REGISTRATION OF INHABITANTS ORDINANCE
No. 50 OF 5709-1949*
THE PROVISIONAL COUNCIL OF STATE hereby enacts as follows:--
Interpreta-
tion
1. In this Ordinance -
  • "area of the Ordinance" means the area to which the law of the State of Israel applies;
  • "inhabitant" means a person whose permanent place of residence is within the area of the Ordinance, and includes a person who has been within the area of the Ordinance for three consecutive months;
Registration
of Inhabi-
tants.
2. A registration of inhabitants shall be introduced in the area of the Ordinance and shall be operated by registration offices.
Functions
of registra-
tion offices.
3. The functions of the registration offices shall be the following:
  • (a) to keep a Register of Inhabitants containing the particulars of registration enumerated in section 4;
  • (b) to issue, renew and enter changes in certificates of identity;
  • (c) to issue copies of and extracts from entries in the Register of Inhabitants and supply information as to the name and residential address of any inhabitant;
  • (d) to carry out any other function under this Ordinance or any other law.
Particulars
of registra-
tion.
4. The particulars of registration shall be the following:
  • (a) surname, first name and names of parents and, where the names have been changed before the registration, the former names as well;
  • (b) date and place of birth;
  • (c) sex;
  • (d) family status (single, married, widowed or divorced);
  • (e) date of immigration and date of settling at place of residence;
  • (f) nationality, ethnic group, religion;
  • (g) everyday language;
  • (h) ability to read and write;
  • (i) occupation, trade, profession;
  • (j) residential address and address of place of work;
  • (k) marriages and divorces;
  • (l) births;
  • (m) adoption;
  • (n) guardianship;
  • (o) departure from, and return to the area of the Ordinance;
  • (p) deaths.
Duty to no-
tify parti-
culars of re-
gistration.
5.
  • (a) Every resident who has attained the age of 16 years shall notify to the registration office the particulars of registration enumerated in section 4(a) to (j) in respect of himself and, if he has children who have not yet attained the age of 16 years, or if there is in his dwelling or under his protection an inhabitant who has not yet attained the age of 16 years, or who is incapable of performing the duty of registration himself, also in respect of such children or such inhabitant.
  • (b) The time for the performance of the duty of notification under subsection (a) shall be -
    • (1) in the case of an inhabitant who has attained the age of 16 years on or before the day of publication of this Ordinance - 30 days from such day of publication;
    • (2) in the case of an inhabitant who attains the age of 16 years after the day of publication of this Ordinance - 30 days from his 16th birthday;
    • (3) in the case of a person who becomes an inhabitant after the day of publication of this Ordinance - 30 days from the day of his becoming an inhabitant.
  • (c) Every inhabitant who has attained the age of 16 years shall notify the registration office of any change in the surname, first name, nationality and residential address of himself and the persons in respect of whom it is his duty to notify particulars of registration under subsection (a).
  • (d) The following inhabitants are under a duty to notify to the registration office the particulars of registration enumerated in section 4(k) to (n):
    • (1) in the case of marriages and divorces-each of the parties;
    • (2) in the case of births-each of the parents of the child;
    • (3) in the case of adoption or appointment of a guardian - the adopter or guardian.
  • (e) The time for notification under subsections (c) and (d) shall be 30 days from the day of the change or event subject to notification.
  • (f) An inhabitant who at the time of his becoming subject to the duty of notification is not within the area of the Ordinance shall give the notification within 30 days from the day of his arrival in the area of the Ordinance.
  • (g) The giving of a notification by one of the persons under a duty to give such notification, shall release all the others from such duty.
Procedure for
notification.
6. A person under a duty to give a notification to the registration office shall, upon demand by the registration officer -
  • (a) furnish, either orally or in writing, any relevant particular and produce any relevant document;
  • (b) affirm, either orally or in writing, the correctness of the particulars and documents furnished or produced by him.
Certificate
of identity.
7. An inhabitant who has attained the age of 16 years and who complies with the provisions of this Ordinance and the regulations made thereunder is entitled, after submitting an application and the number of photographs required from him, to obtain a certificate of identity from the registration office and to use it as a means of identifying himself.
Implementa-
tion.
8. The Minister of the Interior is charged with the implementation of this Ordinance, and may -
  • (a) establish registration offices and determine their location and area of jurisdiction;
  • (b) entrust to local authorities the performance of any function under this Ordinance or any regulations made thereunder.
Exemptions. 9. The Minister of the Interior may, by order published in Iton Rishmi, exempt classes of persons from compliance with all or any of the provisions of this Ordinance.
Regulations. 10. The Minister of the Interior may make regulations as to the following matters:
  • (a) the mode of delivery of notification of particulars of registration and changes thereof;
  • (b) the contents and form of questionnaires, forms, certificates of identity and other documents;
  • (c) the conditions of issue of certificates of identity and other documents and of supply of information;
  • (d) fees for certificates of identity and other documents and for any other service rendered by the registration offices;
  • (e) any other matter relating to the implementation of this Ordinance.
Secrecy. 11. A person who is, or has been, an employee of the State or a local authority shall keep secret any information obtained by him while exercising his functions under this Ordinance or any regulations made thereunder, unless he is lawfully authorised to disclose such information.
Penalties. 12.
  • (a) A person who --
    • (1) contravenes the provisions of section 11 of this Ordinance, or
    • (2) knowingly furnishes the registration office with false or inexact information as to any matter in respect of which he is bound to give information under this Ordinance, or
    • (3) without lawful authority gives a certificate of identity to any other person,
    shall be guilty of an offence and shall be liable to imprisonment for a term not exceeding six months or to a fine not exceeding 200 pounds or to both such penalties.
  • (b) A person who does not comply with the provisions of sections 5 or 6 of this Ordinance shall be guilty of an offence and shall be liable to imprisonment for a term not exceeding three months or to a fine not exceeding 100 pounds or to both such penalties.
Delegation
of powers.
13. The Minister of the Interior may delegate his powers under this Ordinance, except the power under section 10.
Repeal and
transitional
provisions.
14. The Emergency Regulations (Registration of Inhabitants), 5708-1948, are hereby repealed, provided -
  • (a) that a person who has given notification of particulars of registration, or of changes of particulars of registration, under the said Regulations, shall be exempt from giving notification of such particulars or changes under this Ordinance;
  • (b) that an identity booklet issued under the said Regulations shall be deemed to be a certificate of identity issued under this Ordinance.
Commence-
ment.
15. This Ordinance shall have effect as from the 2nd Shevat, 5709 (1st February, 1949).
Title. 16. This Ordinance may be cited as the Registration of Inhabitants Ordinance, 5709-1949.
