CONSTITUTION
AND
BY-LAWS
PREAMBLE
We,
the students behind the Computer Engineering Students’ Society
(CoESS), University of the East chapter, ask the help of the
Almighty, in order to build an organization that shall strive and
function as a uniting force among the Computer Engineering Students
by providing technological knowledge and enhancing leadership skills
among members so that they would become assets of the University
and of the society.
ARTICLE
I
NAME AND DOMICILE
SECTION
1. The name of the organization shall be the Computer Engineering
Students’ Society (CoESS).
SECTION
2. This organization shall hold office at the College of Engineering
Building at the University of the East, Caloocan Campus.
SECTION
3. The organization shall adopt its official logo.
ARTICLE
II
OBJECTIVES
SECTION
1. The organization is a non-political, non-religious and non-profitable.
SECTION 2. The general objective of the organization is to develop
camaraderie among Computer Engineering Students in the University.
SECTION 3. To be the voice of Computer Engineering Students.
SECTION 4. To provide more technological knowledge through co-curricular
activities.
SECTION 5. To enhance leadership skills through extra-curricular
activities.
SECTION 6. To be always of help to the society and to the University
we belong.
ARTICLE
III
MEMBERSHIP
SECTION
1. A bona fide student of the Department of Computer Engineering
can be a member of organization.
SECTION 2. A membership fee which shall be set by atleast the
majority of the Executive Body and approved by the adviser shall
be collected from each member upon registration. This fee shall
be non-refundable.
SECTION 3. An identification card will be issued to each bona
fide member of organization to be signed by the President and
the Adviser of the organization.
SECTION 4. Members in the organization shall be voluntary, personal
and non- transferable and shall extend up to only one (1) curriculum
year, but shall be lost if the student is expelled from the organization,
dismissed from the University, or withdraws his/her membership.
SECTION 5. A member can withdraw his/her membership if he/she
changes his/her major during the curriculum year.
ARTICLE
IV
RIGHTS AND PRIVILEGES
SECTION
1. All members shall have the right to:
Carry the name of the organization; Participate in all activities
undertaken and voice out his/her opinions, suggestions and recommendations;
Use the facilities and services offered, enjoy all other benefits
given by the Organization; Place a primary importance on his/her
responsibilities and duties; Withdraw his/her membership provided
he/she does so in writing; Submit questions/complaints to the adviser
if not satisfied with the decision/action of the officers of the
organization.
SECTION 2. All members who actively participated during the curriculum
year shall have the additional right to: Propose amendments
to any provision of the constitution or the laws; Hold any of the
positions provided for by the constitution; Have access to information
and records on matters concerning the member’s welfare.
ARTICLE
V
DUTIES AND OBLIGATIONS
SECTION
1. All members shall have the duty to: Exercise his/her rights
responsibly; Uphold, honor and defend the constitution and by-laws
of the organization; Abide by the rules and regulation or policies
approved by the organization; Meet the financial obligations
and other duties and responsibilities that may be required for
them; Perform all duties and all responsibilities entrusted
to him/her by the organization with utmost honesty and sincerity
and with the best his/her ability; Give his/her suggestions
and his/her talents for the improvement and development of the
organization; Take good care of all the properties of the organization;
Attend and be punctual in all regular and special meetings,
activities of the organization; Participate in all activities
planned by the organization.
ARTICLE
VI
ADVISER(S)
SECTION
1. Senior Adviser: He/she must be a regular faculty member of
the Computer Engineering Department. He/she will be recommended
to the Computer Engineering Chairperson by the Executive Body
of the organization. He/she will assume office for one (1) curriculum
year and shall take full action concerning disciplinary action,
suspension imposed on the Executive Officers.
SECTION 2. A Junior adviser, which must be a faculty member of
the Computer Engineering Department, may be recommended through
the discretion of the Executive Body and the Senior Adviser.
SECTION 3. The appointed Junior Adviser will assume office for
one (1) curriculum year and may be recommended in the same position
in the next curriculum year by the Executive Body.
