The following are the General TERMS AND CONDITIONS governing advertising on Endless Winter Snow.

*****TERMS AND CONDITIONS*****

1. Endless Winter Snow Rates for advertisments 2008 -2009 are effective beginning November 1 2008 . Announcement of any change in rates will be made 30 days in advance of which such rates will be applicable. Rates valid until May 31 2009

2. Endless Winter Snow may reject or cancel any advertising for any reason at any time ( With Cause)

3. Advertisers may not cancel orders for,or make changes in, advertising after five business days( On-line five days ) placement.

4. Endless Winter Snow is not responsible for errors or omissions in any advertising materials provided by the advertiser or its agency (including errors or for changes ).

5.Payments are due within 30 days from the billing date. Endless Winter Snow reserves the right to change the payment terms to cash, at any time. All Advertising that is pre-paid recieves a 10% reduction,with the exception of Holiday rates.

6. All advertisements are accepted and published On Endless Winter Snow upon the representation by the agency and advertiser that they are authorized to publish the entire contents and subject matter thereof and that such publication (or availability) will not violate any law or infringe upon any right of any party. In consideration of advertisements, the advertiser and agency will, jointly and severally, indemnify, defend and hold Endless Winter Snow harmless from and against any and all losses and expenses (including, without limitation, attorney?s fees) arising out of the placement of such advertisements on Endless Winter Snow, including, without limitation, those arising from claims or suits for defamation, copyright or trademark infringement, misappropriation, violation of privacy or publicity, or from any and all similar claims now known or hereafter devised or created.

7. It is understood that the advertiser and agency are jointly and severally liable for payment of all invoices for advertising published on Endless Winter Snow. In consideration of acceptance of, any advertising on Endless Winter Snow, the agency and advertiser agree not to make promotional reference to Endless Winter Snow in any way without prior written permission of Endless Winter Snow in each instance.

8. No conditions, printed or otherwise, appearing on contracts, orders or copy instructions which conflict with, vary, or add to these terms and conditions or the provisions of Endless Winter Snow ,will be binding. Endless Winter Snow has the right to insert the advertising anywhere specified "*"( the index page, right vertical margin ) on Endless Winter Snow at its discretion. Any condition on contracts, orders or copy instructions involving the placement of advertising within Endless Winter Snow (such as page location, competitive separation) will be treated as a positioning request, ( Preferred Position ) and cannot be guaranteed with every advertiser or advertisers' authorized representative. Endless Winter Snow, inability or failure to comply with any such condition shall not relieve the agency or advertiser of the obligation to pay for the advertising.

9. Endless Winter Snow shall not be subject to any liability whatsoever for any failure to establish, or maintain because of work stoppages, accidents, fires, acts of God, acts of war, lightning strikes ,or any other circumstances not within the direct control of Endless Winter Snow.Additionally,Endless Winter Snow shall not be subject to any liability whatsoever in the event of an Earthquake regarded as Major along the San Andreas Fault in Northern California, ...Just in case.

10. Endless Winter Snow will make every attempt to resolve issues to a fair and satisfactory conclusion for the advertiser or advertisers' authorized representative and "Keep It Real".

11. Endless Winter Snow abides by the Rules, Regulations of The State of California.If any of these provisions ( One through Eleven) or sections are deemed invalid, the remaining provisions including advertising specifics listed below on this page, and teh above sections will continue to prevail with Full Force and Effect.

a. Preferred Position / Positioning Request: Any guaranteed position agreed to in writing, add 10%,Subject to availability ( grooming ).
b. Size: Single add Space standard Unit:
       ( 120 pixels Width x 90 pixels Height )max ;One column inch.(Approximate)
c. All ads will be submitted in .jpg or .gif format to Endless Winter Snow.
d. Advertising placement;

Location will specifically be on the right vertical column margin ( Except Single day landing page add, and is limited in size by the fixed column width without exemption. A single advertisement (single Base-unit ) placement of (120 pixels wide x 90 pixels height )
Endless Winter Snow reserves the right to reject any advertisement that may be considered offensive in nature, for any reason, without restriction. Endless Winter Snow reserves the right to limit the quantity and volume of advertising to preserve ascetic presence, ( grooming )Neither of us desires a banner farm.
e. All trademarks,logos and copyrights appearing on Endless Winter Snow are owned by their respective owners,partnerships corps,LLP's, artists or individuals.
f. I agree to make every reasonable effort to "Do the Right thing".
g. Each and every advertiser or its authorized agency or representative agrees to:
