| This document is a summary of the Lone Gunmen Records Artis Agreement between Lone Gunmen Records and Talent. This summary is not a contract; its purpose is to explain the contract in plain language. The first section involves ownership rights and financial issues. LGR won't sell a band's song(s) for commercial use unless the band authorizes it first, but both LGR and the band will allow the band's music to be played publicly on radio, TV, the Internet, or any other method known now or in the future. While the bands retain ownership of the copyrights of their songs, LGR will own any master recordings that we have paid for. The band will not earn any money from sales until all advance money has been repaid to LGR. After LGR is paid in full, the band will keep the percentage of the money that they are due to earn in the contract. The second section of the contract deals with promotions. It states that LGR is responsible for booking a minimum number of shows in a given period; at the same time, the band must be available to play a minimum number of shows in a given period. It also states that unless there is an extreme emergency, a band must give the label a minimum of 48 hours notice to cancel an appearence. This will give us time to try to find a replacement. The last item in this section says that if you are on an album released by LGR, you must put in an appearance at an official release party or any other event that we stage to release an album. The final section provides for legal protection for both you and us. If you get arrested, we won't bail you out. We also won't be responsible for court costs, lawyers' fees, damages, or any other bills that occur due to you breaking the law, getting arrested, trashing a place, or any other assorted mayhem. If you re-use any of the recordings originally released on LGR, you must acknowledge that we originally released it, and if you sign a deal with another label, our name and logo must appear in a prominent place on the recording. LGR can terminate the contract due to misconduct (legal issues, not showing for gigs or recording sessions, etc.), but we need to give you written warning before we do that. If LGR is ever sold to another company, you will have the right to be cut loose from your contract if you want within the first 30 days of the new ownership taking control. |
