Rules

Restrictions on the use of individual condo units are included in the By-Laws.   These same By-Laws grant the Board of Directors the power to adopt any Rules deemed necessary for the enjoyment of the condominium provided that such Rules shall not be in conflict with the Condominium Act, the declaration, or the By-Laws.  Below are the Rules adopted by the Board of Directors to supplement the By-Laws.

Rules concerning operation

# Rule By-Law Reference
1 Monthly fees ($155) are due on the 1st of every month and considered late if not received after the 15th.  Late payments are subject to a $10 late charge for each month late Para 5.3
2 Unit owners must send 2 copies of keys to the management company if they change the locks to their unit or their storage bin Para 5.8
     
  Suggestion:  Unit owners should notify management if they change their home address, e-mail address, or telephone numbers for home, work, and their unit. Para 5.8
  Suggestion:  Any unit owner selling their unit must contact the management company or have their closing attorney contact management for a Certificate of Good Standing  Para 5.2

Rules concerning use

# Rule By-Law Reference
1 Firewood storage is limited to 1/5 cord on the front deck and 1/5 cord on the rear deck.  More than this amount shall be removed at the owner’s expense and shall be disposed of at the Board’s discretion. 5.7(h)
2 Ashes from woodstoves and fireplaces may remain hot for several days after use.  It is VERY IMPORTANT to deposit all ashes in the cans marked FIREPLACE ASHES ONLY located near the dumpsters. 5.7(b)
3 Parking is prohibited in front of the stairways 5.7(i)
4 No barbequing of any kind is allowed on the porches or near the buildings, only on the lawn areas. 5.7(k)
5 Air Conditioners are allowed:

1.  In the kitchen window

2.  Permanently installed below the kitchen window provided the following conditions are met.  1)  Owner submit a Home Owner Request for Alterations or Improvement Form to the Board prior to approval, 2) Owner locate unit under the window and seal per photos located  under "Frequently Asked Questions "

3.  In one bedroom window provided the following conditions are met.  1)  Owner submit a Home Owner Request for Alterations or Improvement Form to the Board prior to installation, 2) the unit must be occupied by permanent full time residents,  3) the request must contain a doctors note that air conditioning is needed for health reasons of one person, and 4) a second doctors note that air conditioning is to be avoided for health reasons of a second person.  If a unit owners request does not meet these three criteria, it will be disapproved as one of the other two air conditioning alternatives will suffice.

6 Use of front steps (pool side of buildings) is prohibited for any purpose other than as a fire escape route. 5.7(e)
7 Use of snowmobiles is allowed on association property as long as                                        a) Snowmobiles must be on trailers when not being used.
b) These trailers can only be parked between buildings 2 & 3 or at garage end of building 4.
c) Snowmobile access can only be operated, using extreme caution, on the asphalt areas to gain to the snowmobile trails in the area only.

Boards authority to set/amend/enforce rules

Rules are additional stipulations concerning the operation and use of Northface.  The condo documents grant this ability to create and maintain rules to the Board of Directors.  Specifically per the By-Laws;

bullet Para 3.1:  "The Board of Directors shall have the power from time to time to adopt any Rules deemed necessary for the enjoyment of the condominium provided that such Rules shall not be in conflict with the Condominium Act, the declaration, or these By-Laws."
bullet Para 5.9:  "Rules concerning the operation and use of the Common Area may be promulgated and amended by the Board of Directors, provided that such Rules are not contrary to or inconsistent with the Condominium Act, the Declarations or these By-Laws.  Copies of the Rules shall be furnished by the Board of Directors to each Owner prior tot he time when the same shall become effective."
bullet The By-Laws authorize the Board of Directors to take all steps necessary to correct violations at the expense of the unit owner.  Specifically;
bullet Para 3.1 (e). [the Board of directors shall have the power for] making and amending Rules respecting the use and property and enforcement of the provisions of the Declaration, these By-Laws and such Rules, and bringing any proceedings which may be instituted on behalf of the Owners."
bullet Para 5.7:  To assist the Condominium in providing for congenial occupancy and the protection of the value of the Units, it is necessary that the Board of Directors have the right and authority to exercise reasonable controls over the use of the Units.  Violation of the following enumerated prohibitions shall not be permitted, and the Board of Directors is hereby authorized to take all steps necessary to prevent or discontinue any violations thereof, all at the expense of the violator:"
