Issue # 2
Unlawful identification, and violation of 6th Amendment Right to the Assistance of Council.
Within two or three hours of my unlawful arrest I was fingerprinted, hands swabs, finger nails clipped, saliva swabs taken, and forced to appear in a police identification line-up! against my will and without the aid of requested councel to protect my constitutional rights. And this took place during the early morning hours of December 23, 1981, the second day the State chose to file the criminal complaint against me!... knowing that in the process of this illegal police line-up that the State had no probable cause, and had no! evidence or eye witness to charge me with first degree murder, and at this very same line-up, Charles Edward Purifoy and Willie Wilks, who were victims + witnesses of this alleged crime of robbery and murder, stated in writing that I was NOT!!! the man who committed these crimes.

Proceeding arraignment; ineffective assistance of councel, and a defective criminal complaint.
And just for the record at the time of my unlawful arrest and throughout all legal proceeding of this case I could not! read or write to protect my constitutional rights.
Now at this particular hearing I was being represented by the law office of Alan Eisenberg of Milwaukee Wisconsin and he himself was present in court this day. Now I do not know how my family got him to appear on my behalf at this part of my proceeding!... But I do know that he withdrew! from my case saome time in March of 1982! because my family could not pay him what he wanted, but up until then he was the councel on record.
