TESTAMENT DATIVE of PETER GORDON 11th LAIRD of ABERGELDIE

At Aberzeldie the twenty third day of October In the year One thousand Seven hundred and thirty three, In the presence of
Thomas Gordon Portioner of Crathynaird and John Gordon his son, Judges after mentioned, whereas there was a warrand Directed to the said Thomas and John Gordons from the Commissar of Aberdeen dated the twelfth of October and year foresaid. Proceeding upon a Section and Application made to the said Commissar by Mrs Margaret Fowlis Relict of Peter Gordon of Aberzeldie, For rouping and selling the Corns, horse, Noll, Sheep and other Goods, Pertaining to the said deceast Aberzeldie, And upon the Mains of Aberzeldie, In his hands, at his death, And in and about the manour place of Aberzeldie, and Intimation being made by the said Roup at Several kirks on the Sunday previous thereto, The said Roup was begun, and the Effects put to view, Brought out and Carried by the Persons aftermentioned, at the prices after specified, Viz:

And this Roup is subscribed & attended by the said Thomas Gordon & John Gordon Subscribing and we did also express to Roup the Riding horses, the Labouring Oxen and the bear & Corns which were nor rouped for.

Inventory of the Goods, gear and debts underwritten which pertained and were resting owing to the deceased Peter Gordon of Aberzeldie, the time of his death, who deceast in the month of September in the year One thousand seven hundred and thirty three; Given up by Margaret Fowlis: Relict of the said defunct, and Executrive dative decerned to him, by and before the Commissariat of Aberdeen. Conform to a Decreet of Executory pronounced therearent of the date the Sixth Day of November In the year --- and thirty three -

By virtue of her oath, and under protestation That she have Liberty to add and Eik as afterward & comes to her knowledge That she be no further liable, feel Secundum Vives Inventory That she have allowance and Retention in her own hands, Out of the first and Sums underwritten:

1) Of the defuncts funeral expence, Medicaments on Death bed, Servants fees, maintenance of the family till the next term following his death,
2) And of all the preferable and priviledged debts,
3) And of the expence of this present Confirmation
4) And generally, of all other Charges and Expences the said Executrix has deburst, or may regularly deburse and be pull to, In reference to, or in going about the said Executry any manner of way.


Imprimis the said Executrix (with and under the protestations for said) Gives up, Grants and Confesses, That there pertained and were resting owing to the said PETER GORDON deceast, the time of his death, foresaid, The particular goods, gear, and debts following: Viz:

The Sum of Seven hundred and Seventy Five pound three shilling four pennies Scots, As the price of the whole Sheep, Some Kene(?) and young Stoi (?) pertaining to the said Peter Gordon the time of his death. At which sum they were sold, Conform to the Roup & Sale thereof, Made in the presence of Thomas Gordon Portioner of Crathienaird and John Gordon his Son pledges therein, In virtue of a commission directed to them therearent dated the twelfth of October ---- & thirty three. Proceeding on a Petition and Application from the said Mrs Margaret Fowlis to the Commissariat of Aberdeen. And which roup and Sale is subscribed by the said Thomas and John Gordons and is herewith given in:
 
Item, the sum of Four hundred and Seventy five pounds twelve shilling Scots, as the estimate & worth of the said Peter Gordon of Aberzeldie his riding horses, plough, oxen and some young Stoie on the Mains of Abergeldie,
 
Item, the Sum of Two hundred and fifty pound fifteen shilling Scots, As the Amount of the whole produce of the Main of Aberzeldie in the said Peter Gordons own hand Crops ---- & Thirty three, That Crops being for the most part bad or wrong in the High Country, And to which two Sums last men honed the said Riding horses, Oxen and Grain, & were apprehale by John Bowman in Gowindargue and John Gordon in Balmorall, (on form to the said Warrand from the Commisar, dated the said Twelfth of October ---- and thirty three, directed to them therearent, And then appreciation of the same in consequence thereof, herewith given in:
 
Item, the Sum of Twelve pound Scots, gained by the said Executrix upon her Husbands best horse sold to the Laird of Grants held at ten pound sterling, Tho' by the Apprehation made of him he were only Estimate at Nine pound Sterling.
 
Item, the miln of Balmurell was also in the Defuncts own hand crops ---- and thirty three, the rent whereof was Eighty merks, But there was paid in a certain part of the multure to Abergeldie before he died. To that the said Executrix estimates the remaining Multure for Corns found at the said miln crops --- and thirty three the sum of   (----- ---- Scots 'left blank')
 
Item, the whole free Rent of the Lands and Estate, which pertained to the said Peter Gordon of Abergeldie, after deducting of Stypend and Feu duties, Arose to Three thousand and Forty three pound nine Shilling noo pennies Scots, From which being deducted One thousand merks As Rachel Gordon, Old Lady Abergeldies jointure (?) Anno ---- and thirty three.
 
And, Five hundred merks for the Mains, And Eighty merks for the miln of Balmorall, Both in the said Peter Gordons own hand the foresaid Crops ---- thirty three, the sum of One thousand nine hundred and ninety pound two shilling six pennies Scots, And which sum being divided equally --- the Men (?) and Executor, There remains of rent Crops --- & thirty three To the said deceast Peter Gordon of Aberzeldies Executry the Sum of Nine hundred and ninety five pound one shilling three pennies Scots, And which Sum of Nine hundred and ninety five pound one shilling three pennies Scots, The said Executrix gives up.
 
