STUDY GUIDE: Israeli Military Orders in Use in Adjacent Palestinian Occupied Territories

I. ISRAELI LAWS LEGALIZING DISCRIMINATION & EXPLOITATION - sample set of laws used by the Israeli military in the adjacent occupied Paletinian territories that legalize discrimination, oppression and exploitation of Palestinian Arabs living there.

  • A. The Israeli military has been given the role by the Israeli government to govern the Arab areas within Israel (upto 1966), and then the Occupied Territories occupied in the 1967 war. They do so through the passage of 'Military Orders', through which they then oppress and exploit the local Palestinian population. The impacts of these military orders on the occupied territories violate significant numbers of International Laws (details - please see Study Guide on International Law). Their impact can be identified in 5 categories:

    1) Actual Annexation of East Jerusalem and the Golan Heights into Israel itself (more details & quotes);
    2) Creating de facto annexation in the other areas of the occupied territories by creating a separate set of governing, judicial and security systems for the Israeli settlements often tied to Israel (more details & quotes);
    3) Replacing local Arab institutions (Jordanian in the West Bank, Egyptian in Gaza) of government, judiciary and security with Israeli military committees or committees completely controlled by the military, over which local residents have no democratic say(more details & quotes);
    4) Creating a web of permits and licenses which control every aspect of the Palestinian economy. Studies have shown that this system of permits have then been used to manipulate the Palestinian economy to the benefit of Israel (more details & quotes);
    5) Uses other methods to constrict Palestinian society that are oppressive and exploitive (more details & quotes) --
    • (a) Building a web of Israeli settlements, by-pass roads (for Israeli-use-only), military zones, wilderness preserves, and a Security Fence/Wall throughout the territories isolating and/or splitting up Palestinian communities separating families, cutting off workers from their jobs, farmers from their fields, students from their schools, patients from medical care, etc. which seriously undermines Palestinian society and economy.
    • (d) Installing a system of military checkpoints throughout occupied Palestine which further limits movement in inhumane ways (because of the way the Israeli military manages them), thus further strangling the economy and social life of Palestinian society;
    • (e) Destroying or closing Palestinian civil infrastructure such as walls, bridges, and roads or by building ditches around neighborhoods or business centers which further inhibit movement and isolate Palestinian population centers and strangles the economy;
    • (f) Destroying Palestinian economic assets such as office buildings, and port and airport facilities, orchards, and factories which further strangles the Palestinian economy and social movement;
    • (g) Destroying Palestinian security facilities such as police stations and jails so that they cannot fulfill peace agreements, or enforce their own laws;
    • (h) Enforcing the law in inhumane ways such as imprisonment without charges or trial, deportations, home and business demolition, area closures, beatings and torture, assassinating rebel leaders. Often many of these measures are implemented on a massive level.
