Article I Name and Purpose


Section 1. NAME: The name of the Committee is the Shasta County Democratic Central Committee. Hereafter called SCDCC.

Section 2. PURPOSE:

A. To promote the ideals and purposes of the Democratic Party of the State Of California.

B. To elect Democrats to Federal, State and other offices consistent with the by-laws of the State Democratic Central Committee.

C. To carry on the general business of the Democratic Party in Shasta County.

D. To raise funds and to act on other matters pursuant to the purposes of the Democratic Party.

Article II Membership

Section 1. MEMBERS

A. The members of SCDCC shall be elected as described in the California Election Code at the primary general election every even year.

B. Elected members are all members elected to the SCDCC in the primary and shall have all voting rights.

C. Ex-officio members are democratic candidates or office holders in Congress, State Senate or Assembly and shall have all voting rights

Section 2. ALTERNATES

A. Members of the SCDCC shall appoint two alternates who will vote if the elected member is absent.

B. Ex-officio members shall also appoint alternates in case of their Absence or may appoint a permanent alternate to represent them.

Section 3. QUALIFICATIONS

A. All members of SCDCC shall be registered Democrats in the Supervisorial district they represent.

B All elected, appointed or alternate members shall reside in Shasta County Alternates for Ex-officio members shall be registered Democrats and reside in Shasta County.

Section 4. DUES

A. All members of SCDCC shall pay annual dues as determined by SCDCC
B. Dues shall be delinquent if not paid within 30 days of the organizational meeting or appointment.

Section 5. OBLIGATIONS OF MEMBERSHIP

A. To attend meetings of the SCDCC.

B. To pay membership dues promptly.

C. To actively support and promote the stated purpose of the SCDCC.

D. To abide by the by-laws of the SCDCC and the California State Democratic Party.

Section 6. REMOVAL FROM MEMBERSHIP

A. Members may be removed from office if during their term they affiliate with or publicly advocates that the voters should not vote for the nominee of the Democratic Party for any office or who publicly gives support to or avows a preference for a candidate or opposes a candidate nominated by the Democratic Party or endorsed by the California State Democratic Party.

B. The SCDCC shall remove any member, other than an ex-officio member who misses more than three consecutive regularly called meetings, unless their absence is excused for illness or absence from the County at the date of the meeting.

C. The SCDCC may remove any member if he or she misses twelve (l2) or more regularly scheduled meetings of the SCDCC, regardless if said absences are excused.

D. The Chair of the SCDCC shall investigate any charges of behavior described in Section 3 of this article. If substantiated, the Chair shall send to the accused member by timely registered mail: a copy of the statement of charges and a letter stating that the accused member may either resign or have a hearing before the members of the SCDCC, that at such hearing, the accused member shall be afforded an opportunity to respond to the statement of charges and to confront the witnesses against such member, and that such member may be represented at his/her own expense at such meeting.

If the accused member does not resign, the Chair of the SCDCC shall schedule a hearing before the SCDCC. The Chair shall send a copy of the statement of charges to all members of the SCDCC along with a notice of the time, date and location of the hearing no less than ten (10) days prior to the scheduled hearing.

At the hearing the members of the SCDCC shall examine the statement of charges brought against the accused member. The accused member shall be afforded an opportunity to respond to the charges, to confront any witnesses, and be represented at his/her own expense if desired. Such hearings shall be conducted in such a fashion as to afford the accused member due process of law. The hearing shall be held in closed session attended only by the Elected and Ex-officio (or their designees) Members of the SCDCC. At the conclusion of said hearing, upon motion for removal, the accused member may be removes by a vote of not less than two-thirds (2/3) of the members present and voting.

Section 7. VACANCIES

A. A vacancy on the SCDCC shall exist in the eve t any member dies, Becomes incapacitated to act, or is removed from membership pursuant to Section 6 of this article, or moves from the County State or District.

B. Vacancies shall be filled by a majority vote of the SCDCC upon the recommendation of the members from the supervisorial district where the vacancy occurs.

Article III Executive Board

Section 1. MEMBERS

A. The Executive Board of the SCDCC is comprised of the following Officers:

1. A Chairperson
2. A Vice-Chairman
3. A Secretary
4. A Treasurer
5. A Parliamentarian
6. Two members-at large

Section 2. CHAIRMAN

A. The Chairman of the SCDCC is the Chair of the Executive Board.

Article IV Officers

Section 1. GENERAL

A. The officers of this committee shall be a Chair, Vice Chair, Secretary Treasurer, Parliamentarian and two (2) Members-at-Large.

Section 2. ELECTION AND TERM OF OFFICE

A. The outgoing chair shall preside over the election of the incoming chair.

B. The new Chair shall preside over the election of all other officers. If the Outgoing Chair is not available, or is nominated to repeat a term as Chair, Then the next highest ranking officer shall preside over the election of the incoming Chair.

