WILL OF KENNIAN T. WEST

I, Kennian T. West, of the County of Craven and State of North Carolina being of
sound mind and disposing memory do make and declare this my last will and
testament in manner and form following that is to say
First, That my executors hereinafter named shall provide for my body a decent
burial suitable to the wishes of my relations and friends, and pay all funeral
expenses together with my just debts howsoever and to whomsoever owing out of the
monies that may first come into their hands as a part or parcel of my estate.

Item. I give to my nine youngest children, to-wit: Terrence L. West, Wealthy C.
Sutton, Elizabeth A. West, India P. West, James L. West, Franklin N., West,
Sophia A. West, Edward R. West, and Robert L. West as they shall arrive at the
age of twenty-one years or get married one bed, bedstead and furniture each and
fee simple forever.

Item. I give to my eight youngest children, to-wit: Wealthy C. Sutton, Elizabeth
A. West, India P. West, James L. West, Franklin N. West, Sophia A. West, Edward
R. West and Robert L. West, when the youngest shall arrive at the age of twelve
years Five Hundred Dollars in money each in fee simple forever.

Item. I give to my beloved wife Teresa L. West when my youngest child shall
arrive at the age of twelve years if she be then living Five Hundred Dollars in
money in fee simple forever.

Item. I lend unto my beloved wife and my seven youngest children to-wit:
Elizabeth H. (sic) West, India P. West, James L. West, Franklin N. West, Sophia
A. West, Edward R. West, and Robert L. West, all of my real and personal estate
of every kind and description, whatsoever with the understanding that they are
to enjoy so much of the rents, profits, and interests thereof that may accrue
therefrom as may be necessary for their decent support and maintenance in common
until the youngest child shall have arrived at the age of twelve years, and
after the youngest child shall have arrived at the age above mentioned, it is
then my will and desire that all of the estate above named shall be sold, and
the proceeds thereof divided equally between my wife if she should be then
living and all of my children or their legal representatives, to-wit: William
H. West, Bryan C. West, Margaret A. Stevenson, Speight B. West, Terrence L.
West, Wealthy C. Sutton, Elizabeth H. West, India P. West, James L. West,
Franklin N. West, Sophia L. West, Edward R. West, and Robert L. West in fee
simple forever.

It is furthermore my will and desire that if any of my seven youngest children
hereinbefore mentioned shall before the youngest child shall have arrived at
the age of twelve years, marry, he she or they, shall immediately upon his,
her, or their marriage cease to enjoy any of the rents, profits, or interests
accruing from my said estate until the final division between all my children
herein before mentioned shall take place.

And, lastly, I do hereby appoint and constitute my two sons William H. West and
Terrence L. West my lawful executors to all intents and purposes to execute
this my last will and testament according to the true intent and meaning of the
same and every part and clause thereof hereby declaring utterly void all other
wills and testaments by me heretofore made.

In witness whereof I the said Kennian T. West do hereunto set my hand and seal
this the 9th day of September A.D. 1865. Signed K. T. West

Benjamin Sutton administrator of Elizabeth A. Sutton vs William H. West,
ext. Will of Kennian T. West of Craven county written 9 Sept 1865. He
died 1865. Will names nine youngest children of his wife Teresa L. West
as: Terrence L. West exec, Wealthy C. Sutton, Elizabeth A. West (married 1
Nov 1866 Benjamin Sutton and she died Lenoir County on 12 July 1867), India
P. West, james L. West, Franklin N. West; Sophia . West, Edward R. West,
Robert L. West (he age 12 on 9 June 1875). Other children were Bryan C.
West, Margaret A. Stevenson, Speight B. West and William H. West exec who
are by Kennians first wife whose father was Jesse Jackson.

His brother was S.B. West.

Benjamin Sutton, Adm of Elizabeth A. Sutton vs W. H. West, Exec of Kennian T. West
Undertaking on appeal
In Jan. 1877 the plaintiff recovered judgement against the defendant for $500
with interest – the defendant intend to appeal to the NC Supreme Court.

Will of Kennian West was included in the Case and has already appeared in a
previous copy of the Newsletter.

Kennian West died in Craven County in 1865 with a Will – the Testator had four
children – W. H. West, B. C. West, M. A. Stevenson and S. B. West by his first
wife who had received from their grandfather, Jesse Jackson, father of the first
wife about $500 each. All were above 21 years old – when the testator died he
had nine children by his 2nd wife – T. L. West, W. C. Sutton, E. A. West, I. P.
West, J. L. West, F. N. West, S. A. West, E. R. West, and R. L. West, all
minors except T. L. West and W. C. Sutton. Prior to making his Will the
testator had conveyed to said T. L. West a tract of land valued at $1000. No
advancement had been made by said testator to the other children by his 2nd
wife.

The plaintiff had intermarried with Elizabeth A. West daughter of sd Testator
about 1 Nov. 1866. Elizabeth died intestate in Lenoir County about 12 July 1867
and the plaintiff was appointed the Administrator. The plaintiff had demanded
from the defendant the sum of $500 with interest on 9 June 1875 and the defendant
has refused on grounds that Elizabeth A. Sutton died before Robert L. West the
youngest child of sd Kennian T. West arrived at the age of 12 and the legacy was
contingent on the sd Elizabeth living to Robert becoming 12 years of age.
Robert arrived at the age of 12 on 9 June 1875 after the death of Elizabeth.

Judgement found for the plaintiff.

