinary person never touches such devices. Never use them. For he or she minds his or her own business, not forcing themselves into other’s life.

Any man or woman has their own weaknesses. Finding other’s weaknesses, weak-points, is what these predators do.

Who are these people to track others weakness? Other’s personal matters? Isn’t that criminal behavior?

So if it was hard-earned money, then should have spent on something else. Not on spy devices to do covert surveillance! No man or woman, no society accepts covert surveillance from ordinary people. The ones in the front-line (a tip of an ice-berg) are not the law enforcement; don’t even have the court order or permission for tapping.

One of the many observation posts

Observation post 5 – a young man, a young woman and her mother. The woman and her mother are not the stalker and her mother in Observation post 1, BUT a different stalking group.

Three men reveal their presence as accomplices. Two of them financially involved in the funding. One of them has serious repercussions if the evidence hit the internet and reaches the law enforcement indirectly. That man deeply agitated.

Now the number of predators (stalkers and their accomplices) exceed over 10 in number - the young women, their immediate family and accomplices.

All in the process of using illegal EM emission detection devices and other spy and snooping devices to trap men and women.

The Indian Supreme Court ruled this week that wiretapping is a "serious invasion of an individual's privacy" and called for the government to update the century-old Indian Telegraph Act's clause on interception.

The high court ruled that an order for wiretapping can only be issued by the Federal Home Secretary - the most senior official in India's equivalent to the US Department of Justice. In "urgent" cases, this power can be delegated to slightly lower-level officials.

Despite the legal safeguards in the US, there have been growing complaints of the misuse of such covert equipment not only by private individuals, but also by the law enforcement agencies, resulting in a violation or distortion of the rules of natural justice and particularly of the basic constitutional or legal guarantee that no person can be made to incriminate himself by using force or deceitful means.

Sting operations could be mounted only against persons against whom some evidence of criminality already exists and a sting operation is considered necessary for getting conclusive evidence.

Permission for sting operations must be obtained from appropriate courts or the Attorney-General.  This safeguard has been laid down since those who mount a sting operation themselves commit the offences of impersonation, criminal trespass under false pretences and making a person commit an offence.

Some are respectable families, they say. But then, is this the way for seeking alliances? Brothers!! You send someone to the relevant family and ask if they are interested or not. If not interested, then the mission over. (For that the women folk have to be humble. Many present day families live in ego from family positions and wealth. The women live like queens. They only know how to trap, and they have hen-pecked husbands wagging like dogs following each and every wish of those sisters. They want to show off their ugly and arrogant daughters specially prepared as Cleopatras from beauty parlors to trap men. Majority of modern Indian women of “high families”, who live on their parents money (bribery, ill-gotten wealth etc), live in a state of pride. A state of show-off. They need servants to cook, servants to look into any household job, while they indulge in erotic thoughts and deeds. These things of watching stranger’s organ, nakedness etc. is not at all a matter of dishonor to these folks!) What do you see today? Humiliated ones! They spend time and money to trap. To stalk. To force people into submission. They don’t even care if relationship last or not. For divorce condition being very rampant in society, who cares? Just a name of being so and so’s such and such.

From experience it is seen, that there are some predators, who even after a long time, say over two years, still go on, with the reasoning that “We were hunting for such a long time. So it is a disgrace to withdraw. We go forward”. Some went forward to their own humiliation and self-destruction. Pity!

Faced with an unending stream of unrepentant crooks, vagrants and addicts who shrug off short jail terms and scoff at probation, a small number of judges are returning to an old weapon in the war on crime: shame.

 

"The idea is that you are trying to rehabilitate someone, if in no other way than by reminding them and the community what they have done," said Mark Bergstrom, executive director of Pennsylvania's Commission on Sentencing.

 

Pennsylvania gives judges the power to set almost any condition on convicts who are placed on probation, as long as they are "reasonably related to the rehabilitation of the defendant."

Some of the cases have grabbed headlines and won praise, but lawyers and some experts say trying to embarrass someone into reform can be risky.

 

Robert Sadoff, a psychiatry professor at the University of Pennsylvania, said research has shown that prisoners subjected to shaming tactics often react by becoming more violent. Other people punished in humiliating ways can be left embittered and likely to re-offend, he said.

 

"I don't think you can really manufacture remorse," he said. "It has to come from within."

"I remember hearing in the 1980s about judges sentencing drunken driving defendants to work as volunteers in hospital emergency rooms," he said. "It strikes me that shaming somebody like that is on some level an act of revenge ... but it could also be a sign that the judge is saying, 'Can I do something that can turn this person's life around?'"

On stalking

Police forces vary widely in their understanding of stalking and their ability to help protect an individual. This is rapidly improving in many areas. But, no matter how understanding they are, they can't put anyone under a 24-hour guard. The ultimate protection is what each individual can do for themselves.

It is vital to know that there is much you can do to greatly increase your safety. Break out of any isolation. Get support.

A common form of denial is the idea that the stalker is harmless and his activity is just a minor irritation. If you are in a stalking situation, he is not harmless, but neither are you powerless.

Tell everyone that you are being stalked - friends, family, co-workers, your children's school, your regular grocery store - everyone.

If you tell friends and neighbors, you will have one more layer of protection.

Record everything that happens - every phone call, contact or incident. Even if it seems unimportant, write it down. Report it to police.

Protect your personal information. Your full name, phone number and home address are nobody's business except for trusted friends and family. Avoid putting this information on any public documents or official files.

MYTH: He hasn't threatened me, so I'm not in any danger.

The fact there has been no danger up until now does not mean it won't come.

even if he hasn't made such an overtly dangerous statement, any words or behaviors that indicate an unwillingness to let go of his obsession is a red flag to danger. Changing circumstances in the target's life or in the life of the predator could precipitate violent behavior.

just because he doesn't have a criminal record does not mean he is not dangerous. Many infamous stalker/killers had committed no act of criminal violence before the murders they are known for.

every violent offender has to have a first time. Law enforcement personnel are becoming more educated in assessing these risks. Being stalked is itself a warning. Any stalking situation should be regarded as dangerous.

Emails, there may not be any response from the concerned law enforcement due to various reasons – heavy job duties on other more important matters, bureaucracy etc.

Due to some inevitable modifications in the stalking environment, the high pressure and resulting psychological problems, the victim finds unable to frequently update the website, even at least once a week. Only occasional update will be there, due to the associated mental problems - forgetting, lack of material interest, fear and frustration.
