The case of New Jersey vs. TLO has arose certain issues concerning student rights in school that has been kept quiet in the previous years. In the Bill of Rights the 4th amendment protects a citizens right of privacy by forcing police to obtain a warrant or probable cause to search a person's property. TLO tried to have the evidence in her purse not shown in the case because the vice principal did not have a warrant to search her purse and that her confession was due to the evidence in the purse, which was not legally seized. This was over ruled because a school official does not need a warrant. The school official just needs "reasonable suspicion that a crime has been or is in the process of being committed or reasonable cause to believe that the search is necessary to maintain school discipline or enforce school policies." Since TLO was suspected of smoking in the bathroom the first search was reasonable and evidence discovered justified a more detailed search. So in school, school officials do not need a warrant, they just need probable cause in order to conduct a search of a students posessions.
