Emily
On October 8, 2000, in Erwin, Tennessee, little Emily, a Manx cat, wandered over to neighbor Tommy Fender's yard. Innocently sitting at the edge of Tommy Fender's garden, she didn't realize that Tommy was going to shoot her with a bow and arrow until the searing pain rippled through her body. Emily's mom and dad, Edna and Frank Yates, witnessed the murder of their sweet little Emily in horror and called the police.

Fender admitted to the police that he killed Emily, as well as intentionally killing another cat approximately one month prior to October 8. Fender stated that Emily was attacking his fighting chickens. It should be noted that chicken fights are illegal in the State of Tennessee, so why was Tommy Fender even raising them?

According to police reports, when an officer arrived on the scene, he found Emily dead at the edge of the roadway off of the offender's property. The officer followed the blood trail approximately 10 to 12 feet into Tommy Fender's garden. Fender's chickens were approximately 300 yards from where Emily was shot, and there was no evidence of dead chickens.

So, why did Tommy Fender shoot and kill Emily? What was the real reason? We may never know. But what we *do* know is that, because of this arrogant jerk's actions, poor little Emily was violently torn from this world and a warm loving home and people who truly loved her and who she loved in return.

Tommy Fender has been charged with Intentional Killing of an Animal and appeared in court on Friday, June 22, 2001. Tommy Fender admitted to the police that he did in fact shoot Emily and kill her with a bow and arrow. But yet in court on Friday he pleaded "Not Guilty".
Not Guilty? Right.

next trial date is set for August 8, 2001, at 8:30 a.m. Please support Emily, Edna and Frank by writing the Johnson City Sheriff and the District Attorney General to inform them of your desire for a guilty verdict and the strongest sentence allowable by law.

Victory for Emily!
Tommy Fender was found
GUILTY of the "Intentional Killing of an Animal" in court today and was sentenced to the following:
1.   $2,400 fine  ($2,500 is the maximum.)
2.   48 hours in jail
3.   11 months and 29 days probation
4.   He had to make a public apology to the Yates'.
This does not seem like much, but it is a major victory in this area of the country.
In this area, this crime is usually considered insignificant.

Between this conviction and a conviction for another un-related crime, Tommy Fender will be on probation until the year 2004.
Please write letters to the following individuals, thanking them for their tremendous support and diligence in pursuing this case for the Yates'.  They were instrumental in ensuring that Tommy Fender received the verdict today that he did, and they have been very kind to and supportive of Edna and Frank Yates during this emotional and grief-filled ordeal.
