101. Edmund WALLER (10) was born in 1718. (10) Helen's records shows his birthdate as 1713. He served in the military on 8 Dec 1742 in Spotsylvania County, Virginia. As Capt. in the Militia. He died in 1771. He succeeded his father in 1742 as clerk of Spotsylvania County which he held for 9 years and resigned in 1751. At a court held in Spotsylvania County, July 16, 1753, Edmund Waller was "charged with manslaughter or felonius killing and slaying of Thomas Barnes, late of this County, deceased on the Sixth day of this present month (7-6-1753)" for which he had been committed to jail. The Court found the said Edmund Waller guilty of manslaughter of said Thomas Barnes and should "be tried for the supposed fact at the next General Court." The Court also were of opnion "that the prisoner is bailable." John Waller and William Waller paid the bail. The trial records have not been located, but he was believed to have been cleared of the charges as he continued to reside in Spotsylvania County.

on 18 Oct 1740 in Spotsylvania County, Virginia. Mary PENDLETON
was born in 1720. She died in 1808. Edmund WALLER and Mary PENDLETON had the