First, a friendly reminder that in a post such as below, it is useful
to tell people where things are posted. I found the Sutton family info at

Third, I would like to contribute some information. On the
"Descendants of Benjamin Sutton" page, William Sutton, son of Benjamin2, is
listed with his two wives Wilmouth Albertson and Wealthy Catherine West.
Within that section, it states "It is not exactly clear on the 1870 Census
who all the people in his household were - his children or siblings." I
would like to clear up who all the people on the 1870 Census were:

William took in some of his siblings when his father died, and Wealthy did
the same. Kinnian Terrance West died Nov. 27, 1865, and his younger
children were distributed among several of the older ones. I do not know
whether Wealthy took in her sister India before or after India married
Benjamin, William's son. India would have been 17 1/2 when Kinnian died.
Interestingly, I have family notes passed to me that indicate Wealthy and
India's sister Elizabeth Adeline West (b. Feb. 4, 1844) married a Benjamin
Sutton. I have no further information on this Elizabeth, although it is
possible that she married Benjamin first, then died, and India married him.
Some day I will pursue that.
Wealthy's sister Sophia is listed as a dittoed Sutton, but is still a West,
as can be seen in the 1880 Census, where she has moved to her half-brother
William Henry West's household.

Notes for KINNIAN TERRANCE WEST:
In an application to the Daughters of the American Revolution by a daughter of Speight Brock West and Sarah Ann Becton, I find the following:
"Book D, page 395 December Term 1865. Will of Kinian T. West of Craven County. Younger children: Terrence L. West, Wealthy C. Sutton, Elizabeth A. West, India P. West, James L. West, Franklin N. West, Sophia A. West, Edward H. West, Robert L. West. Older children: Margaret Ann Stevenson, Speight Brock West, William H. West, Bryan C. West (by marriage to Katie JACKSON) Exec: Terrence L. West, William H. West. Witness: G. W. White, Clerk of the Court, John W. Collins."
A family document provides more information about Kinnian and his family, "from Aunt Sallie - Sarah West Lindsay", who was a daughter of Speight Brock West and a granddaughter of Kinnian:
"Kinnian Terrence West married two times. 1st wife, Katie JACKSON was born May 10, 1810, died March 6, 1835. Kinnian Terrence West was born Sept 6, 1797, died Nov 22, 1865. they had William Henry, born August 23, 1828; Margaret Ann, born Aug. 9, 1830; Bryan Clinton, born Sept. 15, 1832; Speight Brock, born Nov. 15, 1834."
"Kinnian T. West and 2nd. wife Teresa Watson (who was born Mar. 18, 1818), had Priscilla Adeline, born June 29, 1839; Terrence Lafayette, born Jan 26, 1841; Wealthy Catherine, born Dec. 19, 1842; Elizabeth Adeline born Feb. 4, 1845; Indiana Priscilla born Feb. 15, 1847; James Lewis born March 8 1850; Frank Napoleon born Dec. 1, 1852; Sophia Alice born Dec. 27, 1854; Edward Ross born April 8, 1860; Robert Lee born June 8, 1863."
In the Federal Census, Kinnian first appears in 1830 as "Kenyon", three households away from his father Levi. In this Census, Kinnian has one free white male of thirty and under forty (himself - 33), one free white female of twenty and under thirty (wife Katherine - 20), and one free white female of fifteen and under twenty (unknown). Where is William Henry? Perhaps the Census taker simply missed his mark, and it is interesting to note that the "total persons" column, including the five slaves listed, has "9" entered, with a fainter "8" later written before it. Perhaps number nine was William?
In 1840, Kinnian appears as "Kinnion". In free white males, there is one 40-49 (himself - 43), one 10-17 (William Henry - 12), and two 5-9 (Bryan Clinton - 8, and Speight Brock - 6). In free white females, there is one 20-29 (2nd wife Teresa - 22), one 5-9 (Margaret Ann - 9 going on 10), and one under 5 (Priscilla Adeline - 1). Kinnian is a slaveholder with males: two 0-9, one 10-23, one 24-35, one 36-54; and females: two 0-9, three 10-23, and one 36-54. Seven are listed as engaged in agriculture.
The 1850 Federal Census, Craven County, NC, page 373, lists Kinian West, 53 years old, Farmer, as the head of a large household: His wife, Teresa (32 years), Alexander (24 years), William (22 years), Eliza (21 years), Bryan (18 years), Spaight (16 years), Terence (9 years), Catherine (7 years), Elizabeth (6 years), Indiania (3 years), and Nancy (14 years). My research points to Alexander as Kinnian's half-brother, Eliza as Alexander's wife (Elizabeth Daughety), and Nancy as William Henry's wife (Nancy Moye).
By 1860, several children have married and established their own homes. "Kenion T. West" (63 years, farmer with 12000 value of real estate) is listed with his wife Teresa (41, housekeeper), son "Terence" (19, farmer), daughter Wealthy C. (17, seamstress), Elizabeth (15, seamstress), Indiana P. (13), James L. (10), Franklin N. (8), Sophia (3), and Edward R. (2/12).
Kinnian passed away November 27, 1865, and by 1870, the young children had been distributed among the households of several of the older children: William Henry had taken in "Jas. L", "Edward R", and "Robbert". Speight Brock had taken in Franklin N. The household of William Sutton, by then married to Wealthy Catherine West, included India P., married to Benjamin Sutton, and Sophia, who is interestingly listed as a Sutton rather than a West. Some researchers indicate that Elizabeth A. married Benjamin Sutton in November 1866, and this is corroborated by her headstone in the Kinnian West Family Cemetery off highway 55 near Dover, NC ("wife of Benj. Sutton"). Elizabeth died July 12, 1867, and apparently her widowed husband married her sister India.