C. The elected officers shall serve until the next re-organizational meeting.

D. If a vacancy occurs, an election to fill the office shall be held at the next Regular meeting of the SCDCC, after the announcement of said vacancy to the SCDCC.

Section 3. DUTIES

A. CHAIR

1. To Chair all regular and Executive Board meetings.
2. To be the official spokesperson for the Democratic Party in Shasta County.
3. To call any special meetings of the SCDCC at the discretion of the Chair, or upon the request of five (5) or more committee members.
4. To direct the planning of the meetings and other conferences or meetings sponsored by the SCDCC.
5. To sign contracts and other documents connected with the business of SCDCC.
6. To make an annual report in June of the SCDCC.
7. To appoint committee chairpersons as needed.
8. To establish needed committees.
9. To perform other duties as required by the office.
B. VICE-CHAIR

1. To perform the duties if the Chair in his/her/absence or disability.
2. To assist the Chair in the planning and administration of the activities of the SCDCC.
3. To perform other duties as required by the Chair.
C. SECRETARY

1. To record and distribute the meetings and agendas of the SCDCC both regular special and executive board meetings.
2. Maintain records for:
a. Notices
b. Attendance
c. Correspondence
d. Oath
D. TREASURER

1. Shall be in charge of all funds of the SCDCC and shall disburse them according to the actions of the SCDCC.
2. Shall collect the dues of all members.
3. Shall maintain a record of all receipts receivable and payable.
4. Shall submit a report at all regular and executive board meetings.
5. Shall submit an annual budget at the first meeting after the reorganization meeting.
6. Shall prepare and submit reports to the FPPC and FEC as required.
7. Shall perform other duties as required that pertain to the office.
E. PARLIAMENTARIAN

1. Shall advise the Chair on Roberts� Rules of Order and Procedure.

F. MEMBER-AT-LARGE

1. Shall attend all meetings of the Executive Board of the SCDCC.

Article V Re-Organization

Section 1. RE-ORGANIZATION

A. Re-organization of the SCDCC shall take place at the July meeting in an even numbered year after the June primary.

B. Following the swearing in of the elected members and ex-officio Members or their designated permanent alternates, members may make Recommendations to the SCDCC for appointments to the SCDCC for vacancies in their Supervisorial District according to Article 11, Section7.

C An election of officers will be held at this meeting.

Section 2. STATE PARTY DELEGATES

A. Delegates to the State Democratic Central Committee shall be elected at December meeting according to the California State Party by-laws.

B. One person from the state delegates shall be elected to the California State Executive Board of the State Central Committee.

Article VI Committees

Section 1. STANDING COMMITTEES

A. The Chair shall appoint such standing committees as deemed necessary.

B. Standing Committees currently are:
1. By-Laws
2. Registration
3. Club Chartering
4. Headquarters
5. Volunteers
6. Public Relations
7. Finance

Section 2. SPECIAL COMMITTEES

A. Special committees such as fairs, dinners, fund raisers etc. shall be appointed as needed.

B. The Chair shall appoint the Chairman of all special committees.

Section 3. REQUIREMENTS OF ALL COMMITTEES

A. Members of Standing Committees shall serve a term of two years from Re-organizational meeting to re-organizational meeting.

C. Members of Special Committees shall serve for the time as needed.

D. All Committees shall put their respective policies and procedures in writing and submit them to the Chair.

Article VII Meetings

Section 1. MEETINGS

A. Regular meetings of the SCDCC shall be held monthly.

B. Special meetings of the SCDCC may be called by the Chair, or upon request of five (5) or more members.

Section 2. NOTIFICATION

A. Members of the SCDCC shall be notified of all meetings at least five (5) Days prior to the meeting with the exception of an emergency meeting.

Section 3. QUORUM

A. One third (l/3) of the SCDCC shall constitute a quorum.

Section 4. VOTING

A. Members or alternates must be present to vote.

Article VIII Amendments

Section 1. PROPOSAL

A. Amendments to these By-laws may be initiated by any two (2) SCDCC Members, proposed and presented to the By-laws committee.

Section 2. NOTIFICATION

A. A copy of the proposed amendments shall be sent to each member of the SCDCC prior to the next meeting. First reading will be at the next regular meeting and a vote will be taken at the regular meeting.

Section 3. ADOPTION

A. All amendments to these By-laws must be adopted by a two thirds (213) Vote of the SCDCC members present at a regular meeting after the second reading.

Section 4. EFFECTIVE DATE

A. An amendment to these By-laws shall become effective upon its Adoption, unless otherwise provided for in the amendment.

Article IX Chartered Clubs

Section 1. USE OF PARTY NAME

A. Only Chartered Democratic Clubs may use the name of the Democratic Party within the Shasta County. This section shall not apply to organizations that are official parts of the California Democratic Party or the Democratic National Committee, or that have been authorized to use the name of the Democratic Party pursuant to the California Elections Code. Only the SCDCC may represent itself as the Shasta County Democratic Party. SCDCC letterhead and stationary shall only be used for official SCDCC business.

