FLAG AND EMBLEM LAW, 5709-1949*
Inter-
pretation.
1.
  • (a) "State flag" means the flag which the Provisional Council of State, on the 25th Tishri, 5709 (28th October, 1948)(1), proclaimed as the flag of the State of Israel, or a flag, of any size whatsoever, similar in design to the said flag, and includes any object bearing the design of the State flag.
  • (b) "State emblem" means the emblem which the Provisional Council of State, on the 11th Shevat, 5709, (10th February, 1949)(1) proclaimed as the emblem of the State of Israel.
Use of State
flag for
purposes of
commerce,
etc.
2.
  • (a) No person shall use the State flag in any manner whatsoever for purposes of commerce, business or any trade, save under a licence or permit from the Minister of the Interior ; but the flying of the State flag or the manufacture of or dealing in State flags shall not be deemed to be use of the State flag within the meaning of this subsection.
  • (b) A person contravening this section shall be liable to imprisonment for a term not exceeding six months or to a fine not exceeding one hundred and fifty pounds or to both such penalties.
Use of State
emblem.
3.
  • (a) No person shall manufacture any object bearing on it the State emblem, save under a licence or permit from the Minister of the Interior.
  • (b) No person shall use the State emblem in any manner whatsoever, save under a licence or permit from the Minister of the Interior.
  • (c) A person contravening this subsection shall be liable to imprisonment for a term not exceeding six months or to a fine not exceeding one hundred and fifty pounds or to both such penalties.
Conditions

or permit.
4.
  • (a) A licence or permit issued under this Law may be general or to a particular person or class of persons, and the Minister of the Interior may impose therein such conditions and restrictions as he may think fit.
  • (b) The Minister of the Interior may, at any time, cancel a licence or permit issued under this Law.
Insult to
the State
flag or the
State emblem.
5. A person who insults, or causes to be insulted, the State flag or the State emblem, or uses the State flag or the State emblem in a manner constituting an insult to it, shall be liable to imprisonment for a term not exceeding one year or to a fine not exceeding three hundred pounds or to both such penalties.
Implemen-
tation and
regulations.
6. The Minister of the Interior is charged with the implementation of this Law and may make regulations as to any matter relating to its implementation, including regulations --
  • (a) prescribing the modes of the use of the State flag and the State emblem by State institutions and persons in the service of the State ;
  • (b) imposing conditions, prohibitions and restrictions on the use of the State flag in public ;
  • (c) prescribing the modes of honouring the State flag.
Delegation
of powers.
7.
  • (a) The Minister of the Interior may delegate to another person all or any of the powers vested in him by this Law, except the powers vested in him by section 6.
  • (b) A notice of any delegation of powers under this section shall be published in Reshumot.
Similar
flags and
emblems.
8.
  • (a) A flag so similar to the State flag that it might be mistaken for it, or an object bearing the design of such flag, shall, for the purposes of sections 2 and 6, be deemed to be a State flag.
  • (b) An emblem so similar to the State emblem that it might be mistaken for it shall, for the purposes of sections 3 and 6, be deemed to be the State emblem.
