FALLEN SOLDIERS' FAMILIES (PENSIONS AND REHABILITATION) (AMENDMENT No. 16) LAW, 5747—1987 *

Amendment of section 8.

1. In section 8 of the Fallen Soldiers' Families (Pensions and Rehabilitation) Law, 5720-1950⁽¹⁾ (hereinafter referred to as "the principal Law").

(1) subsection (d) is repealed;
(2) subsection (e) shall be re-marked as subsection (d) and before the words "and a fallen soldier's widow" the words "or a fallen soldier's widow so long as under the provisions of section 9(c) she is not entitled to a pension under subsection (b) or (c)" shall be inserted.

Amendment of section 10.

2. In section 10(g) of the principle Law, the closing passage, beginning with the words "so long as he is indigent", shall be replaced by the following closing passage: "so long as he has not remarried and his income is smaller than the pension paid to a bereaved parent under subsection (a), be entitled to a pension at the rate of the difference between his income and the pension under subsection (b). For this purpose, "income" means income from any source, including an old-age pension under the National Insurance Law (Consolidated Version), 5728-1968⁽²⁾, and including periodic payments received as compensation for damage to health caused by Nazi persecution".

Amendment of section 29A.

3. In section 29A(b) of the principal Law, the following shall be added at the end:

"Where a child of a fallen soldier has reached the age of thirty years and is not yet married, the pensions officer may pay him eighty per cent of the amount of the grant referred to in subsection (a)".

Transitional provision.

4. The provisions of section 2 shall not apply to a person who was entitled to a pension under section 10(g) of the principal Law, as in force before the enactment of this Law.
