Israel Military Order No. 1039 Concerning Planting Fruitful Trees (Amendment)
In accordance with the authority vested in me, and in my capacity as commander of the Israeli Military Forces in the region and because I believe that this Order is necessary for the welfare of the residents, and with the intention of preserving the water resources and the agricultural product of this region for the general benefit, I hereby order the following:
- Change of Name
1. In the Order Concerning the Planting of Fruitful Trees (Judea and Samaria)(Order No. 1015) for the year 5742-1982, wherever in the name of the Order appears the phrase "Planting Fruitful Trees" it is replaced by "Fruitful Trees and Vegetables."
- Amendment of Article 1
2. In Article 1 of the Order--
- A) In the definition of "Fruitful trees" the words "The first" should be added after "Appendix".
- B) After the definition "Fruitful trees" comes:
- 1) "The vegetables"--agricultural development of the plants
shown in Appendix 2.
- 2) "Jericho region"-The region which carries this name and which is described on the map signed by the commander of the Israeli forces in the region and which is attached to the Order (Judea and Samaria)(No. 675) for the year 5736-1963/3.

- Addition to Articles 2A and 2B

- Supervising the development of vegetables

- A) It is prohibited to develop any vegetables in the Jericho district except after obtaining a written license from the relevant authority according to the conditions the latter demands.
- Growing for consumption

- B) The orders of Article 2 do not apply to people who grow vegetables not for marketing but for personal consumption for himself and the members of his family.

- Amendment of Article 5
4. In Article 5 of the Order the words "Land planted with trees" in paragraph (B) should be changed to "Place."
- Amendment of Article 9
5. In the title of Article 9 and also in the contents, the word "Appendix" is replaced by the word "Appendices."
- Amendment of Article 10
6. In Article 10 of the Order:
- 1) In paragraph (B) the phrase "The trees which were planted" is replaced by "The fruitful trees which were planted and the vegetables which were grown."
- 2) Paragraph (C) is omitted and replaced by "If someone is convicted in court of planting and developing fruitful trees or vegetables without a license and does not follow the court's order to uproot these fruitful trees or vegetables, the authorities can uproot them and the convicted person must pay the expenses. (Here are the fees for uprooting.)"
- 3) In paragraph (D) the word "Trees" is replaced with the phrase "Fruitful trees or vegetables."
- Amendment of the Appendix
7. The Appendix should be called "First Appendix" and after it comes:
- Implementation of this Order.
8. The implementation of this Order commences as of 31 January 1983.
