General Terms and Conditions
All New Hosting Accounts with Highland Communications Have a 45-day Money Back Guarantee.
Highland Communications agrees to provide the client web hosting for a monthly fee. Clients are allowed to use the service for business or personal digital content.
Acceptable Content
All services provided by Highland Communications may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States law governing internet content is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, or material protected by trade secrets and other statute. The subscriber agrees to indemnify and hold harmless Highland Communications from any claims resulting from the use of the service which damages the subscriber or any other party.
Refusal of Service
Highland Communications reserves the right at its sole discretion to refuse or cancel service. Violation of any of Highland Communications' Rules and Regulations could result in a warning, suspension, or possible account termination. Accounts suspended or terminated due to policy violations will not be refunded.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Highland Communications (or it's employee's/owners) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against Highland Communications, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Highland Communications against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Highland Communications server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement. Customer agrees to limit the liability of Highland Communications to the amount paid for service and that refund of fees paid within our terms of service will satisfy any claim made against Highland Communications.
Refund and Cancellation Policy
New clients may cancel their account at any time and receive a full refund (excluding any setup, domain name registration, IP address or SSL fees incurred) if canceled within our forty five (45) day money-back guarantee period. You may cancel for any reason. Email to [email protected] will suffice as notice of cancellation, alternatively, you may simply cancel your subscription at PayPal and they will notify us of the cancellation.
After forty five (45) days you may cancel your hosting account for any reason without refund.
Late Payment
Any account whose payment status is not current as of the start of the next billing period is deemed late. Customers are given a 10 day grace period after which the client is notified that their account is under suspension. Accounts not paid within 30 days of due date are terminated for nonpayment of services.
Abuse Policy
Intellectual Property Rights
Material accessible to you through Highland Communications Services may be subject to protection under the United States of America (or any other country) copyright laws, or laws protecting trademarks, trade secrets or proprietary information. Except when expressly permitted by the owner of such rights, you must not use the Highland Communications Service in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you access or receive through the Highland Communications Network. If you use a domain name in connection with the Highland Communications Service or similar service, you must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.
Spam or Unsolicited E-mail
You must not use the Highland Communications Network, Highland Communications equipment or any Highland Communications e-mail address in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited e-mail messages. A message may be considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. For purposes of this provision, merely making one's e-mail address accessible to the public will not constitute a request or invitation to receive messages.
If you are found to have indeed habitually spammed, Highland Communications reserves the right to disable your domain. Highland Communications solely reserves the right to refuse or cancel service to known spammers. Lastly, Highland Communications reserves the right to determine what violates this policy. As such, any violation may result in cancellation of services without refund.
Background Running Programs
We do not allow continually running background programs or daemons. This includes any IRC related software such as bouncers and bots. In certain cases we may allow programs to run continually in the background, these are considered on a one to one basis and an extra charge will be incurred based on system resources used and operational maintenance needed. The best practice is to ask first rather than be caught.
Overage Charges
All accounts are responsible for monitoring their use of bandwidth. I the very unlikely event that the customer exceeds their bandwidth allotment, they will be charged at the following rates.
$0.25 per MB, per month; payable prior to the start of the next monthly bandwidth cycle. We will bill you separately for this charge. Unpaid bandwidth accounts will treated according to our terms of service.
Customers who stream video should pay close attention to their use of bandwidth.
