Notification of Current Legal Position. After two years, WE WON.
Scottish Knight Templars Sovereign Military Order Temple Jerusalem(R)TM. SKT-SMOTJ(c)
The above Patented Trade mark was applied for under the Trademarks Act 1974.
The application by us was to register and protect the usage of our Orders continuing name, Scottish Knight Templars Sovereign Military Order Temple Jerusalem�TM. The Patent Registration was granted by the Intellectual Property Office on the 17th of August 2007.
On 21st of September 2007 Mr Paul McGowan lodged an Invalidity Claim against the registered Trademark. He citing and using evidence from several Websites. These are as follows:
A/ Our own Website of SKT-SMOTJ.
B/ Mr McGowans; Grand Priory of the Knights Templar in Scotland.Self created Order. No connections to us, or to our history.
C/ He also cited the Ordo Supremus Templi Hiersolymitani OSMTH INC USA under Admiral Carey, he using its EEC Registered Patent name as his evidence. The OSMTH USA was proven to the Court to be falsely claiming that the OSMTH USA is a Sovereign Military Order, and recognised as such by the UN. They also claimed on their sites that Supremus in Latin means Sovereign. No, it does not, and evidence submitted by us proved otherwise beyond any doubt. The evidence submitted by me confirmed their registration is in their USA Inc corporate name, and uses Inc at end of its name; its Sovereign Inc name is not legally applicable outwith USA. They have no links to this Order since they left it in 1964 to join Fontes OSMTH. The OSMTH Schism in 1995 as they were the Majority who left Fontes they are now, like our own current Order under our Grand Master Luis Roseira,the only current legal OSMTH, and the OSMTH USA also hold Swiss,and EEC Patents to prove this.
D/ Commandery of Jacque De Molay 1314 OSMTH. We proved no links to this Order.
E/ The Gnostic Templars website. No links
F/ Poor Knights of Christ Temple of Solomon in Scotland under Mr Vince Zubras USA. Self created Order. No Links to us, or to our History.
G/ Militi Temple Scotia. Proven to Court they have never had any links to this continuing Order,or to its history.
H/ Former OSMTH (Regency) Orders under Mr Fontes. Submitted Evidence of Schism in 1995, and Papers ref September 18th in Porto 2008. Proved that there is legally now no longer any OSMTH Regency Orders.
These named website�s along with numerous other written evidence obtained from others in the form of Documentation,formed Mr McGowan�s opposition of Invalidity. He also citing numerous breaches, passing off, in areas of the Trade Marks Act 1974.
The Case was submitted to the Patent Court Examiner for his Final decision. An offer to hold a public hearing in Newport was made first to Mr McGowan by the said Court, he declined the offer to attend.
The conclusion of the Case 16/7/2009 found in favour of James McGrath on all legal matters, and other counts.
All the grounds and submitted evidence for Invalidity etc, made by Mr McGowan failed in its total entirety.
The Rights of the Patent Trade mark continue now in its Registered Format.
Mr McGowan was given twenty eight days leave to Appeal the Courts decision to the Court of Session in Scotland. The Deadline was 13/8/2009, No such appeal was ever made, nor lodged by McGowan.
As there was no appeal made, The Court Decision of 16/7/2009 was implemented by the said High Court recognised as such by the Lord Chancellor as a High Court. Mr McGowan was also ordered by the Court to pay a lump sum of money �900 to Mr J McGrath within Seven Days by 20/8/2009.
A third cheque was received,and this was banked on 22/9/2009, this cheque was cleared by the Bank on 25/9/2009, so payment has been made 36 days late. The first one sent was an invalid cheque made out,and sent in wrong name, this despite clear instructions given to McGowan on Page 19 of 20, Court Papers.The second cheque sent was banked on receipt in good faith by me, and my bank returned it. This clearly stated "payment stopped". I as all will agree had no option left but to call in a Debt Recovery Agency in this matter.
For the record this person has been call blocked by me for many years now, and after more than two more years of vile abuse, and unsolicited threatening emails, time for me to possibly call in the Police ref Harassment and Malicious Communications. I personally do not want to know, or hear from him ever again.He took out the case,and he has to accept that he lost the case.There will be no more post mortems,slanders, libels and lies about me being made on any websites.
Any other named Organisations, or Website/s cited and used in this case by Mr McGowan must with immediate effect cease and desist from using our Registered Trademarks.
Also time to stop trying to pass themselves off as part of us, the Scottish Knight Templars. Or using any part of our recognised format and Patented name, also cease their false claims of any connection to us, our History etc. All should now be deleted. It is a criminal offence,and any further breaches will be prosecuted.

