Discrimination in mortgage lending is prohibited by the federal Fair Housing Act and HUD's Office of Fair Housing and Equal Opportunity actively enforces those provisions of the law. The Fair Housing Act makes it unlawful to engage in the following practices based on race color national origin, religion, sex, familial status, or disability.
Refuse to make mortgage loan
Refuse to provide information regarding loans
Impose different terms or conditions on a loan, such as different interest rates, points, or fees
Discriminate in appraising property
Refuse to purchase a loan  or set different terms or conditions for purchasing a loan
With respect to the information above, a recent article in the Realty Times, "Racial Lending Disparities Widen", concludes that while there are laws in place to assure equal lending opportunity for everyone, this is simply not the case.

While the Fair Lending Laws do help, there are no laws on the books that guarantee that your mortgage broker will treat you with respect and use the same degree of integrity in originating your loan as anyone else's.
