I, Ralph Yarnell, of Malta Township, Morgan County, Ohio, being of full age, sound mind and memory and under no restraint, do publish this my Last Will and Testament, revoking all other Wills by me heretofore made.

ITEM I. I direct that my just debts and funeral expenses be paid out of my estate as soon as practicable after the time of my decease.

ITEM II. I give, and devise to my son, Thelbren A. Yarnell, my eight-nine (89) acre farm situated in Malta Township. This devise to Thelbren A. Yarnell is made upon the condition and said real estate is charged with this condition, that said Thelbren A. Yarnell shall pay to each of my children, Ida Lucille Perry, Frank Donol Yarnell and Lloyd W. Yarnell, a sum equal to one-fourth of the appraised value of said real estate as appraised in the inventory of my estate filed in the Probate Court. Should any of my children predecease me, leaving child or children, said surviving child or children shall receive the share of the deceased parent as if the deceased parent would have survived me. Such payment by Thelbren A. Yarnell shall be made within ninety days of the time of the filing of said inventory, or this item shall lapse and Item III shall be given full force and effect.

ITEM III. I give, devise and bequeath all the remainder of my estate to my children, absolutely and in fee simple, share and share alike. Should any of my children predecease me, leaving child or children, said surviving child or children shall take the share of the deceased parent would have survived me.

ITEM IV. I nominate and appoint Thelbren A. Yarnell executor of this my Last Will and Testament and require that no bond be given by him, hereby granting to him as such Executor, full power and authority to sell and convey all or any part of my estate, real, personal or mixed, upon such terms and at such prices as he my deem proper and without obtaining any order of Court therefor. I also grant to him full power and authority in the settlement of my estate to compromise, compound, adjust and settle any and all debts and liabilities due to or from my estate for such sums and upon such terms and conditions and in such manner as my Executor shall deem best. In the event that my son, Thelbren A. Yarnell, shall for any reason fail to qualify or having qualified, fails to complete the administration of my estate, I nominate and appoint my daughter, Ida Lucille Perry, in his stead, giving to her all rights and powers set forth in this Item.

IN WITNESS WHEREOF, I have hereunto set my hand to this my Last Will and Testament, this 14th day of February, 1961.

The foregoing instrument was subscribed, published and declared by Ralph Yarnell as and for his Last Will and Testament, in our presence and in the presence of each of us and we, at the same time, at his request, in his presence and in the presence of each other, hereunto subscribe our names as attesting witnesses this 14th day of February, 1961.
