Last Will Testament of
Hannah Pearson Laycock.
This is the last Will and Testament of me, HANNAH LAYCOCK, of Sydney, in the Colony of New South Wales, widow. First I direct the payment of all and singular, my just debts, funeral and all the testamentary expenses and particularly the balance of purchase money due by me to His Majesty's Government, on the purchase of one hundred acres of land situate at Putty by my Executors, hereinafter named, as soon as conveniently may be, after my decease out of my personal estate And it is my desire that my funeral may be conducted in a respectable manner and that a vault may be constructed for myself and for such members of my family, as may wish to be interred therein and that all unnecessary expenses be avoided. I give and devise unto my son, SAMUEL LAYCOCK, my messuage and premises situate in Pitt Street, Sydney, numbered 30, with the ......... thereto belonging. I hold the same unto my said son, SAMUEL LAYCOCK, and his assigns for the term of his natural life and from and immediately after his decease I give and devise the same unto and equally between my grandchildren hereinafter named, that is to say, the children of my late daughter, SARAH BAYLY deceased, namely, AUGUSTA the wife of Andrew Allan Esq., CAROLINE BAYLY and SARAH BAYLY, share and share alike as tenants in common and to this several respective heirs and assigns and in case any of my said granddaughters shall depart this life before the said intended devise shall take effect, without having lawful issue, it is my will that their of her equal share of my said estate shall go to her sisters or sister, as the case may be. But in case they or either of them shall leave issue their or her share to their or her issue and to their heirs, such issue taking the mothers share, and in all respects standing in her place. And I hereby do give and devise my said messages and premises accordingly. I give and devise unto my son, WILLIAM LAYCOCK, my message and premises situate in Pitt Street, Sydney, aforesaid number 31. To hold the same unto my said son, WM. LAYCOCK, and his assigns for the term of his natural life and from and immediately after his decease I give and devise the last mentioned premises unto my daughter ELIZABETH PITT, widow, to hold same unto her, my said daughter and her assigns for the term of her natural life and from and immediately after her decease I give and devise the said last mentioned premises unto and equally between and amongst all and every the child and children of my said daughter by Thomas Matcham Pitt, her late husband, as well as daughters and sons, share and share alike as tenants in common and to their several and respective heirs absolutely and forever. I give and devise unto my son, SAMUEL LAYCOCK, one hundred acres of land situate Putty in the said Colony and also one thousand acres of land lately purchased or agreed to be purchased by me off His Majesty's Government situate at or near the same place. To hold the said two parcels of land unto my said son, SAMUEL LAYCOCK, and his assigns for the term of his natural life and from and immediately after his decease I give and devise the said two parcels of land unto my grandson THOMAS WILLIAM EBER BUNKER LAYCOCK, son of my late son Captain Thomas Laycock deceased, and to his heirs and assigns absolutely and forever. I give devise and bequeath unto my grandson, HENRY BAYLY as a reward for his attention to me, my house and premises situate in Pitt Street aforesaid some time since purchased by me off Thomas ........... To hold the same unto the said Henry Bayly his executors, administrators and assigns according to the nature of my estate and therein absolutely and forever. I give devise and bequeath unto my granddaughter, Eliza Pitt, my house and premises situate in Pitt Street aforesaid now occupied by one Petiet, a chainmaker, and also a family Bible, a gold watch, the whole of my plate, linen and china and also the looking glass now in my sitting room together with the whole of my clothes and wearing apparel, the chest of drawers and the boxes containing the same, also any trinkets of every description and the pictures in my sitting room, including my profile likeness. To hold the message and personal effects unto my said granddaughter, Eliza Pitt, and to her heirs, executors, administrators and assigns according to the nature of my estate therein absolutely and forever. I give and bequeath unto my granddaughter, the said AUGUSTA (nee Bayly) the wife of the said Andrew Allan the sum of one hundred pound sterling, but which sum as well as all other sums of money, effects or things by me given or bequeathed to the said Augusta Allan, to her children. I do hereby instruct my executors to secure her and them respectively in such a way as to prevent the same from coming into the hands or forming any part of the estate of the said Andrew Allan, or being in any way made liable to his debts or engagements. I give and bequeath all and singular the cattle and horses which I shall be possessed of or entitled to at the time of my decease unto and equally between my sons, the said Samuel and William Laycock, and my grandchildren the said, Henry Bayly, George Bayly, Edward Bayly, Nicholas Paget Bayly, Charles Bayly, Augusta, the wife of said Andrew Allan, the said Caroline Bayly, the said Sarah Bayly, George Matcham Pitt, William Pitt, Robert Pitt, Mary Matcham Pitt, the said Eliza Pitt, the said Thomas W E B Laycock, John Connell Laycock and Eliza Pearson Laycock, share and share alike. I give and bequeath to each of my great grandchildren the children of my said granddaughter Augusta Allan their share of ten pound sterling. I give and bequeath unto Mrs. (Geo. Blaskett the miniature painting of her late sister Mrs. Laycock (Isabella) formerly Bunker, the wife of my late son Thomas Laycock deceased. I give and bequest unto my daughter, Elizabeth Pitt the miniature painting of my said late son Thomas Laycock, also the dressing glass in my bedroom with the smallest of my two family bibles. I give devise and bequeath all the rest, residual and remainder of my real and personal estate whatsoever and wheresoever the same may be unto and equally between my sons, Samuel Laycock and William Laycock and my said daughter Elizabeth Pitt share and share alike in tenants in common and to their several and respective heirs, executors, administrators and assigns according to the nature of my estate therein absolutely and forever.
I nominate, constitute and appoint Mr. Daniel Cooper of Sydney aforesaid, merchant and Mr. Daniel Dursons of the same place, Gentleman, executors of this my will. And I do hereby revoke all forms and other wills by me at any time heretofore made and do declare this only to contain my last Will and Testament. In witness whereof I have hereunto set my hand and Seal this fourteenth day of April one thousand eight hundred and thirty one.
