Legal Matters

To  avoid difficulties later on you should be aware of all the legalities surrounding issues such as marriage documentation, second marriages, changing names and legal age of marriage. All this is covered here in our Legal Matters Link.

General Rules

The Federal Marriage Act (1961) provides certain guidelines for marriage such as the minimum age at which one can marry, who may officiate, legal documentation, how much notice is required....... The general rule is that you can marry as long as you are a certain age, not closely related and are not married. The marriage service must be conducted in front of an authorised minister of religion or civil celebrant, and two witnesses over the age of 18 must be present.

Minimum Age

  • If you are both over 18 no parental consent is required.

  • A girl aged 16 or 17 needs written consent from her parents or legal guardian.

  • A boy aged 16 or 17 needs written consent from her parents or legal guardian and permission from a judge or magistrate.

  • A girl aged between 14 or 16 requires permission from a judge or magistrate.

Marrying Relatives

The law does not allow you do marry a direct relative. ie. mother, father, daughter, son, sister or brother.

If you have been Married Before

If either of you has been married before and are now divorced or widowed, you are required to produce documents to prove you are no longer married. The documents need to be shown to the person officiating your marriage before the wedding.

Legal Documentation

  • A Notice of Intended Marriage form must be lodged with your celebrant within 6 months of your intended wedding date.

  • A couple of weeks before the wedding a Declaration of Marriage must be completed to confirm there is no reason for the marriage not to take place.

  • After the service your signatures are requires on your Wedding Certificate, the celebrants record book, and a form to be lodged with the Registrar of Births, Deaths and Marriages.