The history of the Scottish Knight Templars in Scotland the (SKT-SMOTJ(c))and the IFA-OCMTH(R)TM and its lineage in the EEC, etc. Our histories are still being researched by our members,and many others associates who like us are also interested in this period of our various Nation's History. We maintain our claims to be the last of the true Knight Templar Order. Our claims based on proven historical facts, not works of fiction. The Sources of all historical facts on our Orders real Christian History are freely available to all serious researchers. These from the National Library of Scotland, National Records Office, Mitchell Library, and Public Libraries, and varied public and private Archives within, and outwith the Realm of Scotland. Also the imfamous and proven Masonic Forgery; "The Charter of Larmenius" dated 1314 confirms our SMOTJ Order's Status as the last of the true Knight Templar Order. It actually names the Scottish Grand Priory under its Grand Master; Robert Bruce, King of Scots, and his Scottish Knight Templars as being expelled by this Masonic forged Charter of Larmenius. We in Scotland have always stated that this Masonic forgery. The Larmenius Document has no legality, nor any credence, and it is accepted by Historians as a proven Forgery. As also has the British National Library in London. They gave it away for nothing to Freemasons Hall in London, this after proving that it was a forged document confirmed as such by their own world renowned experts? All the other 1995 Neo Templar Orders onwards,are just Self Created Corporate Business Orders, "Inc" or "self created Neo Templar OSMTH(Regency)Orders",and all of them are our inferiors with no connections to our Sovereign Military Order of the Temple of Jerusalem.
Basically stated we are an Ecumenical Christian Non Masonic Chivalric Organisation under the Protection and Authority of the Elected Prince Regent M.M. SAE LUIS ROSEIRA, Porto, Portugal, also the Patriarch of Jerusalem, this since the 9/11/2006.
Having told you what we are, let us tell you what we are not.
1. The Order is not associated in any way with Freemasons. we simply note for clarification that we are two totally seperate and distinct Organisations. Each goes its own way.
2. The Order is not associated in any way with any of the 1995 OSMTH onwards self created Orders who call themselves KNIGHTS TEMPLAR. They have no connection to us, no history before they were self created, and have no links to us, our Order, or to the Catholic or Christian Church.
We do not accept ex members of these groups, as even being Christians, never mind Knight Templars. We again point out that it is an immediate expulsion matter for any of our members to even meet with. Or to discuss our Templar Order Affairs with any non members of these Orders. Or to hold meeting with any known Freemasons as the two persons expelled by us on 17th of March 2007 can confirm.
3. The Order is not a "Secret Society", nor is it a threat to the Democratic Process either.
4. The Order does not require members to act in any way contary to their obligation to their Country.Or their Religion.
5. All applicants must be current practising Christians, and Non Masonic. Freemasons or ex Freemasons are barred from ever joining our Orders ranks.
We can state on Vatican Authority,the Orthodox Church's authority that none of these false self created Knight Templar Orders who abuse our Sovereign name, our History, and who are also named as being banned in the Papal Edict of all named Knight Templars Orders. This PAPAL EDICT issued to all Catholic Clergy Worldwide by Cardinal Ratzinger. This was issued when he was the Cardinal, of the Doctrine of the Faith, he is now Pope Benedict XV1. This Papal Edict clearly stating that none of the Knight Templar Orders named,or any claiming to be continuing Knight Templar Orders, will ever be accepted, or recognised by the Catholic Church. A copy of this Templar Papal Edict to the Worldwide Clergy was given to us in January 2007, hence the reason why we had to change our Orders main name,also issue new Brevets to our members in March 17th 2007, this prior to our International World Conference in Edinburgh, May 2007, this name change also goes back to the IFA-OCMTH(R)TM This one given to us by the Catholic Church, it was also used by us in our 1979 Vatican Alliance with three other major Templar Orders. This including our own Sovereign Military Order Temple of Jerusalem SMOTJ name in 1979. This name was used by us in official Vatican discussions in Rome under Canon Johanes Becker. Our Orthodox Church name is, Sovereign Military Order Knights of Christ Temple of Jerusalem. Again any other Brevets dated prior to 17th of March 2007 are just false worthless pieces of paper.
Check it out for yourselves like we did on the Official Vatican website. You cannot be a Catholic, or a Christian, and be a Freemason.
For the people who constantly ask us for information on our Ecumenical Christian Status, we have to remind all that in the 1995/6 period,a member of our current Sovereign Military Order of the Temple of Jerusalem. IFA-OCMTH(R)TM, had our SMOTJ and the now retired Mr Fontes, authority to hold discussions in the Vatican. Also our own Associated Sovereign Military of the Temple of Jerusalem under our own name of the SMOTJ Organisation attended a Papal audience in St Peters Square dressed in their Templar Mantles etc.