ARTICLE
VII
GOVERNING
BODIES
SECTION
1. The Assembly The Assembly shall be composed of all accredited
members of the organization. The Assembly shall have the sole
power to elect the members of the Executive Body. The Assembly
shall convene yearly in a general meeting, which will be held
at any place and time designated by the Executive Officers.
SECTION 2. The Officers The officers shall be composed of elected
Executive Officers and appointed Chairmen and Co-Chairmen of
the permanent committees.
ARTICLE
VIII
PERMANENT
COMMITTEES
SECTION
1. The Permanent Committees shall consist: Research and Development
Committee. Education Committee. Human Resources Committee. Grievances
and Information Committee. Sports Committee. Ways and Means Committee.
SECTION 2. Each Committee shall have a Chairman and a Co-Chairman,
which shall be appointed by the Executive Body.
SECTION 3. The members of the organization shall have the right
to choose from any of these permanent committees stated in Section
1 of this Article.
SECTION 4. Each committee shall meet upon call of its Chairman.
SECTION 5. A majority of the members of a committee shall constitute
a quorum.
ARTICLE
IX
COMMITTEE
ON ELECTION
SECTION
1. The Committee on Election shall: Be composed of three (3)
members of the organization from any year level. Be appointed
by the Executive Officers. Take charge for the preparation for
the election of the members of the Executive Body. Verify the
qualifications of the candidates for the election of officers.
Settle election disputes such as election frauds and occurrence
of equal number of votes within twenty-four (24) hours after
the day of the election. Count the votes cast and proclaim the
duly elected Executive Officers.
SECTION 2. The members of the committee will choose a chairperson.
SECTION 3. The decision of the Committee on Election shall be
final, executory and biding upon all.

ELECTION
SECTION
1. The election of the Executive Officers shall be held annually
on the second week of the month of February.
ARTICLE
XI
THE EXECUTIVE OFFICERS
SECTION
1. Number of Officers - Subject to this constitution, the organization
shall be managed by the Executive Officers which will be composed
of fourteen (14) members, all of whom are to be elected by the
assembly for a term of one (1) year.
SECTION 2. Election and Term of Officers - The Executive Officers
shall be elected by the assembly through secret ballot. They
shall hold office for one (1) curriculum year or until their
successors shall have been elected and qualified.
SECTION 3. Vacancies - In case of vacancy due to resignation
or any other cause, of any of the officers, the Executive Officers
are empowered and authorized to designate successors from among
the qualified members of the organization.
SECTION 4. The newly elected and qualified set of Executive
Officers shall meet within one (1) week immediately following
the annual election and shall continue to hold office meeting
regularly after the term of the current set of officers. However,
special sessions may be called by the President or two-thirds
(2/3) of the members of the Executive Body.
ARTICLE
XII
MEETINGS
SECTION
1. The executive officers shall hold regular meetings every
last Monday of the month.
SECTION 2. The President or the two-thirds (2/3) of the member
of the Executive Body can call special sessions any time.
ARTICLE
XIII
POWERS
AND DUTIES
OF THE EXECUTIVE OFFICERS
SECTION
1. The Executive President - Acts as the President of the organization,
supervises the activities of the permanent committees, gives
advise and will be the one to handle committee who lacks competent
members. He/she will be elected by the members of the
organization. He/she must be a Senior Computer Engineering Student
and must have atleast one (1) year service as a member of the
organization.
SECTION 2. The Executive Vice-Presidents – [Internal Affair]
He/she will handle matters within the university concerning
the whole organization. In the absence of the Executive President,
he/she will act as the President. He/she can handle committee
assigned by the Executive Officers. [External Affairs] He/she
will be the representative of the organization concerning external
matters. He/she can handle committee assigned by the Executive
Officers. He/she will be elected by the members of the organization.
He/she must be a Senior Computer Engineering Student and must
have atleast one (1) year service as a member of the organization.
SECTION 3. The Executive Secretary - He/she will handle matters
concerning the whole organization in the absence of the President
and Vice-Presidents. He/she will keep records and important
documents concerning the organization and will announce meetings
set by the President or one of the Vice Presidents or two-thirds
(2/3) of the members of the Executive Body. He/she can handle
committee assigned by the Executive Officers. He/she may appoint
his/her under-secretary with the approval of the President.