Section 2. NON-ENDORSEMNT OF NON-DEMOCRATS

A. Chartered Democratic organizations shall not politically affiliate with any other political party nor endorse, nor otherwise publicly support by fundraising or publicity, candidates who are not members of the Democratic Party.

Section 3. ELIGIBLITY

A. Any Democratic organization (Club) shall be eligible to apply for a Charter from the SCDCC upon submission of:

a. A membership roster of at least fifteen (l 5) persons who are Registered Democrats or who have declared their intention to register as Democrats upon becoming eligible to vote.
b. A current list of officers.
c. A copy of its current By-laws.
d. A check for annual dues of $24.
e. Minutes of most recent meeting.

B. The Club Chartering committee shall review the application for Chartering and upon approval submit it to the full SCDCC for approval upon a majority vote.

Section 4. RENEWAL OF CHARTER

A. Each chartered club shall submit to the SCDCC on an annual basis Information contained in Article IX, Section 3.

B. Upon receiving this information the Club Chartering shall review the Information and submit it to the SCDCC for renewal of the Charter.

Section 5. SUSPENSION OR REVOCATION OF CHARTER

A. The SCDCC may, by a majority vote, suspend or revoke the charter of Any charters club at any time for violation of Article IX, Sections 1,2, and 3 of these By-laws.

Article X Endorsements

Section 1. ELIGIBILITY

A. Only registered Democrats shall be eligible for endorsement.

Section 2. EXCLUSIVITY

B. Endorsement of candidates for non-partisan office whose jurisdiction does not extend beyond Shasta County lines shall be the exclusive responsibility of the SCDCC.

Section 3. RULES

A. A Central Committee or any of its members can only endorse publicly endorsed candidates for State and Federal office.

B. PRESIDENT OF THE UNITED STATES

The State Central Committee of the California Democratic Party, Democratic County Central Committees, and all official units of the California Democratic Party shall not endorse any candidate for delegate to the Democratic National Convention and shall not endorse candidates for President of the United States until the Democratic National Convention has been held.

Individual members of the organizational units identified in subsection (a) of this section are in no way precluded from endorsing delegates to the Democratic National Convention nor a candidate for the Democratic Presidential nomination. The Party office of members making such an endorsement may be indicated in that endorsement for identification purposes only.

C. Only Democratic candidates for nomination to partisan public office who have been endorsed in accordance with the foregoing provisions shall be deemed official candidates of the California Democratic Party and be entitled to the privileges and benefits associated therewith.

D. To assure the effectiveness of the Democratic Party�s endorsing process, The State Central Committee is committed to the principle that the Democratic Party as an organization shall speak with one voice with respect to the endorsement of candidates for nomination to partisan public office. It is also committed to the principle that The State Central Committee�s endorsement process shall be broadly and fairly representative of the various components of the Party. Any official unit of the California Democratic Party or any County Central Committee which renders an independent, unauthorized endorsement of a candidate for partisan public office shall forfeit its right to representation on the State Central Committee and the privileges and benefits which may be attached thereto for a period of 12 months from the time it renders such an endorsement, or the remainder of the term of the Current State Central Committee whichever is longer.

Article Xl Parliamentary Procedure

Section 1. PROCEDURE

A. On all matters of procedure not covered by the provisions of these By-laws Robert�s Rules of Order, latest edition, shall be the official guide.

Article Xll General Policies

Section 1. OPEN MEETINGS

A. All public meetings of the SCDCC shall be open to all members of The Democratic Party regardless of race, color, creed, national origin, sex, age, religion, ethnic identity, sexual orientation, persons with disabilities as defined by the Americans with Disabilities Act of 1990, or economic status.

Section 2. ANTI-DISCRIMINATION POLICY

A. The SCDCC shall not acquiesce in, condone or support discrimination On the grounds of race, color, creed, national origin, sex, age, religion, ethnic identity, sexual orientation, persons with disabilities as defined by the American with Disabilities Act of 1990, or economic status.

Section 3. PROMOTING DIVERSITY

A. The SCDCC shall support the broadest possible registration of voters without discrimination on the grounds of race, color, creed, national origin, sex, age, religion, ethnic identity, sexual orientation, persons with disabilities as defined by the Americans with Disabilities Act of 1990, or economic status.

Article XIII Dedication and Dissolution

Section 1. DEDICATION

A. The property of the SCDCC is irrevocably dedicated to public Purposes and no part of the net income or assets of the SCDCC shall ever inure to the benefit of any director, manager, officer or member thereof, or to the benefit of any private persons.

Section 2. DISSOLUTION

A. On the dissolution of the SCDCC or its headquarters, its assets Remaining after payment of, or provision for payment of, all debts and liabilities of the SCDCC shall be donated to the California Democratic Party.

Certification of Adoption

The above By-Laws were amended by the Shasta County Democratic Central Committee at the _Democratic Headquarters___located in the City of ___Redding_______and County of __Shasta___________.