The three other Orders including Mr Fontes OSMTH, all failed to meet with the simple set conditions of the Vatican, in especial the immediate expulsion of all known Freemasons. So no recognition by the Vatican was, or ever will be given to them, despite the various false claims made by these Orders. The Grand Council of our own Grand Priors under our Catholic Chef Mondial, and Fontes OSMTH, and others, had authorised meetings to be held with Vatican Officials to gain Papal Recognition. The final meeting was held in Rome in 1979. Four seperate Organisations were present including SMOTJ in its own Sovereign name,under its Grand Master and Chef Mondial, Anton Leprecht Rapp, the Ordo Militiae Crucis Templi, Fontes OSMTH, the OIMT under General Zdrojewski of the Polish Government in exile. Sadly Mr Fontes demanded we all recognise him as Grand Master of the World? All rejected Mr Fontes claim of acceptence by us as Grand Master of the World Templars, he was reminded that he, like his Father was never even elected Prince Regent or Grand Master of his own OSMTH Order. So we formed the IFA-OCMTH. Along with other Autonomous Orders in USA, Wales, England, South Africa, Italy, Australia, Portugal under De Silva,Spain under De Toro Garland. Hence why our name as IFA-OCMTH(R)TM. It is a name known and accepted by the Church.
All know the result of the OSMTH (Regency)elections held on 18th of September 2008, by the OSMTH members, now known as the SMOTJ. Sovereign Magisterial Grand Council Meetings, and the members election results held in Oporto, Portugal. The newly elected 51st PRINCE REGENT of the Order is. PR. M.M. SAE Luis Roseira, Porto, Portugal.
The OSMTH Regency name ceased to be used, as from 18/9/2008 onwards,thus invalidating all Brevets previously held by expelled and false members.Hence why it as OSMTH was made a legally defunct Organisation by us. Neither Mr Fontes Senior, or his son were ever legally elected as Grand Masters, nor elected to Prince Regent Grand Master OSMTH posts as falsely claimed by them both, as unelected persons they legally held no such rank, nor authority. No legal papers as requested by our lawyers, and the Local Civil Authorities in Portugal were ever lodged as proof of Mr Fontes claims in Portugal. Mr Fontes was informed of this position prior to 18/9/2008, by our lawyers, and he was also replaced by his elected and appointed Deputy Luis Roseira. Mr Fontes was retired by us, he is still residing in Spain, due to his age 80 this year,and his current ill health.
The election of a new Grand Prior of Portugal SMOTJ took place in September 2008. This after two years with no meetings ever called, or Services held, and there was no OSMTH members left in Portugal. This after a National Media and Press scandal in Portugal, and Spain naming people who were Fontes senior members as freemasons,named persons involved in fraud, and Fontes staff selling forged OSMTH documents Brevets etc,especially in UK, and Spain etc. Portugal is once again active under its new Grand Prior of Portugal Jose, and its ex OSMTH members, are all now 1705 SMOTJ members. Members who turned up every day in Porto to vote for change. They like us will no longer accept Freemasons, or Non Christians as members within SMOTJ. They will apply the SMOTJ Orders strict Non Masonic rule with immediate effect. The rest of the Worlwide SMOTJ Orders, the various Grand Priories, etc all now under PR. MM. SAE Luis Roseira, have all confirmed they will not accept Freemasons as their members.
We can also confirm that none of the self created Orders of 1995+ the USA OSMTH inc, or the OSMTHU New Orders did as was falsely claimed by these people, ever had a Formal Papal Audience, nor will they ever be recognised by the Vatican, nor officially received by any Vatican Officials either.

5. The Apostle Creed must be adhered to.
These are the five simple conditions the others all failed to accept from the Vatican? Thus creating the Masonic schism, and the founding in 1995/6 of the self created OSMTH Atlantic Obedience, yes the OSMTH inc, Supreme Order of USA under Carey. The withdrawl by their USA senior officers and all members who supported them, was done after they withdrew from his Fontes Organisation in London Meeting in June 1995 for valid monetary reasons. I was also present in London in June sitting with MTS G.P Colin Campbell, and his Chinese wife,(no not our own 1984 Colin Campbell) this as the Chef Mondial, most Senior Templar Officer of SMOTJ, I was also there as a founder member of the Templar Forum London,officially founded in April 1995. Who along with other Grand Priors in UK etc, tried to resolve the above Fontes OSMTH schism. They as OSMTH inc USA, were from 1964 onwards Fontes loyal members for 31 years. They were recognised by Fontes in 1964 as his OSMTH members,they left our Sovereign Military Order Temple of Jerusalem under our Chef Mondial, in 1964 to do so. So they legally ceased to have any right to carry on using our SMOTJ (Sovereign) name, this from 1964.