Item, the Sum of Three hundred & seventy nine pound six shilling Scots, As the worth and price of wood or timber pertaining to the defunct and sold out by him to Country persons, Conforms to ane particular account thereof herewith given in Subscribed by the said Executrix.
 
Item, there also pertained to the said defunct the just & equall two third-parts of the furniture and Domiciles of his house at Aberzeldie, Worth the sum of ----- ----(left blank) or thereby, And which doe yet lye and remain in the said  --- (ripped margin) And they have hither been preserved and Cared for by Executrix, And in case the Samen shall be used by her, --- (ripped margin) be compatible for the true worth of the samen, According as --- (ripped margin) shall be valued and estimate by ane different person, named and appointed by the proper Judge.
 
Item, the Sum of Two hundred and Eighty two pound two shilling two pence Scots of Oldrests (?) and arents for ---- and thirty two and preceedings, resting by the tennents of the Lands of Aberzeldie, Conform to a particular list thereof has given in subserved by the said Executrix.
 
Item, the Sum of  as --- (ripped margin) Hundred & ninety nine pounds fifteen Shilling and eight pence Sterling by severall per---- (ripped margin) upon bills to the said deceast Peter Gordon, Conform to a per--- (ripped margin) account thereof subserved by the said Executrix herewith (ripped margin)



At Aberdeen the Twenty ninth day of November --- (ripped) and thirty five years, In presence of Mr Robert --- (ripped) Commissary of Aberdeen.

The said day the Commissary foresaid confirms the said
Mrs Margaret Fowells relict of the deceast Peter Gordon of Abergeldie Executrix dative to him, Conform to a Decreet of Executive pronounced there arent of the said note above written, Has taken her Oath on the Inventory foresaid, And Received Joseph Gordon in Birkhall, brother german to the said deceast Peter Gordon of Abergeldie, Cautioner for the said Exercise, that the goods, gear and Debts above written as accords of the Law, Conform to abide of Cautioner Subservio by the said Joseph Gordon and the said Exerise of the date the twenty second day of November instant Containing a Clause of Relief.

Inventory and Appreciation of the Following Effects pertaining to Peter Gordon of Aberzeldie Deceast, about the Manour place of Aberzeldie, And upon the Mains of Aberzeldie in the said Peter Gordons own hand at his death, Made by John Bowman in Gowndergue and John Gordon in Balmurrall, In consequence of warrand directed to them from the Commissar of Aberdeen dated the twelfth of October in the year ---- & thirty three, Proceeding on a Petition Given in to the said Commissar by Mrs Margaret Fowlis Relict of the said Peter Gordon of Aberzeldie

Imprimis a bay riding horse being Aberzeldies best horse   = �108.
Item the gray riding horse immediately ill & quite wrong by a sudden
distemper that Renders him almost useless     = �6.
Item the four work horses at �30. each     = �120.
Item Ten Oxen at �19 each      = �190.
Item ane old black bull at        = �19
Item a Cow and a Stirk       = �15.
Item a bull stirk        = �8.
Item the Oxen plough and plough graith     = �5.
Item the horse plough and plough graith & 2 pair harrows with iron lynes = �4.
Item work horses, Holster grouth with currocks, packets & c.   = �-.12s.


Total Sum is Four hundred and Seventy Five pounds and Twelve Shilling Scots = �475.12s.


All which were Estimate and appreciate by us the said John Bowman & John Gordon Unanimously, According to our best skill & Knowledge, and the Sum of whats above Does Extend to Four Hundred and Seventy five pound and twelve shilling Scots, And the said Appreciation was made by us upon the third day of October in the year One thousand Seven hundred and thirty three.

As also wee the said John Bowman & John Gordon Did Consider the grain in the Corn yard & upon the Mains of Aberzeldie, which was in the Lairds own hand and which was put in the barn, All of Crops ---- and thirty three, And after Inspection thereof Wee did unanimously Value & Estimate the Same According to our Knowledge as Follows: Viz:
The Bear with the Fodder at Six pounds Scots the Boll.
Item the Oats with the Fodder, when the said Oats is brought to meal at Eight merks the Boll.

And Wee the said John Bowman and John Gordon Having in November and December Jai by and Thirty three, and in February in the year Jai by and thirty four, Casten the said Grain according as the same was called for, The same Did amount to the Quantities following: Viz:

1733 November - A stack of Oats  = B8 P0 D3.
1733 December - A stack of Oats   = B5 P0 D�

1734 February - A stack of Oats   = B5 P1
1734 February - A stack of Bear   = B7 P0 D�
1734 February - A stack of Oats   = B13 P3
1734 February - A stack of Bear   = B6 P2

Totall Thirteen bolls Two peeks bear & Thirty two bolls three and One halfe Peeks Oats when turned into meall

And the said 13 Bolls 2 Peaks bear at �6# is  �78.15s
And the said 32 Bolls 3� Peaks Oats tuned into meal is  �172.


Totall produce of the Mains the Crops Jai by & thirty three
In the High Country being for the most pairt very bad  =
