S T A L L I O N B R E E D I N G C O N T R A C T This STALLION BREEDING CONTRACT for this year's breeding season is between Jack & Patti Powell (Breeder) and ______________________________(Mare Owner). Mare Owner agrees to breed the mare _____________________________________,\ Reg. No. _____________________, to the stallion REIGN CREEK'S CALL TO ARMS, American Quarter Pony Association P-4413, and Half-Welsh H3464, for the fee of $200.00 (breeding + booking fee), for a live foal, subject to the following conditions: 1. The stallion fee includes a non-refundable booking fee of $50.00, payable with this contract, the balance of which must be paid with all other expenses when mare is picked up. 2. Breeder agrees to provide suitable facilities for the care and feed of the mare/foal while in custody at the rate of $5.00 per day. This is not to be construed as a long-term (beyond breeding activities) boarding agreement. 3. Breeder will exercise judgment consistent with recognized standards in care and supervision of mare and/or foal. Breeder assumes responsibility for arranging veterinarian and farrier services as necessary. Mare Owner will be notified first and give approval for such services and agrees to pay for them. 4. The mare shall be in a healthy and sound breeding condition, free from infectious, contagious or transmissible diseases. Copies of a current negative Coggins Test, registration papers (both sides), proof of shoots/worming, and a negative culture must accompany the mare and be given to the Breeder for their records. Breeder reserves the right to refuse mare if not in satisfactory condition. If mare is refused, the booking fee will constitute liquidated damages. 5. Breeder agrees to diligently try to settle mare: however if mare fails to settle, for any reason, Mare Owner will hold Breeder blameless. Mare Owner agrees to give Breeder ample opportunity to settle mare. 6. This Contract contains a Live Foal Guarantee. A live foal is described as a newborn foal which stands and nurses without assistance. If foal is born dead, there are return privileges for the next breeding season only if Breeder is notified within 7 days and receives a veterinarian’s statement confirming death. If after being pronounced safe-in-foal the mare should miscarry, abort or prove barren after leaving the Breeder's Premises, Mare Owner has the privilege to return her for breeding during the current or following calendar year. 7. A Breeder's Certificate will be issued for the foal, conceived by this mating, when: a) stallion fee and all other expenses have been paid in full, b) when the mare has produced a live foal by this mating, and c) a mare-with-foal photograph is provided for the stallion’s records. 8. Both parties agree that the Breeder is not for death, sickness and/or accident including consequential damages caused to the mare and/or foal unless by the willful and wanton negligence of the Breeder; and the Mare Owner is not liable for the same caused to the stallion. 9. It is further agreed that should the stallion die or become unfit for service prior to settling the mare, the breeding and booking fees will be refunded. If it has been paid in full or if mare dies or becomes unfit to breed before being pronounced save-in-foal, the Breeder may either: a) accept another mare according to paragraph 4, as a replacement, or b) refund $100.00 (breeding fee) if it has already been paid in full thereby canceling this entire Contract. 10. This Contract is non-assignable and non-transferable. 11. This Contract will be interpreted and enforced under the laws of the Commonwealth of Pennsylvania. If any clauses in this Contract is against the law, then that clause shall be null and void. 12. This Contract represents the entire agreement between the parties. Any changes must be jointly initialed.