When King Peter died in 1970. His successor Crown Prince Alexis by Legal Decree withdrew all Royal and Sovereign recognition of them both, Fontes and USA INC, OSMTH Orders, and from many other Orders of St John etc, he passed his Fathers legal claims onto the Vatican recognised SMOM a Papal Order which Crown Prince Alexander is still a senior member of.
Hence why the OSMTH USA do not make any such false Sovereign Order claim now. They still use disclaimers of this Sovereign claim on their current USA websites They do have a Corporate Inc Charter of 1962. However this is only in their Sovereign Military Order Inc business name. Hence why the UN Office in New York registered their Sovereign business Inc name, its their real USA Corporate name. Their registered name elsewhere is as OSMTH only. The Supreme Military Order Temple of Jerusalem. There is no Latin word for Sovereign, despite their numerous, uneducated false sworn statements, and false claims to UN and others that the Latin word Supremus translates into Sovereign. No it does not. Please check it out in a Latin Dictionary for yourself. Supremus translates only as Supreme, or sublime. They can also only use their Corporate Inc name within USA Territories under International Law. So they will really need to delete any such false Sovereign Order claims being made on their websites.

Scotland, and all the SMOTJ Orders in 1995, accepted the Vatican Ecumenical conditions agreed on their behalf by the then OSMTH Secretary General Werner Rind. We as SMOTJ, and IFA-OCMTH(R)TM have enforced the above conditions ever since. We understood from our Vatican contacts in 2005, this agreement was still acceptable to the Vatican. The rest of the other Templar Orders; Fontes Grand Priories of OSMTH, the OSMTH USA etc, OSMTHU could not, and did not accept them. The majority of their members all failing under article four; even now they are still accepting Freemasons, Non Christians as their members.
The IFA-OCMTH(R)TM World Congress Meeting was held in Edinburgh the weekend 11th till 14th of May 2007,and our next International Meeting is in . Rome, in October 2010 will be a Very Historical Meeting for our IFA-OCMTH Order in Italy under Sergio. We were in Germany for talks in September 2006/7/8 and for the Papal Visit there as well, May 2007 Edinburgh the International Chapter General Meeting of the IFA-OCMTH(R)TM as a result as signatories of Charta 2000. We were in writing legally confirmed under said Charta 2000, as being under the Protection, Authority of the Catholic Patriarch of Jerusalem.This confirmed personally in Jerusalem to myself in November 2008 by the Patriarch
We can also confirm that we as the; Scottish Knight Templars Sovereign Military Order Temple Jerusalem(RTM) were in St.Peter's Square on the 24th of April 2005 this for Pope Benedicts First Mass. Dressed in our White Mantles, Regalia. We also as a Templar Ecumenical Christian group in Mantles, Regalia attended the Papal Audience in St Peters Square,on Wednesday the 27th of April 2005, as the Scottish Knight Templars Sovereign Military Order of the Temple of Jerusalem. We were assisted by the Italian Order of; Sovereign Military Order Knights of Christ Temple of Jerusalem. Our thanks to our fellow Sovereign Military Order members from Malta, and the Italian contingment who were a credit to the Order, also to the many Italian and other nations wellwishers in St Peters Square for their support of us as the true Order of Knight Templars. Also whilst in Rome we took the opportunity to call on the Grand Masters of the Papal Orders, Grand Master of the SMOM, and the Grand Master of the KHS.
We were in St Peters Basilica on Thursday the 28th of April 2005. This in our Templar Mantles for Pope Benedict XV1 High Mass after Confession, also to pay our respects, and to lay a wreath inside St. Peter's Basilica, to our Lawful De Facto, De Jure, Stuart Kings who gave up their all for their Religion, and our Country. A Wreath was also laid to our Royal House of Scotland by SMOTJ in July 2007, 2008, Again our thanks to our current elected Chef Mondial, Grand Prior of Scotland, HSE Graham Russell and his family, who were there on official Papal business for us, this related to the Chinon Document and other Templar Documents within the Vatican Secret Archives.
We still await His Holiness response/s to our Order's various recorded delivery letters, the most recent sent in February 2009, these regarding the future of the Scottish Knight Templars with regard to the finding of the Chinon Document which absolves the Knight Templars of any Crime. This Document found in the Vatican Secret Archives by Dr Barbara Frale, it is Signed, sealed by Pope Clement V, and unlike others, we have actually seen the original, held in the Vatican Secret Archives, as we have access to the said Archives. it is also published in a book, on public sale in Italy.