He/she will be elected by the members of the organization. He/she
must be a Senior Computer Engineering Student and must have
atleast one (1) year service as a member of the organization.
SECTION 4. The Executive Treasurer - He/she shall be the official
custodian of funds of the organization and it shall be his/her
primary duty to keep all funds in the bank chosen by the Executive
Body. He/she shall be responsible for the prompt collection
of all fees and contributions as authorized by the Executive
President, provided however, that the original receipts and
the supporting documents shall be kept part of the records.
He/she will be elected by the members of the organization. He/she
must be a Senior Computer Engineering Student and must have
atleast one (1) year service as a member of the organization.
SECTION 5. The Executive Auditor - He/she shall be responsible
for auditing the financial statements of the organization. He/she
examines and verifies reports and financial statements and duly
certifies the correctness of the Treasurer's report before submitting
it to the Executive Body. He/she performs other duties and functions
that may be assigned by the Executive Officers. He/she will
be elected by the members of the organization. He/she must be
a Senior/Junior Computer Engineering Student and must have atleast
one (1) year service as a member of the organization.
SECTION 6. The Executive Business Manager - He/she shall handle
the fund raising projects of the organization, program the budgetary
requirements of the organization and make the necessary budgetary
preparations and coordination with the committee chairman for
the activities of the organization. He/she can handle committees
assigned by the Executive Officers. He/she will be elected by
the members of the organization. He/she must be a Senior/Junior
Computer Engineering Student and must have atleast one (1) year
service as a member of the organization.
SECTION 7. The Executive Press Relations Officer (PRO) - He/she
shall handle matters related to the information regarding the
activities of the organization. He/she shall keep the members
of the organization informed of its all activities and meetings.
He/she be responsible in giving proper and due publicity to
the activities of the organization. He/she shall perform other
duties inherent in the position and exercise other functions
as may be assigned by the President. He/she will be elected
by the members of the organization. He/she must be a Senior
Computer Engineering Student and must have atleast one (1) year
service as a member of the organization.
SECTION 8. The Representatives - There shall be four (4) representatives
of the organization which shall be elected from each year level.
Each representative shall be responsible in voicing problems,
complaints, suggestions and other matters which concerns the
welfare of the Computer Engineering Students. He/she must have
atleast one (1) year service as member of the organization.
ARTICLE
XIV
EXPULSION AND SUSPENSION
SECTION
1. Any Officer of this organization may be expelled from the
office through impeachment by the majority of the Executive
Body or undergo suspension or any sanction imposed by the Executive
Body and Adviser through the following basis: Unable to perform
his/her duties and obligations regarding his position in the
organization. For using the name of the organization without
the permission of the Executive Body. Violation of internal
rules and regulations set by the Executive Body within the organization.
Violation of the Constitution.
SECTION 2. Any member may be expelled in the organization or
suspended or any sanction imposed by the Executive Body and
Adviser through the following basis: Unable to perform his duties
given by the Officers of the organization. Violation of internal
rules and regulations set by the Executive Body within the organization.
Violation of the constitution. For using the name of the organization
without the permission of the Executive Body.
SECTION 3. No Officer and member shall be expelled or suspended
without due process.
ARTICLE
XV
FINANCIAL
MATTER
SECTION
1. The Organization fund coming from membership fees or other
funds will be submitted to the Executive Body and be held by
the Executive Treasurer.
SECTION 2. All funds and money of the organization shall be
deposited in savings account in the name of the Organization:
SECTION 3. All withdrawals from the said savings shall be with
the joint signatures of the Executive President and the Executive
Treasurer.
SECTION 4. No expenditures from the funds of the Organization
shall be made without the approval of the Executive Body.
SECTION 5. All such expenditures shall be covered by vouchers
containing the recommendations of the Treasurer and the approval
of the President.
ARTICLE
XVI QUORUM
SECTION
1. Majority of members of the organization shall constitute
a quorum for the assembly. In its absence, all business done
or discussed shall be unofficial and shall be subject to a referendum
to be approved.
SECTION 2. Majority or two-thirds (2/3) of the members of the
Executive Body shall constitute a quorum to transact business,
hold meetings and other matters.
