Stallion Breeding Contract
Breeder agrees to provide suitable facilities for the care and feed of the mare/foal while in custody at the rate of $5.00 per day. This is not to be construed as a long-term (beyond breeding activities) boarding agreement.
Breeder will exercise judgement consistent with recognized standards in care and supervision of mare and/or foal. Breeder asssumes responsibility for arranging veterinarian and farrier services as necessary. Mare Owner will be notified first and give approval for such services and agrees to pay for them.
The mare shall be in a healthy and sound breeding condition, free from infectious, contagious or transmissible diseases. Copies of a current negative Coggins Test, registration papers (both sides), proof of shots/worming, and a negative culture must accompany the mare and be given to the Breeder for their records. Breeder reserves the right to refuse the mare if not in satisfactory condition. If mare is refused, the booking fee will constitute liquidated damages.
Breeder agrees to diligently try to settle mare: however if mare fails to settle, for any reason, Mare Owner will hold Breeder blameness. Mare Owner agrees to give Breeder ample opportunity to settle mare.
This Contract contains a "Live Foal Guarantee." A live foal is described as a newborn foal which stands and nurses without assistance. If foal is born dead, there are return privileges for the next breeding season only if Breeder is notified within 7 days and receives a veterinarian's statement confirming death. If after being pronounced "safe in foal" the mare should miscarry, abort or prove barren after leaving the Breeder's premises, Mare Owner has the privilege to return her for breeding during the current or following calendar year.
A "Breeder's Certificate" will be issued for the foal, conceived by this mating, when:

when the mare has produced a live foal by this mating, and
a mare-with-foal photograph is provided for the stallion's records.

It is further agreed that should the stallion die or become unfit for service prior to settling the mare, the breeding and booking fees will be refunded. If it has been paid in full or if mare dies or becomes unfit to breed before being pronounced safe in foal, the Breeder may either:

refund $100.00 breeding fee if already paid in full, thereby canceling this entire Contract.
This Contract will be interpreted and enforced under the laws of the Commonwealth of Pennsylvania. If any clause is this Contract is against the law, then that clause shall be null and void.
This Contract represents the entire agreement between the parties. Any changes must be jointly initialed.