This is also the reason why in 2002, 2005,2008 again in 2009. We had by Formal Decree sent recorded registered post,these legal papers officially placed our: SCOTTISH KNIGHT TEMPLARS. SOVEREIGN MILITARY ORDER OF THE TEMPLE OF JERUSALEM, under the Authority and Protection of His Holiness Pope Benedict XV1. This again on St John's Day 24th of June 2005. This till either he, or his successor/s makes the final decision on the future of the Knight Templars Order. We received a letter in response from the Vatican Secretariat confirming receipt of our letters. We still currently await his, and only his, or his successors decision on this Templar matter.
After a long time, we have an appointed Religious Protector. The Patriarch of Jerusalem, who is also a Cardinal of the Catholic Church, who accepts us via the Church as the Sovereign Military Order of the Temple of Jerusalem, SMOTJ, and as IFA-OCMTH(R)TM the names we use till the final decision is made by his Holiness, or his successor/s. This due to the Official Papal Edict mentioned above, and the contents of the Chinon Document found in the Archives in Rome about the Templar Order being found Not Guilty by His Holiness Clement V. We have also pointed out to the Vatican that historically we are the only Worldwide continuing Sovereign Military Order of the Temple of Jerusalem, and as such are the only true inheritors of the Mantle of the Knight Templar Order.
We remind all that Our Scottish Knight Templars Sovereign Military Order, of the Temple of Jerusalem SMOTJ were put on trial by the Invading English King Edward 1, the Papal Legate, Imperial Notary and Clerk of Pope Clement V, John de Solarius,The Trial was Presided over by Bishop William Lamberton of St. Andrews, it was held on the 15th of December 1309, in the Abbey of Holyrood, and this Sovereign Scottish Knight Templar Order of the Temple of Jerusalem, was after this Papal Trial found; NOT GUILTY by the said Papal Imperial Clerk to Pope Clement V, and by King Edward 1 of England. He even complained at our Scottish Knight Templars being in the field opposing his current invasion of the Realm of Scotland under King Robert the Bruce.
A Historically recorded proven fact in these records,is that the main witnesses who bore false witness against the Scottish Knight Templars; were Sir William St Clair, and his son William. Hence why all the claims of any Masonic Grand Master Templar called St. Clair are proven fictions, deceitful fraudulent lies. Sir William and his family were devout Roman Catholics as we are all since 2008, now being informed by the tour guides when we actually visit Roslin Chapel?
Here again are the five simple conditions the others all failed to accept from the Vatican to gain possible acceptence by the Vatican?

As stated Scotland, all of our OCMTH and SMOTJ Orders alone accepted the Vatican conditions agreed on their behalf by HSE Werner Rind who at that time was under Grand Master Fontes OSMTH, Fontes also declined to accept these conditions. We as the SMOTJ, with the IFA-OCMTH(R)TM alone have enforced the above conditions ever since. We understood from our own Jesuit, and other Vatican contacts in 2005, that this agreement was still acceptable to the Vatican.

Most of our history has come down to us from our many PRESENT and PAST members. This History was gathered over a very long period of time. The information is restricted in usage by us for our own active members use only. This due to the misuse of it, in book formats some years ago, and books of fiction written ever since. So what do these others do when the Truth is printed by us and by any others? they delete it? It is a proven fact that the Scottish Sovereign Military Order of the Temple of Jerusalem did not die, after the death of Jacque de Molay in 1314. Our Christian Order in Scotland has continued albeit in an altered form as Ecumenical Christians, within the Christian Churches. We have evolved since 1128 as Ecumenical Christians from through the 1560's, prior to, and after 1745, and in 1962, onto the present time.
Possibly you like us,from time to time will have read many various unproven claims being made in the Press, or in the many fictional books about Knight Templars? These trying to link us as practising Christians; to Freemasonary, Satanism, and other evil subjects, to us the real Knight Templars? We here and now totally reject, and refute any of these false claims. Roslin Chapel was never even built at the time of the Templars, neither were the St Clairs ever Scottish Knight Templars. We will not, and do not accept any current or past Masonic Templars as members in our Order. They are rejected as being Ungodly by us. This based on the Major Christian Church's decisions, "That Freemasons are not Christians" quote from; General Assembly of The Church of Scotland.

Therefore please take any problems with this Church policy, up with the various Church's, not with us. Nor will we ever again accept application forms from any aspirant who is a member of any: members of a Non Christian Church, or Sect. Or any Proscribed Extremists Organisations, or any others named in our list of Undesirables.
