KiLSA Constitution |
(Note: This Constitution was first drafted and at the same time passed in April 1997. Since then, no amendments that have been made so far. It is now a challenge to you -- members of KiLSA for a further review as lots of matters and ambiguous provisions that need to be incorporated and corrected. Further, most of you have not accessed or even read this Constitution, and also those who first drafted it left it with the USPECSA without referring to it. It is important that we display this in your website for you to enforce and review its contents....The Executives should form a taskforce for a Constitutional Review and bring up the amendments following the procedures in this current Constitution. CONSTITUTION
1. Establishment
There shall be within the Emalus Campus of the University of the South Pacific (hereinafter called the University) a Kiribati Law Students Association.
2. Name
The name of the association shall be the Kiribati Law Student Association, abbreviated KiLSA, and hereinafter called 'the Association'.
3. Objectives
| The objects of the Association shall be: | |
| (a) | To promote the general welfare of the members in the University; |
| (b) | To promote the Kiribati traditions and cultures among its members and the Kiribati Community in Vanuatu; |
| (c) | To organise and promote activities of benefits for its members; |
| (d) | To encourage and assist affiliated to USP Emalus Campus Students' Association; |
| (e) | To make representations on behalf of its members to the USP Emalus Campus Students' Association, the Emalus Campus, the University authorities and to any other clubs or societies within the University or outside. |
4. Membership
All Kiribati students in the University shall be members of the Association and shall pay the subscription fee, annually or every semester, as agreed upon the meeting of members from time to time, mainly for the operation and proper maintenance of the Association.
5. Executive Committee
(a) There shall be a President, a Secretary, Treasurer and any other officer thinks fit by members, elected annually at the meeting of members, who shall be the Executive Committee and Officers of the Association, which shall have the power to act on behalf of the Association, and which shall be collectively responsible for all activities carried out in the name of the Association.
(b) The President shall chair all meetings of members and all Executive Committee meetings, and shall generally represent the Association in its dealings with the University and with bodies within or outside the University.
(c) The Secretary shall act for the President in cases where he/she is unable to so act, but his/her main responsibility is to maintain the roll of members preparing agendas for and minutes of meetings of members and Executive Committee for dealing with the correspondence of the Association.
(d) The Treasurer shall keep records of transaction and make annual financial report to the Association. He/She shall more generally be responsible for the funds of the Association.
6. Resignation and Removal From Office
Any member of the Executive Committee wish to resign or be removed the Executive Committee must be notified to convene the meeting of all members for the matter to be discussed and if necessary a replacement be elected.
7. Funds
(a) All funds received for the Association must be deposited in a Pass Book or Bank Account of the Association under the responsibility of the Treasurer.
(b) Withdrawal from such a Pass Book or Bank Account must bear two signatures, one of which shall be that of the Treasurer or President and the other that of either any executive or member authorised under the authority for the operations of the account with the bank.
8. Meetings
(a) The President shall preside at all meetings of Members and meetings of the Executive Committee. In his/her absence the Secretary shall preside. In the absence of both of them the meeting shall elect a Chairperson.
(b) The Meetings of Members may be convened by the Executive Committee on any matters the Executive Committee thinks necessary but there shall be a Meeting of Members during the month of November each year, to submit the annual financial statement and to close the Association's activities for the year. At least a quarter of the members may request for the Meeting of Members on necessary matters or if it is seen that the Executive Committee have been not in action.
(c) The quorum for a Meeting of Members is 25% of the Total members will form form a quorum but 50% of the Total members where the agenda is for the amendment of this Constitution..
9. Affiliation to USP Emalus Students Association
The Association must be affiliated to the University of the South Pacific Emalus Campus Students Association.
10. Amendments to this Constitution
This Constitution may be amended at the Meeting of Members called for that purpose. No amendment shall be made unless a two thirds majority of members present at that meeting vote for the amendment.
11. Enacting Date
This Constitution shall come into effect on the 25th April 1997.
