Secondary Sources

When searching secondary sources it is important to include such non-primary sources as books, manuscripts, and treatises. Although these items are usually more dated, they can often provide a more pointed analysis/interpretation, which in turn may provide a clearer understanding of IDEA issues. Sabio and Tucson-Pima public library were the main databases searched for books and other IDEA-related documents, using such search terms as "individuals with disabilities education act", "special education law", and "individual education plan".

  • Wrightslaw: Special Education Law by Wright, Peter W.D.; Wright, Pamela Darr. Harbor House Law Press, Hartfield Virginia, 1999. Contains text of key laws and regulations including the Individuals with Disabilities Education Act of 1997 (IDEA), Section 504 of the Rehabilitation Act of 1973, and the Family Educational Records and Privacy Act (FERPA). Features U.S. Supreme Court decisions, caselaw, and analysis and interpretation.
  • Due Process in Special Education : on going to a hearing . Budoff, Milton; Orenstein, Alan; Kervick, Carol. ( UA Main KF4210 .B83 1982). Cambridge, Mass. : Brookline Books, 1984, c1982. Although somewhat dated, contains useful information pertaining to special education law and legislation in United States in a historical aspect, as well as an insightful look at administrative procedure and due process in the United States.
  • The Law of Special Education. Jasper, Margaret C. Dobbs Ferry, N.Y. : Oceana Publications, 2000. Oceana's legal almanac series: Law for the layperson. Includes bibliographical references. A fairly up-to-date look at the historical development of special education, the role of the United States Department of Education and State educational systems. An in-depth report of special education legislation including the Individuals with Disabilities Education Act ("IDEA") and the Family Educational Rights and Privacy Act of 1974. Materials written for ease of understanding by those without a legal education.
  • The Complete IEP Guide : how to advocate for your special ed. child. Siegel, Lawrence. Berkeley, CA : Nolo Press, 1999. (UA Law Reference KF4209.3.Z9 S57 1999.) A useful source for parents/guardians needing legal information on Individual Eduaction Plans / special education and the law and legislation and the surrounding issues. Provides useful and pertinant legal information on dispute resolution in IEP planning, and parental advocacy rights regarding special education. The 2000 version is currently on order.
  • Inclusive Schooling : national and international perspectives . Vitello, Stanley J.; Mithaug, Dennis E. (UA Main LC1201 .I54 1998). The Rutgers invitational symposium on education series. Mahwah, N.J. : L. Erlbaum Associates, 1998. A collection of writings on various subjects pertaining to inclusive schooling in special education, including the legal aslpects of inclusion and parent advocacy/participation in special education/inclusion reform.
  • The Least Restrictive Environment : its origins and interpretations in special education. Crockett, Jean B.; Kauffman, James M. (UA Main LC1201 .C76 1999 ). Series: LEA series on special education and disability. Mahwah, N.J. ; London : L. Erlbaum Associates, 1999. Focuses on issues involving Least Restrictive Environment for disabled students, including: history of LRE, placement of disabled students and political issues surrounding it, social context as it pertains to LRE in educational environments, parental viewpoints and their effects on disabled students' placement so as to ensure full participation, and current legal trends in LRE and their implications.
  • A Practical Guide to Federal Special Education Law : understanding and implementing PL 94-142 . Jones, Philip R. (UA Main KF4210 .J67). New York : Holt, Rinehart and Winston, c1981. A somewhat dated guide to federal law and legislation pertaining to special education for disabled children. Contains a useful bibliography with some historical references.

  • Special education : a summary of legal requirements, terms, and trends by Daugherty, Richard F. (UA Main KF4209.3 .D38 2001). Westport, CT: Bergin and Garvey 2001. Covers landmark cases, IDEA, section 504, ADA, Title I, Full inclusion, private schools and residential placement, due process hearings, legal strategies, special section 504 issues, student records, federal laws and guidelines as well as further useful information in appendices. contains a listing of cases cited and an index. A very useful book for those needing information on a number of subjects surrounding the issues.
  • A legal overview of the IDEA's stay-put provision . Wenkart, Ronald D. (UA Law KF4210.Z9 W46 1998 ). Series: Individuals with disabilities education law report. Special report ; no. 20. Horsham, Pa.] : LRP Publications [c1998]. Fairly current report of the legal issues pertaining to the Individuals with Disabilities Education Act. Covers such issues as the legal status and rights to education of disabled children. In particular covers the issue of removal from school of disabled students for various reasons including discipline, and outlines the exact provisions of the law, including rights of appeal.

National Association of State Directors of Special Education (U.S.) Washington : the Association, [1976?]. This set of 56 slides w/ cassete and script sounds like a useful tool for understanding Public Law 94-142, the Education for All Handicapped Children Act of 1975, and how it was historically expected to affect individualized educational programs for these children.
