Graham Here is a time line I have put together while researching the Graham's hoping to be able to fill in some gaps. 1796 � Elizabeth Born Moneghan County, Ireland 1800 � Robert Born Moneghan County, Ireland 1823 � October - Robert came to the US 1825 � Daughter Eliza Jane born 1830 � Madison County Census � Robert Head of Household the names are not listed but these are my guesses 1 male.....30-40....Robert 1 female...20-30....Elizabeth 1 female....5-10....Eliza Jane (probably) 1 female....0-5.....Sarah or Margaret, she was born in this year 183_ - Daughter Sarah Born 1839 � August 23rd � Robert requests naturalization 1840- Madison County Census � Robert Head of Household again the names are not listed but these are my guesses. 1 male..........40-50...Robert 1 female........30-40...Elizabeth 2 female........10-15...Eliza Jane (14) and Margaret (10) �ages according to 1850 census 1 female.........5-10...Sarah 1841- Eliza J probably married John Huey in this year 1842 � February 22nd � Robert Granted Citizenship in Madison County 1849 � July 25th � Robert died 1849 - September 20th � John Hughey, Eliza Jane Hughey, and Margaret Maria Graham sign/sealed Statement of will for Robert 1850 � Madison County Census These two households were listed next to each other, so they were living very close to each other. The declarations of Robert Graham, an alien, made for the purpose of enabling him to become a naturalized citizen of the United States of America. The said Robert Graham declares, an oath that it is his bona fide intention to become a citizen of the United States of America that he was born in the county of Monaghan in Ireland � that he has resided in the United States since the [blank] day of October, eighteen hundred and twenty three and that it is his bona fide intention to renounce forever all allegiance and fidelity to any foreign Prince, Potentate, State, of Sovereignty whatsoever and particularly that it is his intention to renounce former allegiance and fidelity to Victoria, Queen of the United Kingdom of Great Britain and Ireland. -Robert Graham Page 269 Date: Tuesday February 22nd 1842 Robert Graham an alien who has heretofore to wit at the August term of said court to the year of Our Lord One thousand eight hundred and thirty nine declared his intention of record [?] to become a citizen of the United States of America leaving heretofore, to wit on the twenty third day of August in the year of Our Lord one thousand eight hundred and forty one made application to be admitted, as such and being duly sworn, an oath declares that he will support the constitution of the United States of America and that he do the absolutely and entirely renounce and abjure forever all allegiance and fidelity to any foreign Prince, Potentate, State, of Sovereignty, whatsoever, and particularly that it is his intention to renounce forever all allegiance and fidelity to Victoria, Queen of the United Kingdoms of Great Britain and Ireland, whereof before he was a subject � where upon the same is ordered to be entered of record. It is therefore considered by the court of that the said Robert Graham be admitted to allthe rights and privileges of a citizen of the United States of America. This is Robert Graham's Will. I have transcribe it as best I can. I will eventually provide a link to the original which is very difficult to read. There were a few parts that I couldn't make any sense of, I have left a space for these. Deed Book X Page 420 Elizabeth Graham John Huey and wife Margaret M. Graham To Agreement Whereas an instrument of writing purporting to be the last will and testament of Robert Graham, late of the Town of Huntsville in the county of Madison in the State of Alabama was drawn up at the request of said Robert Graham deceased but which never was executed by him, but which is expected by him we be duly proven as his non cupative will and whereas the said is signed, being the [?] and heirs at law of said Robert Graham, deceased an willing and decisions that instrument of writing afor said shall be conscious by them to all interest and purpose as really his last will and testament duly executes and attested by three or more competent witnesses and duly proven as such last will and testament. Now therefore be it known that we the undersigned do hereby agree and obligate ourselves in consideration of the promises that the property of which the said Robert Graham [?] seized and possessed, whether real or personal and every known description shall be and remain in the possession and under the control of his widow Elizabeth Graham for and during her natural life and after her death shall belong to and be divided amongst his children in the same manner and precisely as though the said instrument of writing purporting to be the last will and testament of the said Robert Graham deceased which is dated the Twenty fifth day of July in the year of One thousand eight hundred and forty nine had here duly proven in open court by three or more competent witnesses and duly nominated to record. In testimony where of we hereto subscribe our names and affix our seal in said Town of Huntsville this the twentieth day of September in the year of One thousand eight hundred forty nine. Steele shows unto your honor that Elizabeth Graham who was a citizen and resident of said county died that in on [blank] day of March 1866 that before her death the said Elizabeth Graham made and published her last will and testament, executed and dated 10th March 1866 and duly [?] by T. B. Winston and James Robinson as subscribing witnesses � your petitioner who is nominated by said will as the executor there of now brings the same into court and prays that it be established and admitted to probate as the last will ad testament of said Elizabeth Graham. The said Elizabeth Graham left two children Eliza Jane Huey (wife of John Huey) who with her husband resided in said County of Madison and Margaret M. O�Neal (wife of John W. O�Neal) who with her said husband, resides in the State of North Carolina, and the said Eliza Jane Huey and Margaret M. O�Neal are the only heirs at law of said Elizabeth Graham. Petitioner prays for citation and publication as requested by law. R. W. Walker, Atty. For the petitioner I Elizabeth Graham of the County of Madison and State of Alabama do make and publish this my last will and testament, and I hereby disperse of all of my property in the following way. 1st: I wish that all the debts I may owe at my death and funeral expenses shall be fully paid off. 2nd: I will and that all my property of every kind, real, personal and mixed shall be divided into two equal parts. 3rd: I give bequeath and devise and of these parts, the due half of my property to my daughter Eliza Jane Huey, wife of John Huey, to have and to hold to her during her live, and no longer, and at his death I give bequeath and devise the half so given to her, to her children now in life, and thereafter to be born to be divided equally amongst them. 4th: I give, bequeath ^ and devise the other part, being the other half of my property to my friend Joseph C. Steele, to be by him held in trust for the sole and separate use of my other daughter Margaret M. O�Neal wife of John W. O�Neal for and during her life and no longer. (Pg 2) During the life of my said daughter Margaret, said Steele on such that person or property shall act as trustee in his stead, shall retain the entire control of said half of my property. He shall receive said property, and all the on property dividing all of it, and pay it to her above, for her support. In no way shall the property itself be used, only the [?] on property thereof and in no way shall the said John W. O�Neal become trustee for his wife, or have any right to or control over the property. 5th: After the death of my said daughter Margaret, I give bequeath and devise the said one half, so above give to said Steele in trust for her, to her children now in life, and here after to be born to her equally divided amongst them. I hereby appoint my friend Joseph C. Steele the executor of this my last will and testament. With by hand and seal this the 10th day of March 1866.
